Completion Certificate for Land Plot No. 3-01-04 Project : Colombo Port City Development Project Issued to : CHEC Port City Colombo (Private) Limited Certificate No: (028/MMWD/CPCC/UDA/LP 3-01-04 The Scope of the Certifica This Certificate covers the completion of the Land Plot number 3-01-04 as illustrated in the attached drawing number 14S004 TO-P58 001 of the Reclamation Works of Colombo Port City Development Project and all the Completion Tests as described in Part B of Schedule 17 in the Tripartite Agreement dated 12" August 2016 signed between the Government of Sri Lanka (“GOSL”), Urban Development Authority (“UDA”) and CHEC Port City Colombo (Private) Limited (“Project Company”) This Completion Certificate is issued to the Project Company in response to their request letter reference CPCC/MOM& WD/EPC/012659 dated 06" March 2019. Undertaking by the Project Company Under the terms and conditions of the Tripartite Agreement dated 12"" August 2016, we hereby certify that in the opinion of the Project Company the Reclamation Works of the Land Plot number 3-01-04 as illustrated in the attached drawing number 14S004 TO-P58 001 of the Colombo Port City Development Project has been completed. Further, we certify that all Completion Tests as described in Part B of Schedule 17 of the Tripartite Agreement have been completed in connecticn with the said Land Plot. We also undertake to comply with Clauses 19 and 20 of the Tripartite Agreement which deals with the rectification of defects, if any, during the defects liability period, in connection with the said completed Land Plot, In addition to that, in case of damage caused to this Land Plot number 3-01-04 which may occur while carrying out the Associated Works (refer Part C of Schedule 17) adjacent to this Land Plot after issuance of this Certificate, we hereby agree to recover and rectify such damages caused to thig Laitd Plot number 3-01-04 as required by the Tripartite Agreement. Managing CHEC Port City Colombo (Private) LimitedCertificate of the Government of Sri Lanka Ministry of Megapolis and Western Development (*MMWD"”) hereby certify that the Land Plot number 3-01-04 has been successfully completed based on the Employers’ Quality Representative's (EQR) Report reference BE8280/EQR-LTR-184/SPE/Col dated 25" February 2019. This Completion Certificate is issued subject to clauses 18.4, 19 and any other relevant provisions in the Tripartite Agreement. The defects liability period will be one year from the effective date of this Completion Certificate and all the terms and conditions cited in the Tripartite Agreement are applicable to the defects liability period as well. ‘The validity of land guarantees, insurance bonds and insurances should be extended according to the terms and conditions of the Tripartite Agreement to cover the above defects liability period. In the event of the Contractor's failure to remedy any of the defects, errors or malfunctions brought to his notice by the Consultant/ Client, action would be taken against the Project Company under the terms and conditions of the Tripartite Agreement. ‘The “Certificate of Making Good Defects” for the Land Plot number 3-01-04 specified in this Completion Certificate will be issued separately by the GOSL under the clause 19.5 of the Tripartite Agreement, if applicable, at the end of the defects liability period upon successful rectification of all the defects by the Project Company. Final Completion Certificate will be issued as per the sub clause 18A.5 of the Tripartite Agreement, subject to fulfill the terms and conditions stipulated therein, ‘The effective Completion Date for Land Plot number 3-01-04 is 14" March 2019 Recommended by Certified by Approved by: P.
