DEED OF ADJUDICATION AMONG HEIRS WITH SIMULTANEOUS WAIVER AND SALE

KNOW ALL MEN BY THESE PRESENTS:

This Agreement, made and entered into by and between:

TOMAS S. TICANGAN., of legal age, married and a resident of Saudi Bulo, Tabuk City, Kalinga;
PEDRO S. TICANGAN, of legal age, married and a resident of Purok 4, Bulanao, Tabuk City,
Kalinga;
ALBAN S. TICANGAN, JR., of legal age, single and a resident of Saudi Bulo, Tabuk City, Kalinga;
WILSON S. TICANGAN, of legal age, married and a resident of Saudi Bulo, Tabuk City, Kalinga;
WILLIAM S. TICANGAN, of legal age, single and a resident of Madongo, Sagada, Mt. Province;
ESTEAFANIA T. DANNANG, of legal age, married and resident of Purok 1, Bulanao, Tabuk City,
Kalinga;
- and-

ELENA S. TICANGAN, of legal age, widow and a resident of Madongo, Sagada, Mt. Province.

WITNESSETH: That

WHEREAS, ALBAN TICANGAN, died intestate, leaving a certain real property situated at
Kinnetyeng, Langsayan, Madongo, Sagada, Mt. Province with the following description, to wit:

North: by Martin Tomeg; South by Tauli Pacsay and Budkaeng

East: by Martin Tomeg; West by Road

covered under Declaration No. 147 of the Municipal Assessor’s Office of Sagada, Mt. Province.

WHEREAS, the parties hereto are the sole and only heirs of the decedent, they being the and
children and spouse, respectively of the decedent;

WHEREAS, there are no known debts or obligations due against the estate of said decedent; and

WHEREAS, is it to be the best interests of the parties hereto to divide and partition and adjudicate
among themselves the entire estate extrajudicially, in the form and manner hereinafter set forth;

NOW, THEREFORE, for and in consideration of the premises, and invoking the provisions of Rule
74, Section 1, of the Rules of Court, the parties hereto do by these presents agree to divide and partition
the entire estate above-described, adjudicating, as they do hereby adjudicate, the same to and among
themselves in PRO INDIVISO equal shares, subject however, to the liabilities imposed by Rule 74, Section
4, of the Rules of Court, in favor of any other possible heirs, creditors, and other persons who might be
deprived of their lawful participation in the estate of the decedent, for a period of two years;

In the event that any other property of the decedent should later be found which is not included
hereinabove, the parties hereto further agree to distribute, divide, and adjudicate, as they do hereby
distribute, divide and adjudicate, the same in like manner and proportion as herein established and
disposed;
- AND BY WAY OF WAIVER -

We, PEDRO S. TICANGAN, ALBAN S. TICANGAN, JR., WILSON S. TICANGAN, WILLIAM S.

TICANGAN, ELENA S. TICANGAN, and ESTEFANIA T. DANNANG, for and in consideration of our LOVE
and AFFECTION, do by these presents, hereby WAIVE our respective hereditary share in the estate of the
afore-mentioned decedent, unto our Co-Heir, TOMAS S. TICANGAN;

- ACCEPTANCE -

That I, TOMAS S. TICANGAN, hereby accepts this gift and donation made by my co-heirs and
further express my sincerest appreciation to the kindness and generosity of my co-heirs;

- AND BY WAY OF SALE-

That I, TOMAS S. TICANGAN, for and in consideration of the sum of ONE HUNDRED FIFTY
THOUSAND PESOS (P150,000.00), do by these presents, hereby SELL the aforementioned property unto
my sister, ESTEFANIA T. DANNANG;

This instrument consisting of two (2) pages including the page whereon this acknowledgement and
written, has been signed by the parties and their witnesses on every page hereof and pertains to a Deed of
Adjudication of Estate Among Heirs with Simultaneous Waiver and Sale.
