1. GENERAL DESCRIPTION OF SERVICES

1.1 The Services to be performed by Contractor shall consist of the following works
(collectively referred to as “Service”):

1.1.1 Supply of Services in accordance with the scope of work, specifications, and
requirements;

1.1.2 Supply of competent, qualified, insured, and properly trained Contractor


Personnel capable to satisfactorily perform the Services as specified under this
Contract and Applicable Laws;

1.1.3 Supply, maintain, care, custody, and delivery at the Project Site of Fit-for-Purpose
equipment and materials necessary for the timely and successful performance of
the Services;

1.1.4 Obtain all Required Approvals and maintain all valid permits, licenses, franchises,
and comply with regulatory requirements, Applicable Laws and this Contract to
satisfactorily carry-out the Services; and

1.1.5 Such other services that may be required by the Owner which are necessary and
directly related to the performance of the Services and the timely completion
thereof (“Other Services”).

2. SCOPE OF WORK AND SPECIFICATIONS

2.1 Scope of Work

2.1.1 The Services are intended for use by Owner in Mt. Apo Geothermal Project
(MAGP) (the “project Site”). The climate at the Project site is characterized by a
more or less even distribution of rainfall throughout the year. The intense rain
period usually occurs during the months of June to February season. Contractor
is to expect said climate condition throughout the duration of Works and should
prepare for such eventualities and not use this as an excuse to suspend work or
ask for extension of time to complete the Works and Services, except as provided
on this Contract.

2.1.2 The Contractor shall perform the following as described in detail below:

i. In not less than 10 BD prior to all work at site, Contractor shall submit a Work
Program (including bar-chart/s-curve), PERT-CPM, Resource Loading, and
Working Table of Organization subject to the review and approval of the
Owner. Should Contractor fail to submit these and any necessary documents

in the required period, Contractor shall not be entitled to any extension of


time or additional cost.

ii. Contractor shall be responsible for the installation of signages and other
compliance to Owner’s requirements on Health, Environment, Safety and
Security.

iii. Contractor to procure necessary permits and Unified Permit-to-Work and


accomplish any and all necessary associated clearances.

2.1.3 Contractor shall provide supervision and technical expertise, labor, tools, Fit-for-
Purpose Equipment, Materials, other consumables, and incidentals necessary to
undertake the Proposed SIP Building Facility in MAGP in conformity with this
Contract. The Works shall include but not limited to the following:

A. Preliminary and General Works

i. Mobilization and Demobilization


▪ Contractor shall mobilize and demobilize Equipment, Materials and
Contractor Personnel to and from the Project Site

ii. Temporary Facilities


▪ Contractor shall provide temporary facility for staging area of
materials and temporary shed of Contractor’s personnel, necessary
for the Contractor to complete the Contract. Set-up and remove
facilities; clean up and reinstatement of the site as required upon
completion of the Contract;
▪ Contractor shall set-up and remove facilities and/or Temporary
Works; and
▪ Clean-up Project Site upon completion of the Works.

iii. Supervision and Overhead Cost


▪ Contractor shall provide project key personnel necessary in
implementing the project and to complete the Contract.

iv. Permits, Clearances, and Other Miscellaneous Expenses


▪ The Contractor shall also be responsible, and bear corresponding cost,
for procuring the securities, insurances, licenses, business permits,
permits to operate (PO) for any stationary fuel burning equipment,
building and occupancy permits and other necessary
permits/clearances pertinent to all phases of the work.

▪ Contractor shall bear the cost in relation to safety requirements such


as Safety Indoctrination and personal protective equipment (PPE) of
all its Contractor Personnel.
▪ The Contractor shall submit four sets of hard-bound as-built drawings
in A1 size, of four copies together with digital Autocad files stored in
USB drive.

3. CONTRACTOR’S MINIMUM KEY PERSONNEL

3.1 Contractor shall have the following Key Personnel:

3.1.1 One (1) Construction Manager


a. Must be a Filipino citizen;
b. Must be a Civil Engineer
c. Must have at least 3 years of relevant experience in similar position;
and
d. Must have at least 2 years of experience in similar works
3.1.2 One (1) Field Engineer
a. Must be a Filipino citizen;
b. Must be a Civil Engineer
c. Must have at least 3 years of relevant experience in similar position;
and
d. Must have at least 2 years of experience in similar works
3.1.3 One (1) Project Control Engineer
a. Must be a Filipino citizen;
b. Must be an Engineer or a graduate of any Engineering course;
c. Must have at least 3 years of experience in similar position for a Civil
Engineer or must have at least 5 years of experience in similar position
for a graduate of any Engineering course; and

3.1.4 One (1) Quality Control Engineer


a. Must be a Filipino citizen;
b. Must be an Engineer or a graduate of any Engineering course;
c. Must have at least 3 years of experience in similar position for a Civil
Engineer or must have at least 5 years of experience in similar position
for a graduate of any Engineering course; and
d. Must have at least 1 year of experience in similar Works.

3.1.5 One (1) Competent Person


a. Must be a Filipino citizen;
b. Must have at least 3 years of experience in similar position;
c. Must have at least 1 year of experience in similar works;
d. Must have attended at least 40 hours PTW Orientation Training; and
e. Must pass the PTW holder interview.

3.1.6 One (1) Safety Officer


a. Must be a Filipino citizen;
b. Must be a college level;
c. Must have at least 1 year of experience in safety implementation;
d. Must have attended at least 40 hours Basic Occupational Safety and
Health (BOSH) Training or 40 hours Construction Safety and Health
Training; and
e. Must pass the EDC Safety interview.
3.1.7 One (1) Nurse
f. Must be a Filipino citizen;
g. Registered Nurse;
h. Must have at least 1 year of experience in safety implementation;
i. Must have attended at least 40 hours Basic Occupational Safety and
Health (BOSH) Training or 40 hours Construction Safety and Health
Training; and
j. Must pass the EDC Safety interview.

The Safety Officer shall be responsible in implementing the applicable safety and
health rules and regulations. Contractor shall abide by all occupational safety and
health laws, standards, rules, regulations and procedures set, ordered, enforced and
administered by the Department of Labor and Employment (DOLE) – Bureau of
Working Condition (BWC), the Department of Energy (DOE) and the Owner.

3.2 Appointment and replacement of Key Personnel shall require prior approval by
Owner.

3.3 In case the Contractor fails to provide the minimum Key Personnel, Owner shall
deduct for the total Service Price the corresponding rate per day of the lacking Key
Personnel, in accordance with the table rates below, until such time that the lacking
Key Personnel is present at Project Site, or at the location agreed upon by the
parties, except when the absence of the Key Personnel is approved by the Owner
and a prior written notice was sent to Owner’s Representative.

3.4 Contractor shall submit the list and identities of Contractor Personnel to be
assigned to perform the Services. The list shall be accompanied by:

3.4.1 Fitness for Duty Certificates of each of the Contractor Personnel;


3.4.2 Compliance to LGU and EDC Covid-19 requirements;
3.4.3 Clearances, for the current year, such as:
a. National Bureau of Investigation (NBI) for transient workers outside
the province of Leyte/Police Clearance.

4. OTHER WORK REQUIREMENTS

4.1 Contractor shall engage for the third party Contractor for the inspection of all
Contractor’s lifting, heavy and hauling equipment including agreed vehicles with
semi or full trailers (i.e. cranes, boom trucks, forklifts, loaders, earth moving
equipment, etc.) to be used for the Works.

4.2 Contractor shall have its drivers/operators for lifting, heavy and hauling
equipment certified by Technical Education and Skills Development
Authority/Association of Carriers and Equipment Lessors, Inc. (TESDA/ACEL) or by
TESDA/ACEL accredited entities and undergo safety and security orientation prior
to mobilization at Project Site.

5. INSURANCES

5.1 In addition to other requirement set forth herein, the Contractor is likewise
required to provide the following insurances

5.1.1 Contractor’s All Risk (CAR/EAR) Insurance to cover the entire Works
(permanent and temporary) including materials supplied by the Owner,
to their full replacement value, from any causes whatsoever with:

5.1.2 Third Party Liability Insurance to cover death or injury to persons or


damages to property (including property of the Owner other than the
Works) caused by the Works, tools and/or equipment or personnel with a
combined single limit of PhP 5,000,000.00 and a cross liability provision
to cover both the properties and personnel of the Contractor and its sub-
Contractor and the Owner as if separate insurance were issued to them.
Such wording should be explicitly stated in the policy. Both the Owner
and the Contractor and its sub-Contractor must be named insured.
