23 I am not aware that you or anyone else of Victoria Police responded to my writings and I will
24 first quote the images of the previous supplement and then add some more to it. I intent also to
25 explain the importance of a person holding a “WORKING WITH CHILDREN PERMIT”, in
26 particular when trespassing upon a property where underage children are living.

30 On 3 January 2024 Banyule City Council employee clearly trespassed upon both the properties
31 of 105 & 109 and by this trespassed upon the property of 107 Graham Road, Viewbank and
32 invaded also our privacy. Being at least the 12th time of trespassing upon out property as well as
33 invasion of our privacy, and despite this the Victoria Police continues to fail to enforce the rule
34 of law against Banyule City Council and by this I view became an accessory to the harm
35 inflicted to both my wife and myself.

37 The following is a text message of one of my neighbours, showing that prior to that she had any
38 communication with the Banyule City Council he already had walked across her front law to our
39 joint fence and was making photos of our property, which is trespassing as well as invading our
40 privacy. He then appears to me to have falsely claimed that there was an “appointment” even so
41 no such appointment was made by my wife and/or myself. There appears to me an error in the
42 text message as it states “and will know contact the council and the police regarding this matter”
43 which I understand the word “know” ought to be “now”.

15 underlines that the photos were taken after Banyule City Council staff had walked over the front
16 lawn of 109 to the joint fence between the properties of 107 and 109 and as such the person had
17 left the most shortest walk way to the front door of 109 and by this trespassed to go to the fence
18 to make photos of the 107 property before she attended to the man.

1 The following images appear to me to show a garbage bin but my impression is that Banyule
2 City Council Worker is standing there also for several seconds and I suspect looking into the
3 window of 105 property. Compare 27B picture (where he walks in front of the brick wall) with
4 for example with picture (24-68-19-6). Your judgement is? Pictures 28A/28B and 29A/29B
5 shows he is walking past the front of the house. When I spoke with the tenant he was unaware
6 this Banyule City Council staff member had been on the property, as such I view he was
7 trespassing.

12 Where he is at 51B is in front of the house, and cannot reach the doorbell of 109 property, as for
13 that he needs to be on the veranda and there is a small fence along the veranda that will not allow
14 him to walk from the veranda to where he is now as he would have to walk around the small
15 fence by going back to the driveway and then walk along the house over the front lawn. This
16 would be trespassing without prior consent of the property owner, but then again 105 wasn’t
17 asked either for permission to walk across the front lawn.

1 O.K. it turns out that 109 property owners was after all at home and she was given the
2 understanding Banyule City council staff had an appointment with 107 property owners and well
3 already having taken pictures over the fence so there really was nothing she could do about that.

8 For a person to ring the bell of 109 the person needs to go up the driveway to the steps to the
9 veranda and then walk along the veranda to reach the front door. For as person then to go to the
10 joint fence of 107 and 109 the person needs to walk back to the driveway and then walk across
11 the front lawn of 109 to get to the joint fence. The moment a person walks from the driveway
12 across the front lawn without permission this then is trespassing, unless for example the person is
13 say a gas meter reader who has the right to go to the gas meter, albeit cannot then go to the fence
14 to take photos of another property, as that would then become trespassing on 109 and likewise
15 the invasion of privacy of 107 would also be trespassing, etc. Therefore the person already
16 having been at the fence of 107/109 making photos of 107 clearly was doing so unlawfully and
17 not at all as part of an “appointment”.

19 In my view the ordinary course of attending to an (alleged) “appointment” would be to first
20 attend to the address of the “appointment” and if the matter may be urgent a person finding no
21 response after ringing the bell at the gate, may inquire with neighbours if they are aware of the
22 person concerned being home or not , etc. Once doesn’t just go to a neighbours property then
23 trespass and walk along the front of the house over the front lawn of 105 with a camera in hand
24 and then make whatever photos, which might be of the 3 underage girls living there, perhaps
25 over the fence for paedophilia or whatever, or take photos of 107 invading that owners of that
26 property privacy while trespassing already at 105.
27 I attended to my neighbours property at 105 and noticed that at their staircase they have a low
28 fence, I presume to keep their dog in. However, I didn’t step over the small fence but called out
29 for my neighbour instead and he then attended to me. He gave me the understanding he had not
30 been aware of a person entering the property of 105 let alone having past the front window when
31 walking along the front lawn and then to make photos when at the fence. This severely
32 compromise, at least in my view, the safety of the 3 girls which I assume one may be attending
33 kinder and 2 might be attending primary school. And not to ignore this being the 5 th time I know
34 about that Banyule City Council staff trespassed on the property of 105 Graham Road,

18 Essentially this means: Buzz off, I got more important matters to attend to!

20 After all, I am not going to leave my wife unattended merely because some joker might have the
21 inspiration to ring the doorbell.

23 If therefore the Banyule City Council person had any real “appointment” with me then I
24 obviously would have already been prepared to be there at the time of the appointment.
25 However, where I had no “appointment” made and not interested in having anyone entering our
26 property, which is my right and entitlement, then I do not need to answer anyone ringing a bell at
27 the gate.

29 It is very important that citizens do not cave into the terrorism of any council. Hold
30 them legally accountable. Perhaps this document may provide an insight how to do
31 so.

36 This document does set out a person doesn’t have to attend to a door, etc, if someone rings the
37 bell.

39 As for 109, it is my understanding she didn’t seek to act wrongly by allowing this Banyule City
40 Council staff member to continue to make photos, albeit no neighbour has the rights to allow
41 someone to intrude to a neighbouring property and invade their privacy.
42 Suppose 109 had one or more visitors and someone wanted to know who they were and perhaps
43 wanting to get incriminating pictures or whatever. If then the person came to me asking to enter
44 my property I would make clear I cannot allow someone to engage in criminal activities using
45 my property as that may make me a party of any crime being committed.
46 There can be absolutely no question about it that this Banyule City Council made absolutely no
47 attempt to contact us, regardless if we would or wouldn’t respond to the ringing of the bell. As
48 such I view he was determined to unlawfully obtain pictures of our property regardless of my
49 wife and my privacy and legal rights.
50 Imaging I were to allow someone to enter my property and a neighbour trusting there are high
51 fencing all around happens to walk out to get something out of the back garden and then end up

1 ending up in a compromising situation on a photo to which the neighbour had not given
2 permission for?
3 As I proved with property 105, when there was a small gate preventing me to ring the doorbell it
4 was not for me to blatantly ignore this gate and to deny my neighbours legal rights, I simply had
5 no right to determine what my neighbour intention was with the small gate, as it was none of my
6 business. My neighbour pay for the property and he owns no accountability to others other than
7 the landlord. And this I hold is his right.
8 If Banyule City Council was to employ say a paedophile who then can walk about trespassing on
9 private property taking photos perhaps of underage children, who may or may not be in a
10 compromise situation, and such staff member may sell images to other deviants then surely one
11 would expect the Victoria Police to step in and pursue criminal charges. Yet, despite my ongoing
12 writings none of this eventuated. For all I know pictures of the girls faces may already be sold on
13 the internet. Some creep might very well have horrible intentions and this is of concern to me as
14 I view the 3 girls safety and wellbeing may now be compromised. And this despite that I
15 extensively wrote previously of the dangers to the girls. Let no one ignore what happened to 6
16 year old Jo-Bennet who was murdered in the cellar of her house.
17 One may ask if those Banyule City Council staff members all actually have a “WORKING
18 WITH CHILDREN” permit? If not why not? Why indeed allow any Banyule City Council staff
19 member to trespass upon a property? Here you got Banyule City council alleging that my wife
20 and I are violating legislation, even so they do not have any evidence to prove this and then go
21 about time and time again to trespass, etc. As if they are above the rule of law!
22
23 Now let us deal with matters in order of how the Planning and Environment requires the conduct
24 of lawful entry to be performed.
25
26 1. First of all there has to be an existing (building) permit in operation, not some long ago
27 permit that was disposed of more than half a century ago when a then permit was
28 completed and whatever was build was approved. Once the structure(s) built in
29 accordance to the then existing building permit has been completed and approved the
30 building permit no longer has any relevance.
31 2. As the original permit was disposed off by the approval of what was built then only when
32 property owner/tenant built something on a property that ordinary requires a building
33 permit then at most a failure to obtain a building permit may be at issue for litigation.
34 3. Banyule City Council has indicated that it pursues a breach of a permit allegedly
35 regarding a ”store” on the property albeit to obtain evidence it pursues a NOTIFICATION
36 TO NOTICE TO ENTER. In my view a nonsensical wording which at most may been that
37 the NOTIFICATION is given in advance that at a later time a NOTICE TO ENTER will
38 be issued. To my knowledge at no time was a NOTICE TO ENTER issued no legal
39 grounds existed/exist to issue a NOTICE TO ENTER.
40 4. A NOTICE TO ENTER requires first of all that a court has determined a litigation before
41 it between Banyule City council and the opponent party and upon hearing both sides
42 determined that the opposing party was GUILTY of violating either an existing permit or
43 failed to apply for a permit where such was ordinary required. I am not aware of any
44 actual court litigation between Banyule City Council and my wife and I having existed let
45 alone a court having handed down a “GUILTY” finding against my wife and myself.
46 5. If a Court had handed down a finding that my wife and I were “GUILTY” of failing to
47 apply for a permit, and it is not conceded this actually eventuated, then the Governor of
48 Victoria on advise of the State executive (Government) as Governor-in-Council may issue
49 an Order. I am not aware the Governor-in-Council issued any Order, as no legal basis
50 existed/exist for such Order.

1 6. O)ne a Governor-in-Council issue an Order then the relevant council may pursue
2 provisions of the Planning and Environment Act such as Sections 134, 135, 137 to issue a
3 NOTICE TO ENTER, provided the legal processes have been followed.
4 7. There is no legal provision, at least to my understanding, to issue a NOTIFICATION TO
5 NOTICE TO ENTER.
6 8. For the above listed points no lawful entry by Banyule City Council was permitted.

18 and we seem to have a grossly incompetent Chief Commissioner of Police who would be eager
19 to go after a person for daring to pursue their constitutional rights but can’t bother to hold real
20 criminals legally accountable.

35 I personally view that a “WORKING WITH CHILDREN” is very important, in particularly also
36 when it comes to children hospitals were medical staff have enough to worry about attending to
37 children and should be relieved from having to waste time to try to work out if a person is
38 acceptable to enter.

40 Let me give an example ( no names of persons are included for confidential reasons):

1 I went to visit a long term (platinic) friend, I had not seen for a long time, who was the mother of
2 4 adult children. Upon arrival my friend explained that she was a carer for a 7 year old girl who
3 suffered from Rett syndrome, couldn’t walk or talk or participate in anything with others. I had
4 been ma single parent when my daughter was 2 years old and subsequently had another 4 living
5 with me and so while considering the girls problems to me she was a human being and should be
6 treated as such. My friend went to the kitchen to make me a cup of coffee and I sitting next to the
7 couch started to talk to the girl as I used to do to my daughter when she was little. Meaning no
8 talking down but rather as person to person. The girl looked at me with her big eyes, perhaps
9 surprised I was talking to her rather than ignoring her. My friend came with the cup of coffee and
10 I turned and remained to sit on the ground against the couch. Suddenly, I felt something against
11 the side of my face and my friend called out something like: She never did that before she
12 touched your face! My friend indicated that somehow the girl and I had clicked and if I could
13 come more often because that would be great for the girl as most people was ignoring her. My
14 friend indicated however that I would need to apply and obtain a WORKING WITH
15 CHILDREN permit. I did and after receiving the permit I went to visit and showed I had the
16 permit. From then on I would regularly use the crane to more the girl from her wheelchair into a
17 sling and then place her on her bed. I would let her lean her head against my chest while I was
18 wrapping the sling around her and she seemed to like to hear my hearth beat. Later it actually
19 may have saved her life to know my heartbeat. Anyhow, about 2 years later the girl came back
20 from respite (that is where disabled children go to give the carer a few days a break) and when
21 the girl was sitting in her wheelchair to be moved onto her bed I noticed fear in her eyes. I talked
22 to the girl that something was wrong and we better would take it slowly while she could tell me
23 what was wrong with her. As she couldn’t verbally talk to me and neither move her arms and
24 hands to show me the area of her pain I looked into her eyes (as I usually did) to find what she
25 was saying. In the end I understood that her leg was an issue and I assured her we would take it
26 very slowly to seek to avoid any pains. Ordinary it may take 5 to 10 minutes but now it took
27 more than 30 minutes. After that I made known to the carer that there was something very wrong
28 with the girl’s leg. The carer responded she knows she always has problems with her legs but I
29 explained it was something different as the girl told me. With her eyes. The carer explained she
30 had on the Monday an appointment at the Royal Children’s Hospital and so now being there
31 weekend better wait for Monday. On the Monday I accompanied the carer and the girl to the
32 hospital and the carer explained to the doctor that there was something wrong with the girl’s leg.
33 The doctor then checked it out and concluded nothing special. The carer knowing of the special
34 bond between me and the girl then asked for x-ray’s to be made to make sure. The doctor agreed.
35 The x-ray’s revealed her leg bone had fractured. The Hospital organised for an investigation as
36 to what could have caused this, also as she had returned from respite, etc. In the end a report
37 concluded that the weakness of her bones caused the fracture. More than a year later the girl
38 needed a stainless steel rob to be fitted onto her spine because her spine was bending the wrong
39 way. After the operation I received a text message from the carer asking if I could urgently come
40 to the Royal children Hospital because the girl was dying and I was the only person who could
41 safe her life. I rushed to the Royal Children Hospital and the carer was very much emotional. I
42 just walked to the bed of the girl and took in each of my hands her hands. I stood there, not at all
43 talking, as I held that if the girl could feel my heartbeat this might turn around things. I stood
44 there at least for more than half an hour, not talking to anyone and the carer just sat there
45 watching me. I then noticed that the girl opened her eyes looking at me and then closed them
46 again. I didn’t say anything just kept holding her hands but I had gained the confidence the girl
47 would pull through. Probably more than another half an hour I hears a nurse walking into the
48 room and that moment the girl opened her eyes again and stared at me. I continued to hold her
49 hands but the run quickly left the room and returned with a doctor. I then asked the doctor if we
50 could take the girl downstairs to the (hospital) park one all the instruments were removed from
51 her. He looked as if he saw water burning because the girl’s parents had been notified to say their

1 goodbye’s and here I was talking as to take the girl to the park. His response was that he had no
2 objection for the girl to be taken downstairs to the park if all the instruments were removed, one
3 everything was held to be alright. About an hour later the carer, the girl and I went downstairs to
4 the park. The parents had been notified their daughter was OK. The carer making known that she
5 knew I was the girl’s garden angle. Sometime later the girl’s school had a dance and the girl (in
6 her wheelchair) and I danced and we won a prize. Dinner for 2, albeit we never used the tickets
7 because the girl was being fed through a tube into the stomach. Then the time came that the carer
8 due to being invalid herself no longer could care for the girl, and then the girl moved to another
9 carer. While when the girl was 7 the carer had been informed not to expect the girl to live
10 beyond 10 years old, in 2023 I was informed the girl celebrated her 21st birthday.

12 What proved critical in the survival of the girl was that I had this “WORKING WITH
13 CHILDREN” permit and had absolutely no hassle to enter into the Royal Children’s Hospital to
14 seek to avoid the child to die. Without the “WORKING WITH CHILDREN” permit the
15 hospital may have been obligated to deny me access to what appeared to be a dying child, but
16 now in an extreme emergency no time was lost and the girl survived against all expectations.
17
18 When the girl turned 10 her parents held a birthday party and I went along with the carer and the
19 girl. I however was all the time sitting next to the girl just in case something was to eventuate.
20 Well, her mother was celebrating and then near the girl lost her balance and would have ended
21 up falling on the girl was it not that I prevented her falling on the girl.
22 At times the carer had to collect the girl from her school and I would come along, as the carer
23 held that I was a very good influence upon the girl that she was not anxious, etc. and when we
24 arrived at the school the girl would get exited seeing me and the teachers at time s would say
25 “Your Dad is here”. While I had no biological connection with the girl for most people it was as
26 if I was her father. I do have 3 biological daughter and a step daughter besides 5 sons but still
27 this girl was like a daughter to me.

29 Regretfully, at least in my view, children are not taught how to learn to communicate with a
30 disabled child and that often leaves a disabled child alone if not lonely. Actually, the same with
31 adults, I know because for 37 years I did conduct a (FREE FROM CHARGE) special life line
32 service dealing with people so desperate they contemplated suicide, murder and even mass
33 murder.

35 This is also how I understood the horrific consequences when police, politicians, council staff
36 are blatantly ignoring to act appropriately. And if anything Banyule City Council, the Victorian
37 Police, politicians and their collaborators are proving this in their current conduct. Only this time

39 gallery of court rooms watching me for decades in action at the Bar table assisting/representing

42 The Victorian Police by having failed to take appropriate action against Banyule City Council to
43 prevent them to continue their crime spree now can be considered a party to it and face legal
44 accountability for being an accessory to it all.

46 In my view the Victorian Police should immediately investigate what was recorded on the
47 camera that Banyule City Council staff used to take photos/videos and so if there is any
48 compromising images such as that of my neighbour girls. Also establish if any of the images was
49 with the consent of each and every person and/or where it was regarding property of the property
50 holder.

1 As I indicated above I specifically warned that images could be published on the internet if a
2 person was to enter the property, etc. and this as I expected all along that soon or later I would be
3 the target of a reign of terror and so was preparing in advance for this.

5 When we have a Chief Commissioner of Police who not just sit on his backside but even
6 participate in the “covid scam” that harms untold people and killing many then I view such a
7 person is a disgrace to his/her profession and should be removed from this position without any
8 undue delay.

10 I obtained the assistance of a person to video record any person who might be suspiciously be
11 around my property and most of the above images have been from the videos that were made on
12 3 January 2024 from about 9 am onwards. By the assistance of this person I was able to remain
13 with my wife to try to keep her calm as it very much upsets her that Banyule City Council
14 vandalised her car and yet the Victorian Police appears to have done nothing about it. And this
15 may underline why the youth of today has not particular respect for the rule of law as they see
16 that the Victorian Police itself acted like terrorist shooting rubber bullet upon parents holding
17 their small children doing no more but to exercise their constitutional rights whole ignoring the
18 real criminals.

20 In 2020 I wrote this to a Victorian Police Sergeant

26 unacceptable.

28 There are various videos on the internet showing the Victorian Police attacking citizens for
29 not wearing a mask, even arresting them. What those officers may not realise is that they by
30 this in my view have no QUALIFIED IMMUNITY and can be personally sued.

32 The Chief commissioner of Police even announced police having already smashed windows
33 of cars, etc. And, reportedly police fired into a motor vehicle.

35 How matters can be misunderstood.
36 Most persons may have seen how George Floyd died when a police officer held his knee on his neck. And
37 many made clear this was plain murder. However, there have now other videos surfaced which indicate that
38 was absolutely no racism involved. Moreover, police manual sets out how to place an arm or a knee on a
39 person’s neck until the person is unconscious. I will not describe everything safe to say that there is a video
40 of a black police officer doing precisely the same to a white male and when the police officer was informed
41 the person had died he was joking about it. To my knowledge no charges then followed.

43 What this example indicates is that one need to consider all relevant facts in each separate
44 incident and not just part of this.

46 The police on 10 August 2020 claimed he was not aware of any exemption not to wear a
47 mask. And most police officers may not be aware of this, nevertheless that is not an excuse. In
48 the Nuremberg trial’s it was made clear that following orders is no excuse to deny a person
49 his rights, etc.

52 There was a lot more to it and while you may not then have been Chief Commissioner Of Police
53 nevertheless your were part of the Victorian Police. How many of the police and their family

4 As for the nonsense of “QUALIFIED IMMUNITY” that is utter and sheer nonsense because
5 the constitution doesn’t provide for this, and the Parliament cannot overrule the constitution!

17 then get politicians, councillors, police and their collaborators discovering that they may have a
18 painful lesson to lose their personal possession when held legally accountable for their
