AFFIDAVIT OF WITNESS

I, SHAINA JEAN A. MOJABE, 21 years old, single, and with postal address at Barangay
Santa Fe, Caraga, Davao Oriental after having been duly sworn to in accordance with law do
hereby depose and state THAT;

That, I was present and personally saw that accused, MARTIN S. ADIOS, committed the
crime of rape against the victim HANNAH P. MONTANA;

That, on 2nd day of July, 2023 I went to the victim’s house to make amends to her
because we have little fight that day. But when I go in to their house there is no person who
opened the door but I hear some groans and small shouts that is why I shout and asking to the
person in the house if they are okay but there is no response. So that, I opened the door of
Hannah’s house and I immediately go to the room that the groans came from and then in that
very moment I saw Hannah’s body lying on the bed weakly and I saw some blood in the
bedsheets. And I saw that the window of Hannah’s bedroom is open that is why I look at it and
I saw Mr. Martin S. Adios running away holding his pants. After that, I called for help and after
an hour the police came and they perform first aid to the victim and the bring her to the
hospital to get her medical on what happened and to cure the victim.

That, I executing this affidavit to attest the truthfulness of the foregoing facts and to
support the filing of Criminal Justice against Martin S. Adios for violations of rape.
