REAL ESTATE MORTGAGE

Know All Men by These Presents:

This REAL ESTATE MORTGAGE is executed t by and between:

__________________________________, of legal age, Filipino, and with residence and


postal address in Purok 2, Brgy. Gulod, Cabuyao City, Laguna, hereinafter known as the
MORTGAGOR,

and

__________________________________, of legal age, Filipino, and with residence and


postal address in Purok 2, Brgy. Gulod, Cabuyao City, Laguna, hereinafter known as the
MORGAGEE,

WITNESSETH THAT:

That the MORTGAGOR is indebted unto the MORTGAGEE in the sum of


______________________________________________________ THOUSAND
PESOS (Php. _______________________________), Philippine Currency, receipt
whereof is hereby acknowledged and received on _________________ 2022, payable
within a period of ONE (1) YEAR, with interest at the rate of FIVE PERCENT (5%) per
month;

That for and in consideration of said indebtedness, the MORTGAGOR does


hereby convey and deliver by way of MORTGAGE unto the said MORTGAGEE and the
latter’s heirs and assigns, the certain parcel of land covered by Transfer Certificate of
Title No. ____________________of the Registry of Deeds of Calamba City, Laguna
situated in Barangay Gulod, Cabuyao City, Laguna, of which real property the
MORTGAGOR is the true and lawful owner of ___________________SQUARE
METERS PORTION of the aforementioned property in accordance with the provisions of
the Land Registration Act;

That should the MORTGAGOR failed to pay the said indebtedness on due date a
penalty of five (5) % per month shall be imposed on the principal loan

That should the MORTGAGOR duly pay or cause to be paid unto the
MORTGAGEE, or his heirs and assigns, the said indebtedness including interest and
penalty, within the agreed term, then this MORTGAGE shall be discharged, and
rendered of no force and effect, otherwise, it shall subsist and be subject to foreclosure
in the manner and form provided by law. OTHERWISE, the MORTGAGEE may have
enforced his/her rights herein without judicial proceedings by causing the above-
described property to be sold at public auction and the MORTGAGOR hereby appointed
the MORTGAGEE as Attorney-In-Fact in filing Extra Judicial Foreclosure in the City of
Cabuyao the place where the said proper is situated, after giving noticed of sale for 20
days posted in at least three public places of the said city said sale to take place on a
business day at the municipal building at said city, under the direction of a notary public
of said city, the provincial sheriff, in accordance with Act No. 3135, as amended by Act
No. 4118.
