DEED OF UNDERTAKING

This Deed of Undertaking with Special Power of Attorney, made and entered into by among:

WITNESSETH THAT:

1. The above-named parties are legitimate children and lawful heirs of JOSE B. NIERVA, who
died on October 19, 2002 in Jalajala, Rizal, and CANDIDA B. NIERVA, who died on August
17,1974 in Jalajala Rizal, who died on September 09, 2016 at Jalajala, Rizal.
2. The said deceased, at the time of his death, was an Agrarian Reform Beneficiary and awardee
of an agricultural land pursuant to PD27/EO228/RA 9700, designed as Lot No. 138 with an
area of 7,265 (meters/hectares), situated in Poblacion 1st District, Jalajala, Rizal, as evidenced
by EP/CLOA TCT No. M-1607 issued by the Registry of Deeds for the Province/City of
Morong, Rizal.

3.Land Bank of the Philippines (Land Bank), as financial intermediary of the agrarian reform
program of the government, has a lien by way of mortgage on the said agricultural land, and the
cancellation/release of which is conditioned upon full payment of the land amortizations by
EMMALYN R. BUNOT and/or his legal heirs in favor of LBP.

4. The said Real Estate Mortgage was annotated on the said EP/CLOA TCT No. M-1607.

5. For the cancellation of the said mortgage annotated on the said EP/CLOA TCT NO. M-
1607, a Certificate of Full Payment and Release of Real Estate Mortgage (CFP/ROREM) shall
be issued by the LBP to EMMALYN R. BUNOT upon full payment of the amortizations on the
said agricultural land.

6. The awarded agricultural land covered by EP/CLOA TCT No. M-1607 was fully paid on

7. In the light of the foregoing circumstances, we hereby name constitute, and appoint
EMMALYN R. BUNOT, of legal age, Filipino, resident of 271 Victor Pilapil St., Brgy. Rizal
Baras, Rizal to be my true and lawful attorney-in-fact, to act in my behalf and in my names,
place and stead, to do the following acts things:

a. To represent me before the LBP, Registry of Deeds and other concerned government
agencies in connection with the release and discharge of the Real Estate Mortgage, issuance
of CFP/ROREM, and cancellation of the annotation of encumbrance or lien on EP/CLOA
TCT No. M-1607.

b. To submit to and receive from Land Bank, Registry of Deeds and other concerned
government agencies, any document relating to the issuance of CFP/ROREM and other acts
mentioned in item a.

c. To sign any and all documents concerning the issuance of the CFP/ROREM.

d. To receive the CFP/ROREM issued by Land Bank.

e. To receive the original Owner’s Duplicate Copy (ODC) of EP/CLOA Title No. M-1607.

HEREBY GIVING AND GRANTING unto the said attorney-in-fact full power and authority
to do and perform any and all of the acts above enumerated whatsoever necessary or proper to be
done in or about the premises as fully to all intents and purposes as we might or could lawfully
do if personally present or all that said attorney-in-fact shall lawfully do or cause to be done by
virtue of these presents.
8. WE hereby UNDERTAKE to be solely responsible for whatever dispute/disagreement that
may arise within the family or caused by other interested party/ies as regards the above-
mentioned agricultural land in relation to the issuance of CFP/ROREM.

9. WE declare that Land Bank and/or its officials and employees shall not be held liable for any
loss, damage, or injury, whether direct or indirect, actual or consequential or otherwise, arising
or resulting from this Deed of Undertaking with Special Power of Attorney, and we undertake to
hold the Land Bank and/or its officials and employees free and harmless from any and all
liabilities and shall fully reimburse Land Bank and/or its officials and employees against any and
all claims and suits for loss, damages or injury by any third person/s arising/resulting from this
Deed of Undertaking with Special Power of Attorney and release of CFP/ROREM.
