DEED OF SALE

(Of Undivided Share)

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Sale made and executed by and between:

LEWELYN T. TOMADO, of legal age, married, Filipino citizen and a resident of Brgy.
2 Poblacion, Hinoba-an, Negros Occidental, hereinafter referred to as the SELLER;

- and -

SALOME T. ESTARES, of legal age, married, Filipino citizens and resident of Brgy. 2
Poblacion, Hinoba-an, Negros Occidental, hereinafter referred to as the BUYER;

WITNESSETH:

1. That the SELLER is one of the three (3) lawful heirs of the late Consejo Tembrevilla, of
legal age, Filipino, married to Agustin Tomado, both deceased, and a co-owner of a parcel of
land covered and embraced by Transfer Certificate of Title No. T-71393 consisting an area of
4,607 sq. meters described as follows, to wit:

“A parcel of land situated at Brgy. Poblacion, Binmaley, Pangasinan.


Bounded on the North by Baybay Polong; On the East by Silverio Evangelista;
On the South by National Road; and on the West by Barrio Road, containing an
area of 480 square meters, more or less, and declared under Tax Declaration No.
28285 in the name of Eugenia Reloza”

2. That for and in consideration of the sum of FIFTY THOUSAND PESOS (P50,000.00)
Philippine Currency, paid in cash by the BUYER receipt in full thereof is acknowledged by and
to the full satisfaction of the SELLER, the latter does by these presents hereby SELL, CEDE,
TRANSFER and CONVEY absolutely and unconditionally unto the BUYER, her heirs and
assigns my undivided share of ONE THOUSAND FIVE HUNDRED THIRTY FIVE square
meters (1,535 sq. m.) only free from all kinds of liens and encumbrances whatsoever;

3. That all the requirements provided for under Act 1623 of the Civil Code regarding
notices to the owners of the adjoining lots had been complied with and none expressed interest to
buy the same;

4. That by virtue hereof, the SELLER does by these presents hereby WAIVE and
RELINQUISH any and all rights that he has over the parcel of land herein sold in favor of the
BUYER and shall defend her rights against all kinds of claims of whomsoever.

IN WITNESS WHEREOF, the parties herein have hereunto set their hands this ___ day
