1. Reference: Memorandum from the OIC, RPRMD dated February 20, 2019.
2. This pertains to the Motion for Reconsideration (MR) filed by PSSg John
Rossmond Domingo Cruz relative to the Decision of the Regional Director, PRO
CALABARZON dated January 23, 2020, finding him liable for Grave Neglect of Duty
(AWOL) and imposing upon him the penalty of Dismissal from the police service.
3. Respondent-movant in his motion interposed the following grounds:
a. Respondent-movant claimed that the continuous absences are justified

due to difficulty in breathing that caused by Asthmatic Bronchitis; and
b. Respondent-movant was included in the High Value Target of the PNP

for the unknown reason.
4. This Office finds that the Motion for Reconsideration is without merit.
A. Section 20, Rule 17 of NAPOLCOM Memorandum Circular No. 2016-

002 explicitly provides that "the party adversely affected by the decision
may file a motion for reconsideration with the Disciplinary Authority which
rendered the same within ten (10) days from receipt of a copy thereof
based on any of the following grounds:
a. Newly discovered evidence which, if presented, would materially

affect the decision rendered; and
b. Errors of law or irregularities have been committed prejudicial to the

substantial rights and interest of the movant.
B. The motion for reconsideration filed by PSSg John Rossmond Domingo

Cruz interposed no new issues raised or presented newly discovere

evidence that would affect the decision of the Disciplinary Authority. As
mentioned in the above cited NMC provision, in order for an MR to be
given due course, the same should be based on the grounds stated
therein. Otherwise, this Office will be constrained not to give due course
over the same. In his MR the movant essentially raised issues which do
not fall under any of the grounds enumerated in the aforementioned rule.
Therefore, there is no cogent reason to disturb the assailed Decision

being based on the findings well supported by substantial evidence. The
motion for reconsideration, should therefore, fail.
5. In view thereof, this Office recommends that the Motion for Reconsideration
filed by PSSg Rossmond D Cruz be DENIED for lack of merit. Attached is the proposed
resolution for your approval (LS-1).

RESOLUTION
This resolves the Motion for Reconsideration tiled by PSSg John Rossmond

COMES NOW respondent and to this Honorable Office most respectfully

files his Motion for Reconsideration on the Decision rendered by PBGen. Vicente
D. Danao Jr on January 23, 2020 which was received by the respondent on
February 7, 2020, dispositive portion of which reads as follows:
"WHEREFORE, premises considered, the Disciplinary Authority finds

the respondent Pcpl John Rossmond Domingo Cruz GUILTY of Grave
Neglect of Duty (AWOL) abd meted the minimum penalty of
DISMISSAL from the Police Service pursuant to NAPOLCOM
Memorandum Circular No. 2016=002.
SO ORDERED."
FACTS OF THE CASE
The Disciplinary Authority charges the respondent as follows:
That P02 John Rosmond Domingo Cruz 188691, who is presently assigned
at Morong MPS, Rizal PPO has failed to report for duty on October23, 2017 to
November 23, 2017. Subject PNCO absenting himself without informing neither
his superior officer nor the reason of his absences for the above mentioned period.
His whereabouths cannot be ascertained prompting Morong MPS, Rizal PPO sent
him a Memorandum re-Notice to Report by PCINSP PERLITO RUBANO TUAYON,
Chief of Police, delivered personal by Mobile Patrol duty PNCO, of Morong MPS to
the last known address reflected to his personal data sheet directing him to report
immediately for duty. However, the latter failed to report on the prescribed period,
hence this complaint.

In his defense Pcpl Cruz c;aimed that the continuous absences are justified.
On October 23, 2017 he suffered from difficulty in breathng that caused by
Asthmatic Bronchitis wherein he was advised by Dr. Josme M. Macabuhay of Mc
Life Surgical-Medical Clinic located at No. 30 Sumulong St. Antipolo City to rest for
thirty-nine (39) days and will fit to resume for work on December 1, 2017. On
December 1, 2017 ge returned to the hospital for follow-up check-op and the same
findings were seen. He was advised agaoin to rest for twenty seven (27) days and
will be fit to work on December 28, 2017. PCpl Cruz also stated that his mother
was rushed to Binangonan Lakeview Hospital, lnc, Binangonan, Rizal on November
11, 2017 because of Acute Respiratory Failure, Acute Congestive Heart Failure.
His mother was admitted on November 13, 2017 and he had to take care of her.
In addition, herein respondent was included in the Hgh Value Target of the
PNP for unknown reason. Upon know;edge that he was one of the suspect being
sought by the ClTF, he gone into hiding in fear for his life. While he personally knew
that he is not involved in any illegal drug activities in any manner, he hid in different
places including the said medical clinic and hospital to save his life considering the
political climate at that time until some of his comrades in the police force vouched
for his true identity telling the higher authorities that the respondent is not
involved in any illegal drug activities whatsover.
At present albeit, he was cleared by the higher authorities in any illegal drug
activities involvement, he was ordered to report directly to Chief of PNP for further
verification. The certification to that effect will be submitted to this Honorable
Office upon its release.
RULING OF THE DISCIPLINARY AUTHORITY
The previous medical records in favor of respondent cannot be given

probative value and its contents cannot be deemed to constitute proof of the facts
stated therein. In this case, since the doctor who examined the respondent was
not presented to testify during the Pre-Hearing Conference nor executed an
affidavit to identify the medical certificate. Since a medical certificate involves an
opinion of one who must first be established as an expert witness, it cannot be
given weight or credit unless the doctor who issued it is presented or executed an
affidavit. Thus, an unverified and unidentified private document cannot be
accorded probative value. It is precluded because the prosecution is deprived of
the right and opportunity to cross-examine or question the person to whom the
statements or writings are attributed. Being mere hearsay evidence, failure to
execute an affidavit or present the attending physician of the medical certificate
renders its contents suspicious and no probative value.
Respondent's defense failed to discharge him from administrative liablity.

Neither can it be appreciated as mitigating circumstances. First, the Medical
Certificates presented by the respondent was not even validated by the PNP Health
Service. The respondent was not even confined in hospital which leads us to infer
that his alleged health problems were not so serious that could incapacitate him to
work and to inform his superior officer of his condition. Respondent should have
filed for sick leave, as a matter of procedure. Second, respondent claimed that for

more or less ten (10) years of service, his service remained untarnished by any
wrong doing. Ironically, records show that he was previously charged of Grave
Neglect of Duty (AWOL) and meted penalty of forty nine (49) days Suspension from
the Police Service.
ARGUMENT
The absences without leave committed by the respondent is justified
In two (2) decisions of Supreme Court, it treated with compassion an

absence although without prior leave for causes beyond the control of the absent
employee. In Re: Pedro P. Tiongson,' the Supreme Court ruled that:
"the misfortunes that were visited upon his family and which prevented
him from attending office were not of his own making and were beyond
his control. It was but natural for him to move his family in the face of
danger from his son's enemies and when he was in the province, even if
he wanted to return, he could not do so on account of the floods.
In Makabuhay v. Manuel2 we recognized that an employee may be

forced to go on leave even if he no longer has any leave credits because
of the administrative case that was filed against him.
In the case of City Government of Makati, vs, Civil Service Commission3 ,
the Supreme Court ruled:
"Lastly, petitioner City Government cannot pin the blame on private

respondent Gaizote for her failure to assume her work. Clearly, she
reported for work as soon as she was free to do so, but was
unfortunately turned back by petitioner City Government. In locking her
out of her job, the City Government illegally deprived her of the
opportunity to work and so must be held liable for such unlawful action.
All in all, we hold that private respondent must be reinstated as Clerk III
or a position of equivalent rank and compensation in the City
Government. She must also be paid back wages and other benefits
lawfully due her counted from 19 October 1994 when she presented
herself for resumption of duties but was refused. This is very much
consistent with the elementary rule that a government official or
employee who had been illegally dismissed and whose reinstatement
had later been ordered is considered as not having left his office, so that
he is entitled to all the rights and privileges that should accrue to him by
virtue of the office that he held.

By analogy, the case of Adalim v. Taninas, et., al.,4, provides that:
"At the outset, Adalim assails the CSC's liberal application of its rules. In
a number of cases, we upheld the CSC's decision relaxing its procedural
rules to render substantial justice. The Revised Rules on Administrative
Cases in the Civil Service themselves provide that administrative
investigations shall be conducted without strict recourse to the
technical rules of procedure and evidence applicable to judicial
proceedings. The case before the CSC involves the security of tenure of
public employees protected by the Constitution. Public interest
requires a resolution of the merits of the appeal instead of dismissing
the same based on a rigid application of the CSC Rules of Procedure.
Accordingly, both the CSC and the CA properly allowed respondent
employees' appeal despite procedural lapses to resolve the issue on the
merits."
Prescending from the foregoing, the respondent could not have filed
his leave of absence as he fears for his life knowing fully well that during that
time many were killed on war against drugs particularly those who fights
against the authorities and his absences is beyond his control.
WHEREFORE, it is most respectfully prayed of this Honorable Court that

the Decision dated January 23, 2020 rendered by PBGen. Vicente D. Danao Jr
be reconsidered and set aside and a new one be issued absolving herein
respondent of the charged of Grave Neglect of Duty AWOL.

that he is not involved in any illegal drug activities in any manner, he hid in different
places including the said medical clinic and hospital to save his life considering the
political climate at that time until some of his comrades in the police force vouched
for his true identity telling the higher authorities that the respondent is not
involved in any illegal drug activities whatsover.
At present albeit, he was cleared by the higher authorities in any illegal drug
activities involvement, he was ordered to report directly to Chief of PNP for further
verification. The certification to that effect will be submitted to this Honorable
Office upon its release.
RULING OF THE DISCIPLINARY AUTHORITY

not presented to testify during the Pre-Hearing Conference nor executed an
affidavit to identify the medical certificate. Since a medical certificate involves an
opinion of one who must first be established as an expert witness, it cannot be
given weight or credit unless the doctor who issued it is presented or executed an
affidavit. Thus, an unverified and unidentified private document cannot be
accorded probative value. It is precluded because the prosecution is deprived of
the right and opportunity to cross-examine or question the person to whom the
statements or writings are attributed. Being mere hearsay evidence, failure to
execute an affidavit or present the attending physician of the medical certificate
renders its contents suspicious and no probative value.

Neglect of Duty (AWOL) and meted penalty of forty nine (49) days Suspension from
the Police Service.
ARGUMENT
The absences without leave committed by the respondent is justified
In two (2) decisions of Supreme Court, it treated with compassion an

absence although without prior leave for causes beyond the control of the absent
employee. In Re: Pedro P. Tiongson,' the Supreme Court ruled that:
"the misfortunes that were visited upon his family and which prevented
him from attending office were not of his own making and were beyond
his control. It was but natural for him to move his family in the face of
danger from his son's enemies and when he was in the province, even if
he wanted to return, he could not do so on account of the floods.
In Makabuhay v. Manuel2 we recognized that an employee may be

forced to go on leave even if he no longer has any leave credits because
of the administrative case that was filed against him.
In the case of City Government of Makati, vs, Civil Service Commission3 ,

the Supreme Court ruled:
"Lastly, petitioner City Government cannot pin the blame on private

respondent Galzote for her failure to assume her work. Clearly, she
reported for work as soon as she was free to do so, but was
unfortunately turned back by petitioner City Government. In locking her
out of her job, the City Government illegally deprived her of the
opportunity to work and so must be held liable for such unlawful action.
All in all, we hold that private respondent must be reinstated as Clerk III
or a position of equivalent rank and compensation in the City
Government. She must also be paid back wages and other benefits
lawfully due her counted from 19 October 1994 when she presented
herself for resumption of duties but was refused. This is very much
consistent with the elementary rule that a government official or
employee who had been illegally dismissed and whose reinstatement
had later been ordered is considered as not having left his office, so that
he is entitled to all the rights and privileges that should accrue to him by
virtue of the office that he held.

By analogy, the case of Adalim v. Taninas, et., al.,4, provides that:
"At the outset, Adalim assails the CSC's liberal application of its rules. In
a number of cases, we upheld the CSC's decision relaxing its procedural
rules to render substantial justice. The Revised Rules on Administrative
Cases in the Civil Service themselves provide that administrative
investigations shall be conducted without strict recourse to the
technical rules of procedure and evidence applicable to judicial
proceedings. The case before the CSC involves the security of tenure of
public employees protected by the Constitution. Public interest
requires a resolution of the merits of the appeal instead of dismissing
the same based on a rigid application of the CSC Rules of Procedure.
Accordingly, both the CSC and the CA properly allowed respondent
employees' appeal despite procedural lapses to resolve the issue on the
merits."
Prescending from the foregoing, the respondent could not have filed
his leave of absence as he fears for his life knowing fully well that during that
time many were killed on war against drugs particularly those who fights
against the authorities and his absences is beyond his control.
WHEREFORE, it is most respectfully prayed of this Honorable Court that
the Decision dated January 23, 2020 rendered by PBGen. Vicente D. Danao Jr
be reconsidered and set aside and a new one be issued absolving herein
respondent of the charged of Grave Neglect of Duty AWOL.

DECISION
This resolves the administrative case filed by the Philippine National Police
thru Pre-Charge Investigation Section (PClS), Regional Investigation and Detective
Management Division 4A (RIDMD) against PCpl John Rossmond Domingo Cruz
188691, member of Morong Municipal Police Station, Province of Rizal, for Grave
Neglect of Duty (AWOL) docketed as PRO 4A-AC-147-0509-18-RIZ.
ANTECEDENT FACTS
On this reason, Investigation ensued at Rizal Police Provincial Office, after

which probable cause was found. Hence the filing of the formal charge dated
January 8, 2018 read as follows:
That P02 John Rosmond Domingo Cruz 188691, who is presently

assigned at Morong MPS, Rizal PPO has failed to report for duty on October
23, 2017 to November 21, 2017. Subject PNCO absenting himself without
informing neither his superior officer nor the reason of his absences for the
above mentioned period. His whereabouts cannot be ascertained prompting
Morong MPS, Rizal PPO sent him a Memorandum re-Notice to Report by
PCINSP PERLITO RUBANO TUAYON, Chief of Police, delivered personal by
Mobile Patrol duty PNCO, of Morong MPS to the last known address reflected
to his personal data sheet directing him to report immediately for duty.
However, the latter failed to report on the prescribed period, hence this
complaint.
Investigation report dated November 21, 2017, found that PCpl Cruz failed to
report from October 23, 2017 to November 21, 201 ——

Investigation disclosed that PCpl Cruz, member of the Philippine National
Police (PNP), was assigned at Morong MPS, RPPO, when the Office of the Regional
Personnel and Human Resource Development Division (RPRMD) issued Special
Orders Number 2911 dated November 15, 2017 placing him on Absent Without
Official Leave (AWOL) status effective October 23, 2017, for incurring continuous
absences without official leave. PCpl Cruz has been AWOL for a period of thirty (30)
days, from October 23, 2017 to November 21, 2017.
Three (3) consecutive notices to report dated October 30, 2017, November 2,
2017, and November 4, 2017 were sent to the respondent which were received by
his relative. However, subject PNCO still failed to report.
Hence, Pre-Charge Investigation ensued at Rizal Provincial Investigation and

Detective Management Branch (RPIDMB) which further referred the case to PClS,
RIDMD 4A who in turn found probable cause. Thus, formal charge dated January 28,
2017 was filed against the respondent.
After the Summary Dismissal Proceedings conducted by PLT NOEL

TUMAMAO GAMIAO, Summary Hearing Officer (SHO), respondent was found guilty
of the offense charged with a recommendation of minimum penalty of six (6) months
suspension from the police service.
ISSUES/FJNDINGS
The issue to be resolved is whether or not the respondent, PCpl John

Rossmond Cruz is liable for Grave Neglect of Duty (AWOL).
PCpl Cruz claimed that his continuous absences are justified. On October 23,
2017, he suffered from difficulty in breathing that caused by Asthmatic Bronchitis
wherein he was advised by Dr. Josme M. Maca buhay of Mc. Life Surgical Medical
Clinic located at No. 30 Sumulong St., Antipolo City to rest for thirty-nine (39) days
and will fit to resume for work on December 1, 2017. On December 1, 2017, he
returned to the hospital for follow-up check-up and the same findings were seen. He
was advised again to rest for twenty-seven (27) days and will be fit to work on
December 28, 2017. PCpl Cruz also stated that his mother was rushed to
Binangonan Lakeview Hospital, Inc., Binangonan, Rizal on November 11, 2017
because of Acute Respiratory Failure, Acute Congestive Heart Failure. His mother
was admitted on November 13, 2017 and he had to take care of her.

Under PNP Memorandum Circular No. 2016-062, Absence Without Official
Leave (AWOL) in general, it refers to the status of any official or employee who
absents himself/herself from work without an approved leave of absence.
Under Rule 21 Sec 2(C) para j of NAPOLCOM Memorandum Circular No.

2016-002, the act of respondent is considered Grave Neglect of Duty which states:
"absent oneself from office without having filed the necessary application for leave or
secured approval of the authorized official for a period of more than fifteen (15) days
prior to the enjoyment of the leave."
It is clear on the provisions of the said circular that respondent's liability exists.
He was absent for more than fifteen (15) days without informing his superiors to
secure approval. In today's technology, communication is too accessible. In using
cellphones, emails, and other social media sites, you can connect in just one click to
any person you want to contact. Therefore, his illness cannot justify absences nor
exculpate him from administrative charge. There is no evidence on records that PCpl
Cruz filed the necessary application for leave for his continuous absences.
It also states under Rule 5 Section 1, paragraph d of NAPOLCOM

Memorandum Circular No. 2016-002 states that "any member or officer that has
been absent without official leave for a continuous period of thirty (30) calendar
days or more are subjected for Summary Dismissal Case." This provision, if proven,
warrants the maximum penalty of dismissal from the police service.

WHEREFORE, premises considered, this Disciplinary Authority finds the

respondent, PCpl John Rossmond Domingo Cruz GUILTY of Grave Neglect of Duty
(AWOL) and meted the minimum penalty of DISMISSAL from the Police Service
pursuant to NAPOLCOM Memorandum Circular No. 2016-002.

3. In the Daily PNP Personnel Accounting Report (DPPAR) of Morong MPS,

Morong, Rizal, it was documented that PCpl Cruz failed to report for duty from
October 23, 2017 to November 21, 2017 thereby incurring thirty (30) days of
unauthorized absences without having filed the necessary application for official
leave or secured approval from the authorized official.
4. Three (3) Memorandum of Explanations and Memorandum of Notices to

Report dated October 30, November 2 and November 4, 2017 respectively were
issued by PMAJ PERLITO R TUAYON, Chief of Police and delivered thru Mobile
Patrol duty PNCO to the last known address of the respondent and received by the
latter's relative Nicetas D. Cruz. However, the respondent still failed to report.
5. The Pre-Charge Investigation ensued in Rizal Provincial Investigation and

Detective Management Branch (PIDMB) which further referred the case to PCIS,
RIDMD 4A which found probable cause for the indictment of the respondent. Thus,
formal charge dated January 8, 2018 was filed against the respondent.
6. Respondent posited that on October 23, 2017, he suffered from difficulty in

breathing that caused by Asthmatic Bronchitis, attending physician, Dr. Josme M.
Legal Opinion on Administrative Case filed against PCpl John Rossmond Domingo Cruz
Macabuhay of Mc Life Surgical-Medical Clinic advised him to rest for thirty-nine (39)
days and will be fit to resume for work on December 1,2017. On December 1,2017,
PCpl Cruz returned to the clinic for follow-up check-up and same findings were seen.
The attending physician advised again the respondent to rest for twenty-seven (27)
days and will be fit to work on December 28, 2017. The latter further stated that his
mother was rushed to hospital on November 11, 2017 for findings of Acute
Respiratory Failure, Acute Congestive Heart Failure. Hence, his mother was
admitted on November 13, 2017 and he had to take care of her.
7. After judicious evaluation of the case records, the Summary Hearing

Officer finds the respondent, PCpl John Rossmond Domingo Cruz GUILTY of the
offense charged and recommended in its minimum penalty of six (6) months
suspension from the police service as stated on the NAPOLCOM Memorandum
Circular No. 2016-002, Rule 21, Section 2, Para C (1) (j), read as follows: "Absent
oneseff from the office without having filed the necessary application for leave or
secured approval of the authorized official for a period of more than fifteen (15) days
prior to the enjoyment of the leave."
8. As a matter of procedure, when the respondent suffered from difficulty in

breathing that caused by Asthmatic Bronchitis, the latter should inform immediately
thru any available means his superior officer purposely to inform him about his status
or whereabouts and he couldn't report for official duty. But the latter obviously failed
to do so. Respondent can also filed a sick leave after he recuperated his sickness,
nevertheless he deliberately failed to comply and continue his unauthorized
absences. This circumstance is sufficient proof of respondent's clear and deliberately
intent to abandon his job as a police officer as well as the FNP organization.
9. The two (2) Medical Certificates present by respondent for mitigating

conditions was not validated by PNP Health Service and were not notarized, thus,
cannot be given probative value. PCpl Cruz undergone examined and treated only
but not admitted. It is so glaring that he was not confined in the hospital which shows
that his sickness was not so serious to incapacitate him to his work or even to inform
his superior of his condition. Further, the Position Paper submitted by respondent
was not subscribed and verified, thus, respondent pleading is considered as mere
scrap of paper which totally bereft of legal effect.
10.Respondent cite his defense that for more or less ten (10) long years in
the police service, he remained untarnished by any wrong doing, however, record
shows that respondent was previously charge with Grave Neglect of Duty (AWOL)
for failure to report for official duty from September 3, 6 to 10, 2016 and October 15,
16, 18, 19, 21 to 27, 2016 with a total incurred for seventeen (17) intermittent days of
unauthorized absences, thus, respondent was found guilty and meted the penalty of
forty-nine (49) days suspension from the police service.

11.Clearly, the respondent incurred thirty (30) days of unauthorized absences

for which reason the penalty of dismissal shall apply. Under Section 42, Para a of
RA 6975 as amended by Section 53, RA 8551 provides: "Any member or officer of
the PNP who shall go on absence without official leave (AWOL) for a continuous
period of thirty (30) days or more shall be dismissed immediately from the sen/ice."

REPORT OF INVESTIGATION I RESOLUTION
This pertains to the Administrative Summary Proceedings against P02 John

Rossmond Domingo for Grave Neglect of Duty (AWOL).
In the Charge Sheet, the Chief, PCEIS-RIDMD 4A as nominal complainant

hereby accused the above-named respondent for Grave Neglect of Duty (AWOL)
pursuant to NAPOLCOM Memorandum Circular 20 16-002, committed as follows;
That P02 John Rossmond Cruz BN 188691, who is presently assigned at

Morong Municipal Police Station, Rizal PPO has failed to report for duty on October 23,
2017 to November 21, 2017. Subject PNCO absented himself without informing neither
his superior officer nor the reason of his absences for the above-mentioned period. His
whereabouts cannot be ascertained prompting Morong MPS, Rizal PPO to send him
Memorandum re-Notice to Report by PCINSP PERLITO RUBANO TUAYON, Chief of
Police. Delivered personally by Mobile Patrol duty PNCO, of Morong MPS at his last
known address reflected in his personal data sheet directing him to report immediately
for duty. However, the latter failed to report.
Acts committed in violation of existing PNP laws and regulations.
FACTS OF THE CASE
P02 John Rossmond Domingo Cruz with Badge Nr. 188691 is a bonafide
member of the Philippine National Police assigned at Morong Municipal Police
Station, Morong Rizal.
In the Daily PNP Personnel Accounting Report (DPPAR) of Morong Municipal

Police Station, Morong, Rizal it was recorded that subject PNCO had incurred
continuous absences for the period of thirty (30) days which was accumulated from
October 23 to November 21, 2017.
in connection with his absences, Morong Municipal Police Station issued

Memorandum of Explanation dated October 30, November 2 and November 4, 2017
respectively directing subject PNCO to explain in writing within twenty (24) hours upon
receipt why no disciplinary action should be taken against him for being absent. His
failure to comply and or unsatisfactory explanation shall mean a waiver on his part to be
heard, hence an administrative proceedings shall commence against him.
Likewise Morong MPS also sent a Memorandum of Notice to Report dated
October 30, November 2 and November 4, 2017 also directing subject PNCO to report
for duty upon receipt of the memorandum. His failure to comply shall mean a waiver on
his part to be heard, hence an administrative proceedings shall commence against him.
Although all Memoranda were received by the subject PNCO's relative Nicetas D. Cruz
still P01 John Rossmond Cruz failed to report.
After thorough examination on all attached documents the herein SHO confirmed
the non-existence of necessary application for Official Leave of subject PNCO and or
secured the approval of his authorized officer during those period of his absences as
well with the non-attendance of his written explanation.
To satisfy the procedural conduct of SHP, a Summons to Answer the complaint

dated May 29, 2018, together with the copy of complete case folder was issued to P02
Cruz, notifying him regarding the said complaint which has been filed with this Office for
formal hearing in consonance with Uniform Rules of Procedure before the
Administrative Authorities and Internal Affairs Service of the Philippine National Police
and further, directing him to submit his Answer, containing a list of his witnesses, if
obtaining, accompanied by documentary or other evidence he may have in support of
his defense, within seven (7) working days which he received on May 31, 2018.
P02 Cruz was able to submit his answer stating that the case filed against him is
baseless and no legal basis, in which he claimed that the truth on the said incident is
that during those prescribed period of his absences he suffered from difficulty in
breathing cause by Asthmatic Bronchitis which brought by excessive stress and thinking
on October 23, 2017 which led him to bring himself to a doctor for consultation.
He undergone medical diagnosis to Dr. Josme M Macabuhay M.D. of Mc. Life

Medical Clinic located at # 30 Sumulong St., Antipolo City who advised him for a home
rest for 39 days (October 23 to December 1, 2017) and to return on December 1, 2017.
Above claimed of P02 Cruz was supported with his Medical Certificates from
Josme M Macabuhay, M.D. Family Medicine dated October 23, 2017 and December 1,
2017, certifying that John Rossmond P Cruz was seen and treated because of
Asthmatic Bronchitis. He was further advised home rest for 39 days and will be fit to
resumed work on December 1, 2017.
In his Medical Certificate dated December 1, 2017, the same findings was seen
and treated in which he was also advised for 27 days rest and he will be fit to work on
December28, 2017.
It was also noticed in his answer that his mother was rush to hospital on
November 11, 2017, in which he took care of his mother. He submitted the Clinical
Abstract of his mother dated January 16, 2018 with findings of Acute Respiratory
Failure, Acute congestive heart failure and the date of admission was on November 13,
2017.
ISSUE
Whether or not respondent is guilty of Grave Neglect of Duty (AWOL).

DISCUSSIONS:
Based on the foregoing circumstances, P02 John Rossmond Cruz absented

himself for a continuous period of thirty (30) days which was accumulated from October
23t0 November21, 2017.
Respondent was able to defend himself, stating that during the prescribed period
of his absences he suffered from Asthmatic Bronchitis wherein his Medical Certificate
issued by Dr. Josme M Macabuhay M.D. of Mc. Life Medical Clinic in which he was
advice for 39 days (October 23 to December 1, 2017) home rest, thus serves as integral
part.
However, the defense of the respondent does not totally extinguish him from
being administratively because of his failure to file appropriate official leave (Sick Leave)
before, during and even after his absences and or secured the approval of his superior
officer or authorized official which is the main issue and or the charge filed against him
in this particular case.
Therefore, his defense can only be considered as mitigating circumstances under

Rule 22 Penalties, Sec. 4 Mitigating and Aggravating Circumstances, Letter e) Illness.
Hence, considering the presence of mitigating circumstances and no aggravating

can be noticed in this particular case under Rule 22 Penalties, Sec. 5 Guidelines in the
Application of Penalties, Letter b. The minimum period of penalty shall be imposed
were only mitigating and no aggravating circumstances are present.
Under Rule 22, Sec. 2, the penalties for Grave Offenses are:
a) Sixty (60) days to six (6) month suspension (minimum)

b) One (1) rank demotion (medium)
c) Dismissal from the service (Maximum)
Therefore, P02 John Rosmond Cruz is administratively liable for Grave Neglect
of Duty (AWOL) under NAPOLCOM Memorandum Circular (NMC) No. 2016-002,
Rule 21, Sec. 2, C "Grave Offenses", I "GRAVE NEGLECT OF DUTY" (j), reads as;
"absent oneself from office without having filed the necessary application leave or
secured approval of the authorized official for a period of more than fifteen (15)
days prior to the enjoyment of the leave"
FINDINGS/CONCLUSION:
Based on the forgoing circumstances, the herein SHO finds respondent GUILTY
for Grave Neglect of Duty with one (1) mitigating circumstances and considering that
there is no aggravating pleaded in this case the Minimum period for his Offense shall
be imposed pursuant to NAPOLCOM Memorandum Circular 2016-002.
VII. RECOMMENDATION:
WHEREFORE, hence that P02 John Rossmond Cruz is GUILTY of Grave

Neglect of Duty (AWOL), the undersigned hereby recommend that a penalty of "Six
Months Suspension from the Police Service shall be impose upon him.

advised by my attending physician JOSME M MACABUHAY to take a rest for thirty
seven (37) days DUE TO asthmatic bronchitis (Respondent presented his Medical
Certificate).

7- A few days later, On November 11, 2017, out of expectation that her
mother rush into the hospital and went to the brink of death (50-50) in too much
trouble as a mother, because of unhealthy news and watching on trouble happening
to a police that she was concerned about, his mother attacked and admitted to the
ICU; (Hereto attached issued Clinical Abstract and picture to this effect);
8- As a parent respondent also feel the feeling of a worried parent in his

or her child and in those moments only one things enter on his minds is to survive and
taking care of his mother, even she has always been opposed to my chosen job, but
because of this is my dreams and ambition in lfe from childhood, that's why
respondent not going to able to neglect and think or do something bad that it would
break it as a law enforcer.
9- December 1, 2017 back again and decided to submit himself to a
physician as he could not bear his worst body condition and given advise for full rest
for recuperation and physician advice to come back on December 28,2017 to check up
again for full recovery;
11- Respondent being a Police Officer maybe he knows what is right and
wrong in view of the foregoing circumstances, as it gleamed herewith his eagerness to
render Police service merely have an impediment as he acquired health problem on the
said given dates and attending his duty as a son to her mother;
12- Attached issued Medical certficate and Clinical Abstract with photo
could not contest by anyone as it legal and accepted even in court proceeding;
13- And lastly a Humanitarian consideration is above all;

STATEMENT OF ISSUE
1. Whether respondent committed Grave Neglect of Duties;
For more or less Ten (10) years long years in Police service, herein respondent
has always been truthful to his sworn duties as Police Officer, because the oath he
has taken always lead to his giving all that good, not only for himself but for the good
name of the PNP. The performance of his duties has always been by the books, by
what has been lawfully practiced by command, with the end in view of the betterment
of his fellow Police Officers and all that should be deserving of the services they may
extend. Such long years in the service remained jmiqgiisiied by any wrongdoing, and
nota gle disregard of aut ho rity or of our laws dot in his career as Police Officer.
Respondent has never indulged himself in anyJrjegularity in the performance,of

hiutiea,.s he has been complaint with all that has been imposed upon him either y
the books or his superior. Though at times, with regards to concern of the office of
station to which he may be attached.
For whatever it may be of worth, and just to make clear of the records,
respondent himself suffered illness and taking care of his mother in times of needed
during those days he was not perform his Police service as duty Sentinel;
With the foregoing circumstances, herein respondent humbly submit that he

cannot be said to have committed Grave Neglect of Duties;

inaasahang pangyayari na maisugod ang aking ma sa hospital at malagay
sa bingit ng kamatayan(50-50) sa sobrang pag-aalala bilang isang ma,
dahil sa mga di-magaganda na balita at napapanood na patayan sa
telebisyon tungkol sa pulis na labis niyang ikinabahala, na kung kaya siya
ay inatake at na lagak sa ICU na tanging ako at aking lOyo na anak at 9yo
na pamangkin ang kasama sa bahay sa kadahilanang ang aking ama,
asawa, at dalawang kapatid ay nagtatrabaho bilang ofw, bilang isang
magulang din ay ramdam ko ang pakiramdam ng nag-aalalang magulang
sa kanyang anak at sa mga oras na iyun ay wala ng ibang pumasok sa
isip ko kung hindi ang makaligtas at maalagaan ang aking ma na kahit
nuon paman ay tutol sa aking napiling trabaho, ngunit dahil narin sa ito
ang aking nais at ambisyon sa buhay mula pagkabata, na kung kaya
hindi ko to magagawang pabayaan at mag isip o gumawa ng bagay hindi
maganda na ikakasira nito bilang isang alagad ng batas;

2. This pertains to the initial evaluation report from PIDMB, Rizal PPO dated
November 23, 2017, re: Administrative Case against P02 JOHN ROSSMOND
DOMINGO CRUZ BN 188691 PNP member, assigned with Morong MPS, Rizal PPO
for Grave Neglect of Duty (AWOL) for continuous unauthorized absences without
official leave docketed under APC-R-171206-403.
3. As culled from the record, P02 John Rossmond Domingo Cruz,

assigned at Morong MPS, Rizal PPO who was placed on Absence Without Official
Leave (AWOL) status dated October 23, 2017 under SO Nr. 2911 dated November 15,
2017, subject PNCO failed to report for duty and was marked absent in Morong MPS
DPPAR from October 23, 2017 to November 21, 2017 incurring a total of thirty (30)
days of continuous absences without filing the necessary application for official leave
nor securing the approval of the authorized official.
4. Severity of document presented, memoranda of Explanation dated

October 30, 2017, November 2, 2017 and November 4, 2017 were issued by PCINSP
PERLITO RUBANO TUAYON, Chief of Police to P02 John Rossmond Domingo
Cruz, delivered by Mobile Patrol duty PNCO of Morong MPS to his last known
address at Brgy Looc, Cardona, Rizal as reflected in his Personal Data Sheet were
received by subject PNCO relatives Nicetas D. Cruz, directing him to explain in writing
within 24 hours upon receipt why no disciplinary action should be taken against him
for being absent. His failure to comply shall be a waiver on his part to be heard, hence
an administrative proceedings shall commence against him. However, the latter failed
to do so.

5. Likewise, submitted memoranda of Notices to report for duty dated

October 30, 2017, November 2, 2017 and November 4, 2017 were issued by PCINSP
PERLITO RUBANO TUAYON, Chief of Police to P02 John Rossmond Domingo
Cruz, personal delivered by Mobile Patrol duty PNCO of Morong MPS to his last
known address at Brgy Looc, Cardona, Rizal as reflected in his Personnel Data
Sheet, were received by subject PNCO relatives Nicetas D. Cruz directing him to
report for duty upon receipt of the memorandum to answer his explanation to validate
his reason. Failure to comply shall mean a waiver on his part to be heard, hence an
administrative proceedings shall commence against him. However, the latter failed to
do so despite due notices
6. In addition, on December 11, 2017, radiographic messages were sent

to Rizal PPO, duly received by NUP Manaig directing P02 John Rossmond Domingo
Cruz to report without fail at the Pre-Charge Investigation Section, RIDMD at exactly
10:00 o'clock in the morning of December 12, 2017, to bring along a copy of his
subscribed and notarized affidavit and other allied documents to support his reason
relative to his administrative case for Grave Neglect of Duty (AWOL) but failed to
appear thus exparte investigation.
7. Furthermore, on December 14, 2017, upon request of this Office Mr.

Rodelio A. Siapian, Acting Chief, Certification and Clearance Section, Bureau of
Immigration issued certification that the name P02 John Rossmond Domingo Cruz
does not appear in the list of their Computer Data File among those who left the
country covering the period from January 1, 1993 to December 12, 2017.
8. Based on the foregoing circumstances, this Office finds the

existence of probable cause to indict P02 John Rossmond Domingo Cruz for
Grave Neglect of Duty who incurred Thirty (30) days of continuous absences from
October 23, 2017 to November 21, 2017 without filing appropriate official leave nor
securing the approval of the authorized official under NAPOLCOM Memorandum
Circular No. 2016-002, Rule 21, Sec., Paragraph C Grave Offenses, I "Grave
Neglect of Duty", j)- "absent oneself from office without having filed the necessanj

application for leave or secured the approval of the authorized official for a period of C,
more than fifteen (15) days prior to the enjoyment of the leave".
9. WHEREFORE, this Office recommends that P02 John Rossmond

Domingo Cruz of Morong MPS, Rizal PPO be subjected to Summary Dismissal
Proceedings (SOP) for "Grave Neglect of Duty" (AWOL), to determine the extent of Ei
his administrative liabilities and for him to adduce other controverting evidence in his
behalf.
10. This instant administrative case will be prosecuted by SPOI Ventura L

Catabay of PIDMB, Rizal PPO, effective upon approval.

1. References:

attached allied documents;
2. Facts of the case:
This pertains to the Endorsement from the Chief, PHRDDB dated November
22, 2017, requesting the conduct of Initial Evaluation on the alleged absences without
official leave of P02 John Rossmond Domingo Cruz.
In the Daily PNP Personnel Accounting Report (DPPAR) of Morong Municipal

Police Station, Morong, Rizal it was recorded that subject PNCO had incurred continuous
absences for the period of thirty (30) days which was accumulated from October 23 to
November 21, 2017.
In connection with his absences, Morong Municipal Police Station issued

Memorandum of Explanation dated October 30, November 2 and November 4, 2017
respectively directing subject PNCO to explain in writing within twenty (24) hours upon
receipt why no disciplinary action should be taken against him for being absent. His failure
to comply and or unsatisfactory explanation shall mean a waiver on his part to be heard,
hence an administrative proceedings shall commence against him. Likewise Morong MPS
also sent a Memorandum of Notice to Report dated October 30, November 2 and November
4, 2017 also directing subject PNCO to report for duty upon receipt of the memorandum. His
failure to comply shall mean a waiver on his part to be heard, hence an administrative
proceedings shall commence against him. Although all Memoranda were received by the
subject PNCO's relative Nicetas D. Cruz still P01 John Rossmond Cruz failed to report.
After thorough examination on all attached documents the herein evaluator

confirmed the non-existence of necessary application for Official Leave of subject PNCO
and or secured the approval of his authorized officer during those period of his absences as
well with the non-attendance of his written explanation.
3. Findings:
Based on the foregoing, P02 John Rossmond Domingo Cruz had incurred thirty
(30) days continuous absences which was accumulated from October 23 to November 21,
2017 which is tantamount to "Grave Neglect of Duty" under NAPOLCOM Memorandum
Circular No. 2016-002, Rule 21, Sec. 2, Paragraph C1j)- absent oneself from office without
having filed the necessary application leave or secured the approval of the authorized official for a period of
more than fifteen (15) days prior to the enjoyment of the leave.
4. Recommendation:
WHEREFORE, the undersigned recommends that this case be referred to the

Regional Investigation and Detective Management Division, PRO CALABARZON for Pre-
Charge Investigation as to the nature of his offense "Grave Neglect of Duty" is beyond the
jurisdiction of this Office.

of the Philippine National Police assigned to this station under the disciplinary
authority of the Officer-In-Charge, did, then and there, willfully absent himself from
his duty as member of Morong Police Station, Morong, Rizal without having filed the
necessary application for Leave or secure the approval of authorized official prior to
the enjoyment of his absences.

I. AUTHORITY:
1. NAPOLCOM Memorandum Circular No. 2016-002;

2. Daily PNP Personnel Accounting Report of Morong MPS,
Morong, Rizal;
3. Verbal Instruction of Officer in Charge, Morong PS to Conduct
Pre-C harge Investigation against subject PNCO;
II. MATTERS TO BE INVESTIGATED:
4. To establish facts and circumstances surrounding the alleged

unauthorized absences committed by P02 John Rossmond Domingo Cruz from
October 23-November21, 2017 to date.
5. To determine the extent of his administrative liability, if any.
Ill. FACTS OF THE CASE:
6. That on October 23, 2017 up to present, it appears that P02

John Rossmond Domingo Cruz failed to report to his duty without having filed
necessary application for leave or secured approval of the superior officer thus, he
was marked absent. Such faults apparently committed by subject PNCO affects the
utilization of personnel and performance efficiency within the station.

7. His unauthorized absences were recorded and reflected in their

Daily PNP Personnel Accounting Report (DPPAR) of Morong MPS from October 23-
November 21, 2017.
8. That on October 30, 2017, November 2 & 4, 2017 an

explanation letter were given and directing him to explain in writing for being absent
and without informing the Officer-In-Charge and Admin Personnel of his
whereabouts from October 23-November 21, 2017. Also on October 30, 2017,
November 2 & 4, 2017, a Notice to Report for Duty were sent to him which
personally received by his relatives Nicetas 0. Cruz.
9. The Officer-On-case examined the attached documents and

found out that non among those were able to explain the subject PNCO's
unauthorized absences.
IV. DISCUSSION:
10. The Admin Section of Morong MPS certified that respondent

failed to report his duty on October 23-November 21, 2017, is a clear violation of
NAPOLCOM MC NR. 2016-002, under Rule 21, Section 2, Para (B-i), Sub-Para (0)
"Less Grave Neglect of Duty" which reads;
o) "Absent oneself from office without having filed the necessaty

application for leave or secured the approval of the authorized official for
a period of more than three (3) days but not exceeding fifteen (15)
days".
ii. The respondent was required to file explanation to controvert the

charges against him. Accordingly, P02 John Rossmond Domingo Cruz was advised
to report to the police station thru Memorandum dated October 30, 2017, November
2 & 4, 2017 with subject Notice to Return for Duty and were personally received
by his relatives Nicetas Cruz but instead P02 John Rossmond Domingo Cruz
ignored the same and continue his unauthorized absences, hence disregard to
inform the Admin Officer nor his immediate superior of her whereabouts.
12. That, despite of memorandum being deliver to him, he failed to

report and answer the explanation dated October 30, 2017, November 2 &4, 2017
Likewise, he could at least informed his immediate superior of his supposed
condition which could easily reached the person concerned by the wonders of
communication such as i.e SMS but no to avail, disregarding the anxieties of her
superiors who are duty bound to look for his welfare.
V. CONCLUSION
13. After careful evaluation of the case, the undersigned Officer on

case arrived into fair and just conclusion that prima facie exist to P02 John
Rossmond D Cruz for violating under Rule 21, Section 2, Para (B-i), Sub-Para
(o) "Less Grave Neglect of Duty" of NAPOLCOM Memorandum Circular No. 2016-
002.
VI. RECOMMENDATION:
14. WHEREFORE, the undersigned recommends that a Case of

"Less Grave Neglect of Duty" against P02 John Rossmond Domingo Cruz of
Morong MPS, be subjected to Summary Hearing Proceeding (SHP) and to
determine the degree of his administrative liability and further give her full
opportunity to offer supporting documents, if any for his defense.
