I. INTRODUCTION

1.1. Background of the Study

Slater Young, a Filipino engineer and content creator, recently introduced The Rise at
Monterrazas, a luxury condo project in Cebu City. Inspired by the Banaue Rice Terraces, it aims
for advanced and sustainable living, utilizing the mountainside for a safe and eco-friendly
design. The project offers unique amenities like individual infinity pools and a clubhouse,
blending comfort and luxury. Slater Young sees this as a milestone in Philippine real estate,
gaining significant interest even in its early stages. If you seek an exclusive and lasting
investment in Cebu City, the project promises a distinct living experience.

The Rise at Monterrazas, a luxurious residential complex in Guadalupe, Cebu City,


developed by The Month Property Group and led by civil engineer Slater Young, is set for
turnover in 2028. Offering diverse 3-bedroom units starting at Php 56M, with floor areas ranging
from 244 to 533 square meters, the project demonstrates a commitment to environmental
responsibility. Young and his experienced team have made about 300 revisions to ensure
meticulous planning and sustainability. Notable features include a drip irrigation system for
rainwater collection, addressing concerns raised by environmental groups. The project, located at
the base of a mountain, has secured an Environmental Compliance Certificate from the
Department of Environment and Natural Resources, showcasing a proactive approach to legal
requirements (Monterrazas de Cebu, 2023; PhilStar Global, 2023).

The project unveiled as the first mountain development in the Philippines, faced
immediate controversy upon its announcement on August 24 (Sitchon, 2023). Despite
emphasizing sustainability and meticulous planning, the project's location near Monterrazas de
Cebu, a site with a history of cease and desist orders due to potential environmental disasters,
stirred concerns. Monterrazas, previously owned by Landco Pacific Corporation and Genvi
Development Corporation, has faced issues such as mudslides and flooding, raising questions
about the environmental impact of further development (Makoy, 2023). Moreover, the project's
proximity to Guadalupe, the most populated barangay in Cebu City, adds complexity to the
situation. Despite securing Environmental Compliance Certificates, the project faces scrutiny
regarding its environmental impact assessment, public consultation, and compliance with
regulations.

The controversies surrounding the project underscore the necessity of aligning real estate
ventures with stringent environmental laws and ethical practices. Possible positive outcomes
involve successfully implementing sustainability features, and contributing to responsible real
estate practices. Conversely, negative outcomes could include legal challenges, heightened
environmental impact concerns, and reputational risks for the developers. This case study offers
a platform for discussing the balance between economic development and environmental
protection within the framework of CE Laws, Ethics, and Contract surrounding critical aspects
such as environmental compliance, ethical considerations, and legal regulations.

The outcomes of this study will help the public, specially the community in Barangay
Guadalupe, Cebu in obtaining the necessary information

This case study aims to investigate the controversies surrounding The Rise at
Monterrazas, emphasizing its environmental impact, legal challenges, and ethical considerations,
to enhance understanding of the balance between economic development and environmental
protection in real estate ventures. Specifically,
• To analyze the environmental implications in light of its location and past controversies;
• To assess the legal challenges related to environmental compliance and public
consultation; and
• To explore the ethical considerations involved in the development. Focusing on the
responsibility of real estate developers toward the environment and local communities.

1.4. Scope and Limitations

This study delves into controversies surrounding The Rise at Monterrazas, examining its
impact on the environment, legal challenges, and ethical dimensions. The focus is on
understanding how the project influences its surroundings, particularly ecologically, and its
adherence to ethical standards in Cebu City's real estate development.

Several limitations exist in this study. Real-time data collection for a dynamic project
may pose challenges. Restricted access to specific legal documents and proprietary information
is anticipated. Time constraints may limit the capacity for a comprehensive, long-term analysis.
Despite these constraints, the study aims to provide valuable insights based on available
resources.
