“AN ORDER CREATING THE WATER QUALITY MONITORING UNIT OF THE MUNICIPALITY OF

MALAPATAN, PRESCRIBING THE DUTIES AND RESPONSIBILITIES AND PROVIDING FUNDS THEREFORE”

WHEREAS, Republic Act 9275 or the Philippine Clean Water Act of 2004 provides that LGUs shall share
the responsibility for the management and improvement of water quality within their territorial
jurisdictions;

WHEREAS, among the responsibilities of LGUs are the monitoring of water quality and taking active
participation in all efforts concerning water quality protection and rehabilitation;

WHEREAS, Section 20 of RA 9275 also requires LGUs, six months from the establishment of a Water
Quality Management Area (WQMA), to prepare a compliance scheme, subject to the review and
approval of the governing board. Further, the same section also requires LGU to comply with the
framework of the WQMA Action Plan;

WHEREAS, DENR Administrative Order No. 2009-12 designated the Sarangani Bay Water Quality
Management Area and Creation of its Governing Board which includes the municipality of Malapatan
and its coastal Barangays of Libi, Lun Masla, Lun Padidu, Poblacion, SApu Masla, Sapu Padidu, and Tuyan;

WHEREAS, Section 3 of DENR AO No. 2009-12 designated LGU Malapatan as of one of the governing
bnoard members;

WHEREAS, there is a need to creation a Water Quality Monitoring Unit in order to ensure the compliance
of the municipality in the provisions of RA 9275 specifically in the preparation and monitoring of a
regular Water Quality Status Report;

NOW THEREFORE, I

Section 1. ORGANIZATION OF WATER QUALITY MONITORING UNIT OF THE MUNICIPALITY OF

MALAPATAN- The Municipal Water Quality Monitoring Unit of the Municipality of Malapatan is hereby
created to oversee the monitoring and facilitate the compliance of LGU to the WQMA Action Plan.

Section 2. COMPOSITION OF THE WATER QUALITY MONITORING UNIT- The Municipal Water Quality
Monitoring Unit shall be composed of but not limited to the following:

Section 3. DUTIES AND FUNCTIONS. The Municipal Water Quality Monitoring Unit shall perform the
following duties and functions:

1. Perform regular water quality monitoring in coordination with DENR EMB and other appropriate
government agencies.
2. Formulate the Municipal WQMA Action Plan.
3. Review and update as the needs arises the Municipal Action Plan.
4. Formulate strategies to harmonize policies/regulations/local legislation necessary for the
effective implementation of R.A. No. 9275 in accordance with those established in the Integrated
Water Quality Management Framework;
5. Monitor and facilitate the LGU compliance to the WQMA Action Plan;
6. Coordinate relevant activities among its members;
7. Conduct regular meeting as often as necessary.

Section 4. CAPABILITY TRAINING- As provided in the DENR AO No. 2009-12, the DENR- EMB shall provie
capability traingings to the members of Water Quality Monitoring Unit in order to ensure the strengthen
the technical capability on water quality monitoring at the local level.

Section 5. SECRETARIAT. The Secretariat shall be composed of the staff of the Municipal Environment
and Natural Resources Office. They shall perform the following duties and functions:

1. Preparation and furnishing of notice of meetings

2. Recording and transcribing minutes of the meetings
3. Consolidation of submitted data/information; and
4. Perform other functions as may be deemed necessary

Section 6. LOCAL WQMA COMPLIANCE ACTION PLAN- The unit shall develop and implement a Local
WQMA Action Plan in coordination with DENR- EMB.

Section 7. BUDGETARY ALLOCATION FOR THE IMPLEMENTATION OF THE PLAN. The Sangguniang Bayan
shall ensure to allocate regular and annual budget for the effective and efficient implementation of the
WQMA Action Plan.
Section 8. EFFECTIVITY. This Executive Order shall take effect immediately.
