CHILD PROTECTION PROGRAM AND POLICIES


Including Anti Bullying Policy Statement

A. RATIONALE

Article 15, Section 3 (2) of the Philippine Constitution upholds “the right of
children to assistance, including proper care and nutrition, and special protection
from all forms of neglect, abuse, cruelty, exploitation, and other conditions
prejudicial to their development.” This is supported by R.A. 7610, an act providing
for stronger deterrence and special protection against child abuse, exploitation, and
discrimination.
Likewise, the Convention on the Rights of the Child (CRC) spells out the
basic human rights that children everywhere have: the right to survival; to develop
to the fullest; to protection from harmful influences, abuse, and exploitation; and to
participate fully in family, cultural and social life.
In the same light, the Family Code of the Philippines, by way of the principle
of in loco parentis, gives the school, its administrators, and teachers the special
parental authority and responsibility over the minor child while under their
supervision, instruction, or custody. More recently, Republic Act 10627, or the
Anti-Bullying Act of 2013 was enacted to ensure that all schools provide a
conducive and safe learning environment for children.
As a DepEd institution, Tropical Village National High seeks to form learners
who manifest concern and care for others. Through programs initiated and services
provided, the school takes seriously its responsibility to protect and promote the
welfare of children and young people under its care.
Consequently, Tropical Village National High School will support the
Department’s campaign on child protection as embodied in the “DepEd Child
Protection Policy” enclosed in DepEd Order No. 40 s. 2012. We recognize the duties
and responsibilities of the school and school personnel stated in the policy as well
as the duties and responsibilities of the pupils, students, and learners stated
therein. We believe that a balanced emphasis given to the duties and
responsibilities of both the school and the learners will provide the ultimate
protection for all.

B. OBJECTIVES
This program aims to:

1. empower the students by including in the curriculum activities that


would develop their self-esteem, self-confidence, assertiveness, and self-
protective skills;
2. include in the faculty training program capacity-building activities for
school personnel that would develop a more proactive stance toward
ensuring a safe, free-from-fear, and healthy learning environment for the
students;
3. inform and involve parents by raising their level of awareness on the
significance of their role in protecting their children against various
forms of abuse; and

4. ensure that, whenever possible, effective working relationships and


coordination are constantly maintained between the school and the
community/ concerned agencies.

C. CHILD PROTECTION PROGRAM

The Child Protection Program ensures the involvement of the different


community sectors particularly the students, teachers and staff, school
administration, Parent-Teacher Associations, and the officials and members of the
local units (barangays). Through consultative and collaborative working efforts, the
program assures the school constituents of its preventive measures, protection, and
support from the community as regards to child protection and safety.

D. SPECIFIC ANTI-BULLYING POLICY STATEMENTS

In compliance with the Implementing Rules and Regulations of the AntiBullying Act
of 2013 (Republic Acts 10627), Tropical Village National High School will:

1. Prohibit the following consistent with Section 3 of the Act –

a. Bullying on the school grounds and its adjacent properties, in school-


sponsored or school-related activities on or off the school grounds,
vehicles leased by the school for special events, and school buses
accredited by the school.
b. Cyberbullying – bullying through the use of technology and electronic
device or other forms of media owned, leased, or used by the school.

c. Retaliation against a person reporting a case of bullying.

2. Address bullying through preventive and intervention programs as provided


for in Rule IV Sections 6 and 7 of the Anti-Bullying Law.

3. Implement the mechanisms and procedures provided for in Rule VI Sections


8.4-8.6 of the Anti-Bullying Law.

4. Draft a Code of Conduct and a plan to ensure child protection and safety
which
shall be reviewed every three (3) years.

E. ESTABLISHMENT OF THE CHILD PROTECTION COMMITTEE (CPC)

The school has established the Child Protection Committee (CPC) that shall work
closely with existing concerned offices in:

1. drafting policies and plans to ensure child protection and safety, which
shall be reviewed every three (3) years;

2. initiating information dissemination programs and organizing capacity-


building activities for the different school sectors;

3. developing and implementing a school-based referral and monitoring


system in response to identifying students who may be suffering from
significant harm from others;

4. ensuring that the children’s right to be heard is respected and upheld in


all matters and procedures affecting their welfare; and

5. closely coordinating with government agencies and non-governmental


organizations as may be appropriate.

F. ESTABLISHMENT OF THE SCHOOL DISCIPLINE COMMITTEE (SDC)


Article 349 of the New Civil Code provides that teachers shall exercise substitute
parental authority in relation to their students. While the law provides or assigns
them the legal authority of natural parents in a substitute capacity, they are
answerable for any damage or injury caused to other people by the tortuous not of
their students as long as the latter remain under their supervision and control.
Pursuant to Section I, Chapter III, Part IV of 2000 DECS Service Manual, every
school shall maintain discipline inside the school campus as well as the school
premises when students are engaged in activities authorized by the school. As
stated in paragraph 2, Section 6.2, Rule VI from Rules and Regulations of RA 9155
as mentioned in DepEd Order No. 1, s. 2003, the school head shall have authority,
accountability, and responsibility for creating an environment within the school
that is conducive to teaching and learning. Thus, school officials and teachers shall
have the right to impose appropriate and reasonable disciplinary measures in case
of minor offenses or infractions of good discipline.

G. Creation of School Discipline Committee.


There shall be a committee, which will handle grave/major offenses as stated
in the 2000 DECS Service Manual. They shall be composed of a chair, co-chair, and
member. The school principal shall designate a school disciplinary officer per
curriculum year level. He/she shall also designate a curriculum chairman and
class adviser per curriculum year level.

Section I. Duties and Responsibilities of School Discipline Committee

The committee shall have the following specific duties and responsibilities.

2.1 School Discipline Officer as Chair

 He/she shall serve as prefect of discipline within the curriculum year


level.
 He/she shall investigate cases listed on the offenses punishable by
suspension or expulsion depending on the seriousness of the offense
as stated in the TVNHS Code of Conduct. (See attachment)
 He/she shall secure records with confidentiality.
 He/she shall serve as the mediator between the offender and the
aggrieved party.
2.2. Curriculum Chairman as Co-chair
He/she shall serve as co-prefect of discipline within the year level in the
absence of the School Discipline Officer who shall investigate cases listed on the
offenses punishable by suspension or expulsion depending on the seriousness of
the offense as stated in the TVNHS Code of Conduct. (Please see the attachment)

 He/she shall secure records with confidentiality.


 He/she shall serve as a mediator between the offender and the
aggrieved party.
2.3. Class Adviser as a member
 He/she shall serve as a liaison between the school and the parents or
guardians.
 He/she shall write letters to call the attention of parents or guardians
to invite them to a conference.
 Prepare the anecdotal report and safeguard confidentiality.

Section 2. Referral.
All cases beyond the control and expertise of the School Discipline
Committee shall be referred to the following offices and furnish a copy of the
referral form attached with an anecdotal report and other supporting documents for
more extensive supervision and control. (See Annex A)

2.1. Office of the Principal

 The case needs administrative action.


 The case needs referral to other government agencies and private
institutions.
2.2. Office of Guidance and Counseling
 The client manifests deviant and maladjustment behaviors.
 The client violates the school rules and regulations despite signing the
behavior contract.
 The client needs to seek professional help.
Section 3. Jurisprudence.
All minor offenses or infractions of good discipline will be handled first by
class advisers. However, if the case is a grave offense, the class adviser is expected
to refer the case to the School Discipline Committee. They shall call the attention of
parents or guardians for a short conference and prepare the anecdotal report. When
the parties involved are between and/or among different year levels, the jurisdiction
of the school discipline officer shall be based on the year level of the primary
offender. The School Grievances and Complaints Committee (SGCC) will handle all
sensitive cases when the parties involved are between or among students and
teaching and/or non-teaching staff.
