LESSON 7 : General Principles of International Law

ASSESSMENT :

1. Identify one essential learning that you obtained from this lesson.
- Understanding the fundamental principles of international and national law will enable us to
protect ourselves from tyranny and improve the quality of our lives. These laws promote peace, justice,
cooperation, and commerce.

2. Reflect on how this learning will enable you to help the following:

a. Your country
- It is important to understand that every country's actions have far-reaching consequences that
affect the entire world. There would be no corporate accountability without regulations and laws.

b. Your community
- Knowing the laws is one of the most important skills we can have. It will help us, especially when
we do business in our neighborhood, because we will have a much better chance of protecting
ourselves.

c. Your school
- As students, we can have a significant impact on our society by always acting lawfully.

d. Your family
- Learning international law will help us define policy and improve our quality of life.
Understanding how significant they are and how they affect the global economy and politics will be eye-
opening. It will also lead to exciting career opportunities not only for our current generation, but also for
the next.

LESSON 8 : States, Nationality, and Statelessness

CONTEMPLATE

Study the Philippines as a state:

1. Does it possess all the elements mentioned?


- No.
2. How do you say so?
- Because of one of the elements mentioned, permanent pollution. Our country's population growth
rate is currently high. It leads to poverty and has become one of our society's most serious problems.
Our government is struggling to meet all of our fellow Filipinos' needs today, especially given the
pandemic. Because of our country's current situation, some Filipinos have chosen to migrate to other
countries. They believe that if they moved to a different country, they would have a better life.

3. Study 3 existing states all over the world. Discuss in the space below how the states you chose were
created.

1. Japan
- enactment of the new (democratic) constitution.
2. Korea
- it has been divided into two parts (South Korea & North Korea)
3. Israel
- when UN approved a plan to partition Palestine into a Jewish & Arab State. Israel was declared
independent state with David Ben-Gurion.

Rights of States Practices in the Philippines


The right to Independence The constitutional officers of the Philippines' free and
independent government must serve their full terms as
specified in the constitution.
The right to equality After years of lobbying by female rights activists, the
Philippines has finally enacted gender equality legislation.
The right to existence and self- defense The presence of unlawful aggression is one of the
circumstances that must be present in the Philippines in
order to avail of the defense of self-defense. So, if a person
is sexually harassed by a stranger, he or she has the right to
defend herself.
The right to territorial integrity and We Filipinos have the right to defend our homeland. You
jurisdiction cannot easily enter another person's property without their
permission. The same as the other country, which is why we
have people who guard our land borders with other
countries.
The right to legation We all have the right to send envoys to the Philippines or to
establish diplomatic missions there. We can live freely in
other countries.

1. What are you talking about?


- Dual citizens have certain advantages, such as the ability to freely live and work in two countries,
own property in both countries, and travel between them with relative ease. However, having dual
citizenship means having double responsibilities as a citizen in my opinion.

2. Why do you say so?


- You have dual responsibilities in both countries. Both countries require you to pay taxes. You are
required to complete all of the countries' mandatory service. If you do not comply, you may lose your
citizenship under certain conditions.

3. So what?
- So, in my opinion, having only one citizenship makes it easier to live peacefully. You must have
pride in your blood to be successful in your own country.

The Syrian refugee crisis is the humanitarian emergency resulting from the Syrian civil war that began
March 15, 2011. Conflict in Syria has exacted a heavy toll on hundreds of thousands of children and their
families. It created the largest refugee and displacement crisis of our time, affecting millions of people
and spilling into surrounding countries.

3. Philippines could be a temporary destination as refugees await acceptance from a host country for
resettlement

The Philippines has a long history of extending its kindness to successive waves of refugees fleeing
persecution since the end of World War I, and it continues to uphold this humanitarian tradition to
support the forcibly displaced today.

2. Draw the map of the straight baselines above-stated and the corresponding coastal areas in the space
below.

3. What did you observe from these maps and straight baselines?
- The twenty-one straight baseline segments total 826.4 nautical miles, forming all but
approximately 30 miles of the Burmese baseline. The average segment length is nearly 40 n.m. The
maximum length is 222.3 n.m. which forms a closing line for the Gulf of Martaban. At no point does the
straight baseline exceed seaward of the continental shelf of Burma. None of the base points are situated
on the mainland of Burma. The ratio of water to land enclosed within the baselines is estimated to
exceed 50:1.

- One essential learning from this lesson is the importance of understanding the principles of
maritime law. It is critical that we mark our own territory on every map so that others are aware of it.
They will honor it.

- It is critical that we learn to respect the territory of other countries. We must protect ourselves by
knowing and defending our territory.

- We should help our community to protect our marine life. We should conduct a community service

knowledge and ideas to benefit our country.

this lesson.
- As a Filipino, you should be aware that you are born free and equal in dignity and rights. We are
entitled to all rights and freedoms without regard to race, color, gender, language, religion, political or
other opinion, or other status.

2. Reflect on how this learning will enable you to help the following:

a. Your country
- By exercising all of our rights in the Philippines

b. Your community
- These laws were created for all of us, that’s why we should also respect other’s right. We should
not abuse other people.

c. Your school
- It will assist us in living lawfully at all times. We, as students, should be aware of this law in order
to protect ourselves.

d. Your family
- If other people abuse you or members of your family, you can protect them.
