a) Activity schedule is prepared and priced by the Contractor during his tender stage.

It is not part of the Works


Information and must not be used to describe the works. The Contractor, at the tender stage, decided to break up
his work into activities and price accordingly. No matter how, it is the Contractor’s responsibility to Provides the
Works in accordance with the Work Information [CC 20.1] but not the Activity Schedule. Since, the fencing is clearly
identified in the Works Information, it is the Contractor’s obligation to construct the fencing. In Option A,
contractor is to be paid according the completion of item in Activity Schedule. As there is no such item for security
fencing in the Activity Schedule, the Contractor will not be paid for particularly for the fencing according o the
original Activity Schedule. The Contractor is allowed to revise the Activity Schedule [CC 54.2] to show the works
related to the 30m fencing. However, if the total of the Prices is changed, the revision of the Activity Schedule will
not be accepted [CC 54.3].

b) Under [CC 14.1], the Project Manager’s acceptance of a communication from the Contractor including but not
limited program does not release the liability and change the responsible of the Contractor to Provide the Works or
his liability for his design. This mechanism reasonably avoids the Contractor to change the Works Information such
as delete any works or reduces one of the employer’s periods either intentionally or unintentionally. The
subsequent acceptance of the programme does not by default overwrite the original works information. The
Project Manager is the only person who can change the works information on a project. 

The program is very important as a guidance throughout the whole project. The Project Manager may decide to
instruct the Contractor to revise and resubmit a program for his acceptance even though there are previously
accepted program [CC 32.2]. The Contractor shall submit a revised program to the Project Manager for acceptance
accordingly. Or the missing information can be re-input into the program in the next submission at no longer
interval than the interval stated in the Contract Data [CC 32.2].

An early warning [CC 16.1] may be raised as the situation may increase the Contractor’s total cost. The early
warning will be entered into the Risk Register by the Project Manager.

c) The Contractor shall submit the particulars of his design to the Project Manager for acceptance. The Contractor is
not allowed to proceed with the relevant work until the Project Manager has accepted his design. [CC 21.2].
Therefore, the Contractor shall first submit his design to the Project Manager for acceptance no matter what
method he chose to adopt.

For sub-contracting, the Contractor has to submit the name of the Sub-Contractor to the Project Manager for
acceptance. The tendering Sub-Contractor that advising a better solution has to be accepted by the Project
Manager before the Contractor appointed him for the piling work. [CC 26.2].

The Contractor also needs to submit a revised program to the Project Manager for acceptance to reflect the change
in method and show, for each operation, a statement of how he plans to do the work identifying the principal
Equipment and other resources which he plans to use. [CC 31.2]

On the basis that the Works Information only specify the performance of the piling works instead of the types,
numbers, arrangements and such, the Contractor will have his feasibility to change the method. Finally, under
[A54.2], the Contractor is allowed to submit a revision of the Activity Schedule to the project Manager for
acceptance as long as the total of the Prices isn’t changed as the alternative piling method suggested by one
tendering Sub Contractor could be provided at half the quoted price. Also, the Project Manager will not reject the
revision of the Activity Schedule as the revised Programme is submitted and accepted as per [CC 31.2]

d) The Contractor shall provide information which shows how each activity on the Activity Schedule relates to the
operations on each programme submitted for acceptance [A31.4].

If the contractor changes a planned method of working at his discretion so that the activities on the Activity
Schedule no longer relate to the operations on the Accepted Programme, he shall submit a revision of the Activity
Schedule to the Project Manager for acceptance [A54.2]. However, the submitted revision of Activity Schedule
should not change the total of the Prices. Changed prices in activities shall be reasonable distributed between the
activities. And finally, it shall comply with the Accepted Program. [A54.3]

In case of Compensation Event, assessments for changed Prices will be in the form of changes to the Activity
Schedule. In this case, the Contractor can submit a revision of the Activity Schedule to the Project Manager for
acceptance. [A63.12]
