I, Imamuddin, S/o Late Salahuddin, R/o B-6/11 DDA

Flats, Sarai Khalil Sadar Bazar, New Delhi-110033, do hereby

solemnly affirm and declare as under:

1. That the Deponent is the Respondent in the present Petition and

well conversant with the facts of the same and hence competent

to swear this affidavit.

 It is important to mention here that Petitioner is further

having various properties at different locations. The Deponent

has come to know that the Petitioner is having other properties

for the sake of business. It is submitted that the Deponent will

furnish the complete details of the properties as when he gets to

know about the same. It is thus crystal clear that the Petitioner

is not having any bonafide requirement of the premises in

question and has filed the present petition just with an ulterior

motive to harass and torture the Deponent and get vacated the

suit property while making the sheer misuse of provisions of law,

on false and frivolous grounds.

3. That the present petition is not maintainable and deserves

outright dismissal for the reason that the present petition has

been filed by the Petitioner with an ulterior motive to harass and

torture the Deponent and get vacated the premises in question

from the Deponent on the alleged false and frivolous grounds.

It is submitted that the present petition is just a counterblast

to the aforesaid suit filed by the Deponent against the

Petitioner, otherwise the Petitioner does not require the premises

in question for any purpose.

4. That the Present petition involves many triable issues which

requires evidence by both the parties.

5. That the witnesses on the point of determining the bonafide need

of the Petitioner, as alleged, are required to be examined before

this Hon’ble Court.

6. That in view of the aforesaid facts and circumstances, the

Deponent is entitled to be granted Leave to defend the present

petition.

7. That the contents of the accompanying application for grant of

leave to defend has been drafted by the counsel of the deponent

under his instructions and the same have been read over to him

in vernacular language.

8. That the contents of this affidavit are true and correct.
