12 I provided a 8 April 2020 complaint to the Victorian Ombudsman re the
13 involvement of the Victorian Police regarding alleged COVID-19 issues which the Ombudsman
14 referred on to Victorian IBAC regretfully IBAC claimed in its correspondence to me that the
15 issue was deemed not of “public interest”.

17 Since then matters have dramatically escalated with the Victorian Police much is involved. I
18 below will also address the issue of testing involving the Victorian Police and others, etc.

28 I understand that there was a health official issuing notices for a lockdown of 9 high rising flats,
29 seemingly on instigation of the premier Mr Daniel Andrews.
30 While I accept that when a person has an infection it would be appropriate for the health official
31 to request a court to authorise quarantine. However the Framers of then Commonwealth of
32 Australia Constitution Act 1900 (UK)in which in Section 106 the States were created
33 "SUBJECT TO THIS CONSTITUTION" and as such subject to the legal principles embedded in
34 this constitution:

13 Therefore, locking up healthy people cannot be legally justified when no competent court of
14 jurisdiction authorized this after “both sides heard”. When will politicians do again the same or
15 worse in the future for their political mantra using health officials as an excuse to terrorize the
16 community?
17 In my view, unless there were specific court orders (after both parties were heard) authorizing
18 the virtual imprisonment of residents regardless of how healthy they were, I view that this is
19 rightfully an issue for the Victorian Ombudsman to investigate .

24 I will give you an example as to how one could easily be misled re a particular issue at hand:

26 As you are aware many cancer patients having chemotherapy will have hair loss and many
27 I understand are bullied at school and suffer greatly. However, it would be absurd to hold
28 that every person who is bald therefore suffers from cancer and is a victim of harassment.
29 This, as many a person, in particular adults, shave their heads because well they just desire
30 to do so. As such, merely because some people have hair-loss from cancer treatment
31 doesn’t mean that every person who is bald must be suffering from cancer.
32
33 As such, generalisation is not just likely causing a gross injustice upon those who do not
34 suffer of cancer but also may deprive the real sufferers of a proper understanding and
35 support.

1 Worse is when someone being bald is outed and denied normal involvement with others
2 for the fear they might somehow infect others. This as if cancer is contagious to others
3 around them.

5 I as a constitutionalist and (now retired) Professional Advocate during cross examination of
6 expert witnesses would expose that what an expert witness stated as evidence may be the truth to
7 this expert witness but may be totally in conflict with what was already before the court as
8 “evidence” from other sources. Hence, it is always critical that one doesn’t jump to conclusions
9 merely because one may have grown up with certain views, which by hindsight might be totally
10 different.
11 For example, about every person in Australia born or naturalised claims to be an “Australian
12 citizen” (by birth of nationality), however In AEC v Schorel-Hlavka I challenged “compulsory”
13 aspect of voting, the constitutional validity of “Australian citizenship” being a nationality, the
14 usage of AVERMENT, etc. I objected to many other purported legislative provisions including
15 “compulsory” voting. On 4 December 2002 the Magistrates Court of Victoria at Melbourne (by
16 consent of the parties) ordered that the many constitutional issues (including Citizenship) was to
17 be heard and determined by the High Court of Australia. It is a mere issue of law that when a
18 person objects to the constitutionality of a legislation then that part objected to is ULTRA
19 VIRES AB INITIO, unless and until if ever at all a competent court of jurisdiction declares it to
20 be INTRA VIRES. This has not eventuated by the HCA. However, on 19 July 2006 the Country
21 Court of Victoria exercising federal jurisdiction upheld both my appeals.
22
23 Therefore, it should be clear that any person dealing with this matter should not have any
24 prejudice to merely “assume” something!
25
26 Indeed, I recall some decades ago when I was at the bar table before His Honour Guess J and I
27 was submitting to His Honour about an authority and of head quoted part of it. His Honour then
28 made clear he had been the leading (senior) Counsel in that case and what I stated had absolutely
29 nothing to do with the case. I invited His Honour to check the law report I had referred to. His
30 Honour did so and then announced that I was correct that indeed I had correctly quoted the
31 authority but he simply had not realised it was part of the case.

33 I for one had no formal medical training and yet when cross examining medical doctors was able
34 to expose that the evidence they had given was not what were the real facts of the case.
35
36 I until 2019 conducted for 37 years a (private) special lifeline service under the motto MAY
37 JUSTICE ALWAYS PREVAIL, dealing with persons contemplating as I understood it suicide,
38 murder and even mass murder. When I understood that the then Family Court of Australia then
39 at 570 Bourke Street Melbourne was to be targeted to kill judges and lawyer’s I contacted the
40 then Premier of Victoria urging to install metal detectors and to his credit they were not long
41 thereafter rolled out.

43 I, inn July 2016, wrote to all federal and state politicians that obstacles such as bollards should be
44 placed in tam tracks and specifically referred to Bourke Street mall as to prevent possible mass
45 murder. I in December 2016 referred to this again but nothing was done to secure the area and
46 well on 20 January 2017 reportedly 6 people were murdered in Bourke Street, Melbourne.

48 In 2017 I was asked to investigate (privately) the murder of Carl Williams. I did not at that time
49 read any investigation reports by the Victorian Ombudsman, the Victorian Police or others so as
50 not to be side tracked. I later that your wrote to the Victorian Police, Ombudsman, etc, that in my
51 view the Williams had not been appropriately represented by lawyers and that it appeared to me

1 the Victorian Police had concealed relevant evidence from the Ombudsman investigation,
2 relating to who delivered the CD containing statement of Carl Williams to the prison. I
3 understand that after the death of Carl Williams (about 6 weeks later) the Governor of the Prison
4 went missing in the Grampians while in his car a copy was located of the CD that had been
5 delivered to Carl Williams.
6 Moreover, another copy had been located in the possessions of another prisoner.
7
8 I recall, a case where I represented a party and a CD was part of an Affidavit. I however noticed
9 that the date the CD was created was a day AFTER the Affidavit was sworn. Checking the Court
10 file this too was burned the day after the Affidavit was sworn. During evidence it was claimed
11 that the CD was outsourced to a company and this company appeared to have changed the
12 content of the CD (that was what attracted my attention as it was in conflict to what the Affidavit
13 claimed was on the recording) and also the Affidavit was not re-sworn. Once any part is altered
14 after an Affidavit is sworn then the Affidavit needs to be re-sworn as it no longer is an Affidavit
15 as such when anything is altered after swearing in (or affirming it).
16
17 Therefore, when I became aware that 2 copies existed of the same content that was delivered to
18 Carl Williams in prison it was clear to me that all the authorities had to do was to check the date
19 and time the copies were burned. This, as if the copies were burned prior to delivery of the
20 original to Carl Williams then likely the police officer did so and delivered the copies to others.
21 If the copies were burned after the records shows the police officer delivered the original to Carl
22 Williams then it would have been prison staff who would have burned the copies.
23
24 Correction Services I understood claimed that the Governor was essentially computer illiterate
25 and didn’t know how to properly use a computer, however, as the CD (delivered to Carl
26 Williams) was first checked for its content on the computer of the prison then all it was needed
27 was to do “Control+A” and the content would have been in the memory. Then say the prison
28 government later on his own with the computer then could have done “Control+V” to either or
29 both put it on the computer and/or burn a CD. Again, the time and date ordinary is recorded on
30 each copy that was burned and as such the Police in any investigation could have established
31 when a copy located in possession of a prisoner and/or the Governor (who 6 weeks later
32 disappeared in the Grampians) was created.
33
34 There was also what I view an elaborate swindle involving Police Integrity and the ATO
35 regarding the deal made with Carl Williams. As I referred to above in AEC v Schorel-Hlavka (4
36 August 2005) I also challenged “AVERMENT” on constitutional grounds and the magistrates
37 Court of Victoria after the day of submissions from both parties upheld my objection that the
38 Commonwealth could not rely upon “AVERMENT” this because (Kable NSW) the
39 Commonwealth must accept the State Court as it finds it.
40 The Moti case had been wrongly claimed by the Police to deny the deal that was made with Mr
41 Carl Williams to pay his fathers tax bill, etc. To the credit of Mr Williams (father of Carl) he
42 raised this Moti issue but was blatantly disregarded. Reality is that the High Court of Australia in
43 its decision clearly rebuked what had been claimed originally by the presiding judge.
44 Here we had Mr Carl Williams in a deal pleading guilty and then the Victorian Police wrongly
45 denied him the deal, after he had already pleading guilty. More over, the ATO in regard of
46 George Williams referred to “AVERT” as it does in untold other cases this even so again on 4
47 August 2005 I defeated the Commonwealth in that “AVERT”/”AVERMENT” cannot be used by
48 any commonwealth authority unless and until if ever at all the State legislature provided for this,
49 such as it did with Bass Strait.

1 In December 2018 a former police officer came to my property (without prior knowledge and/or
2 authority) and with a worker smashed a new fence I was building and which was within the
3 boundary line of my property (next to the original fence) and while I reported this to the
4 Victorian Police until now nothing was done about this. This former police officer made clear
5 the police wouldn’t bother to get involved.
6 My wife is 87 and in October 2019 was in ICU with Hearth Failure, etc, and well it really scared
7 the living daylight out of her that despite having gates and signage warning to enter without prior
8 permission would be trespassing nevertheless an estimated $10,000 damage was cause
9 (considering that a complete new fence would need to be build), and no police investigation
10 whatsoever despite my extensive writing to the then Chief Commissioner of Police. My wife
11 assumed that more than likely this might have been some kind of deliberate destruction perhaps
12 of the Carl Williams case as to what I had exposed relating to the police involvement.
13
14 While my wife was in hospital, I woke up and heard noises at the backdoor and discovered 2
15 police officers at the back trying to break in to the property. I am well aware that I have signage
16 warning about unlawful access and when I opened the door the male police officer first response
17 was to tell me to do a welfare check on request of my wife. The moment the police officer stated
18 this I realised that he had acted lawfully and in fact thanked (via email) the Victorian Police and
19 upon this Senior Sergeant Kim French wrote me an email thanking me for praising the police
20 officers in their conduct. I used to be in management of factories and hold that when someone
21 does a good job you do show recognition regarding this and not just criticise only. My wife
22 afterwards made known she had authorise the police to even smash a window to gain access and
23 I was rather glad the police had caused minor damage to the door frame.

25 To my knowledge, albeit being a constitutionalist I was able to represent myself having the
26 constitution as my defence shield, no one else ever defeated the Commonwealth that
27 “compulsory” voting is unconstitutional. At the time Mr R Hulls attorney-general for Victoria
28 made known the State would abide by the court decision. Reality is that instead people are fined
29 for “failing to vote”.

31 As you may have noticed my typing is closely typed whereas ordinary lawyers are using
32 DOUBLE SPACING. Once an opponent barrister took me on that my documentation was too
33 close typed because the Court rules provide for 6 mm between the lines and he claimed mine was
34 violating this rule. I explained to the Court that I was born in The Netherlands and had no formal
35 education in the English language and so to me 6 mm between the lines was not DOUBLE
36 SPACING but rather like a 6 mm linen page where the line forms the baseline of each line
37 written. After various submissions from both sides the court held that I was correct.
38 Yet, lawyers ordinary still continue to do DOUBLE SPACING when really they are violating the
39 court rules.

42 homework.

17 We now have as I understand it people openly canvassing to hang politicians and others, and
18 while I oppose violence and certainly executions it should be understood that without law
19 enforcement agencies operating to ensure the rule of law is enforced regardless of who the
20 person might be then in the end civil war likely might be the end result.

22 I view that Victorian IBAC is too much political to take the side of the ALP rather than too be
23 neutral as to the political association of any person. While it might be held that those law
24 breakers of the ALP such as with the RED SHIRT issues got away in reality it merely adds to the
25 seeding of dissatisfaction. Precisely what law enforcement authorities are to avoid.

27 If it was good enough to take me to court for failing to file a candidate expenditure return even
28 so as I explained to the court I had outstanding request for compensation where the ALP was
29 involved in criminal activity against me destroying my political signage’s during the 2010
30 Ivanhoe election and I didn’t desire to file a false/misleading return where I could be held not
31 having disclosed any payment of compensation, hence the court didn’t order any cost against me,
32 then yet many ALP Members of parliament precisely failed to declare all relevant monies, such
33 as those unlawfully obtained during the 2014 Victorian election and yet the Victorian Police
34 somehow seems to have held that to file a false/misleading declaration is not to be pursued.
35 clearly this shows DOUBLE STANDARDS.

37 When it comes to people being fined $1,652 regarding claimed violation of restrictions the police
38 proved to claim that no one was above the rule of law. Well, when they=n there was a political
39 rally to which I understand Premier Daniel Andres supports then the Victorian Police is
40 instructed not to fine any of the participants. Yet after this the Victorian Police again are fining
41 others.

43 It is therefore clear that so to say the Victorian Police and IBAC are in the pocket of Premioer
44 Daniel Andres and are like puppets on aa string doing whatever is commanded. This to me is not
45 law enforcement but enforcement of dictatorship and tyranny.

47 While Premier Daniel Andrews himself has been claiming it is all for the safety of citizens
48 reality is that it is nothing more then abuse of powers. After all, if it was about safety of citizens
49 then where the political protest (well that was what it was claimed to be) was justified then
50 nevertheless the “social distancing” should have been enforced. But obviously this whole “social
51 distancing” really appears to have been a money revenue issue rather than based upon proper
52 medical science. Even the WHO (World Health Organisation) on 4 June 2020 admitted that
53 asymptomatic persons cannot infect others.

4 Yet, we have the Premier Mr Daniel Andrews suddenly locking down many post code area’s and
5 even 500 police officer locking up a reported 9 high rising flats to prevent anyone from leaving
6 the buildings.

23 weaponised the police is the more likely violent criminals will be using weapons to challenge the

2 The absurdity is also that a proper look as the mask shows that it is not at all sealing around the
3 skin and so places the police officer in danger, that is if there is a real infected person around.
4 What appears to me is that this COVID-19 fraud is conducted as a pre-run for the NEW
5 WORLD ORDER. And as there are questions as to Premier Daniel Andres communist
6 connections allegedly violating the “external affairs” provisions of the Commonwealth of
7 Australia Constitution Act 1900 (UK) where within section 106 the States were created
8 “SUBJECT TO THIS CONSTITUTION”, then I view that any authority ought to have concern
9 as to the legitimately of it all.

12 There is now even a specialist offering $5,000 to anyone proving that a person died of COVID-
13 19.

15 This, as even a judge when told that her sister had died of COVID-19 didn’t accept this and a
16 subsequent autopsy showed that the sister had no coronavirus at all.
17 The issue is not if there is some virus going on but if this is really a virus that somehow justify
18 this kind of tyranny upon citizens without even a court of competent jurisdiction having
19 sanctioned any of it.

22 now but it ought to be clear that the rates of death allegedly of COVID-19 is far less than
23 ordinary flu related deaths. This then beg the question is the Premier going to lockdown the state
24 for every flu season?

12 As a constitutionalist it appears to me that this statement would be applicable when the
13 Commonwealth commenced to register with the District of Columbia which is subject to
14 the legislative provisions of the US Senate and so violates S44 of our constitution.

16 As I indicated in previous correspondence that “man-kind” illnesses are within the legislative
17 powers of the Commonwealth. However, I di accept that where a person is found to be suffering
18 of an illness and fails to act according to health legislative provisions then the Government
19 authorities can apply to a court for a special order against that person. However, there is no
20 unilateral decision making power for a Premier to disregard the rule of law and to ignore legal
21 processes and essentially imprison people even so they are not suffering of any ill health and
22 neither any court issued an order to sanction such a conduct.

24 As my various writings (see links below) have shown that not even the testing can be relied upon
25 nor the number of claimed testing for being positive because even the USA CDC double count
26 alleged infection rates. And, while the infection rates apparently are skyrocketing the death rates
27 somehow are plummeting.

29 We have the Victorian Police (other than when the Premiers political mates are protesting)
30 issuing $1,652 fines for a medical unjustified “social distancing”.

32 As the documents to which the links relate the Victorian Minister of Health precided over a
33 fiasco of even reportedly security guards sleeping with those in quarantine and take them
34 shopping.

36 In my view, any person who is infected should have been quarantined and assisted with food and
37 medication to avoid any need for shopping. This was not done at all and my past writings
38 criticised this but now on 5 July 2020 suddenly those in the Housing flats are provided with
39 some essential food but not others of lockdown postcodes area’s.

1 And, those who are door knocking (to ask about coronavirus issues) in fact themselves not
2 properly protected could easily spread the virus when in contact with a person who is actually
3 infected.

5 There are ample of video’s showing that using a mask actually can be very harmful as one

12 Get the drift why Premier Daniel Andrews seems to encourage people to be tested even when
13 having mild symptoms? As if you got a “common cold” you can be found positive for a
14 “coronavirus” and so be added to the list of “COVID-19” positive tested persons and be not only

27 When Josepha van Rooy was charged with 3 criminal offences regarding injuring a police officer
28 with her motor vehicle on 19 July 2006 she approached me in the court lobby (I just had
29 succeeded in both appeals) when she asked me to assist her. I accepted and wrote to the DPP
30 that there was “NO CASE TO ANSWER”, upon which the DPP responded to withdraw 2 out of
31 3 charges. While ordinary one submit “NO CASE TO ANSWER” to the court at conclusion of
32 the prosecutors case there is however no rule that you cannot do so, as I did, about 2 years before
33 the trial commences. On the one hand, you so to say may awake a sleeping dog to warn them
34 better make sure their case is solid but on the other hand getting rid of 2 charges itself
35 considerably reduced the litigation battle. In any event After the prosecutor completed the case
36 Wood J held that the prosecutor had not made out its case and directed the jury to return NOT
37 GUILTY verdict. This it did. So, the prosecutor having 5 police officers, a Clerk of Court and a
38 Deputy Clerk of Court nevertheless got no where without Jospeha van Rooy needing to present
39 any defense.
40 One major issue in the case was that as was set out in the written submissions titled “ADDRESS
41 TO THE COURT” that the police had tampered with audio recording where they had made 11
42 cuts to fabricate a version of recording most suitable to the police. That is what they filed in
43 court. Just that Jospeha van Rooy unbeknown to the police also had recorded the same and as
44 such it exposed the police conduct to manufacture a version of events that really NEVER
45 EXISTE DAS SUCH.
46 Let me use an HYPOTHETICAL example:

48 A” tells be “B”: “I don’t like going to the Sunday market when it rains.” Later “B” tells “C” “A”
49 told me that he doesn’t like going to the Sunday market.”.
50 Clearly, by “B” concealing the rain reference as the real motive changed dramatically what “A”

15 ordinary police get away with it or they just claim the recorded wasn’t working.
16 In my view there should be a minimum penalty of 5 years in imprisonment if some police officer
17 deliberately turns off recordings as this I view is deliberate to obstruct the course of justice by

29 directly need deal with the farmers. And if it is indeed a project meant to serve the public purpose,
30 details of the agreement must be immediately made public.

33 are trying to outdo each other to attract investments. This is a race right to the bottom. The moment Tata
34 Motors threatened to walk away from Singur, several state governments came forward. The lure of big-ticket
35 project is such that governments are willing to forgo taxes, forcibly acquire land, give subsidized water and
36 electricity, give capital subsidies and put thousands of security personnel to man the project. In all this,
37 industries are having free ride on public money. This is cheap industrialization. Where not only states are
38 giving fiscal subsidies, they are subsidizing the natural resources—land, water, and energy. In a single
39 economic entity that India is, competition between states, by the way of subsidizing industrialization, is
40 neither good for economy nor is it good for environment. And it surely is not for ‘public purpose’.

21 I am a constitutionalist and to show I know my basis on 19 July 2006 representing myself I
22 comprehensively defeated the Commonwealth in AEC v Schorel-Hlavka on constitutional
23 grounds against “compulsory” voting. While at times I vote if I consider there is a worthy
24 candidate to vote for it is voluntarily for me to do so. Meaning if I hold there is no worthy
25 candidate to vote for I do not vote. The court upheld both appeals.

27 If the police were to fine me for claiming I breached confinements rules then I have no doubt I
28 would defeat the police for this.
29 As a senior citizen, and my wife being 87 with heart Failure and numerous other medical
30 problems, I am very much guarding against getting ill. However, I view that the lockdown is
31 unconstitutional and not prepared to sacrifice my, and that of my wife, constitutional rights
32 embed as legal principles in the Commonwealth of Australia Constitution Act 1900 (UK). The
33 States created within Section 106 “subject to this constitution” therefore are bound by it.

10 Obviously in the proper context this means the Commonwealth can apply quarantine measures
11 regarding humans but within its powers of aliens, migration and immigration. The States lack
12 this powers unless the person is found to be in ill-health and not otherwise. This means, as the
13 Framers of the Constitution made clear that any “citizen” (meaning a person residing within the
14 Commonwealth of Australia) who is an “alien” can be subjected to special provisions of the
15 Commonwealth. The Commonwealth therefore even without any QUARANTINE issue involved
16 limit the movement of any “alien”, as it deems appropriate in the circumstances. Also it can
17 invoke S51(xxvi) against any specific race but not against the “general community”! The
18 Framers of the Constitution made clear that S51(xxvi) could not be used against the “general
19 community”. The States cannot unilaterally order a kind of house arrest for its citizens (being
20 people residing within the State) as it has no such constitutional powers. However, a State within
21 its Health legislation obviously can provide for anyone who has a certain contagious illness to be
22 limited in movement. Any citizen who however doesn’t accept this cannot be restrained unless
23 both in Federal and State/Territory a court obtains a specific court order against that particular
24 person. However, a court exercising state and/or federal powers cannot merely issue orders in
25 violation of a person’s constitutional rights. As I proved with both successful appeals on 19 July
26 2006 in AEC v Schorel-Hlavka that I was well within my constitutional rights of Political
27 Liberty to be subjected to “compulsory” voting. As such if I do vote in any political election it is
28 because I consider there is a worthy candidate who is standing to vote for. Otherwise I continue
29 to exercise my rights not to vote.
30 Likewise with this nonsense of purported unilateral “house arrest” under whatever mantra this is
31 pursued, it simply is not going to prevent me to do what I elect to do. Our constitution provides
32 for embedded legal rights of freedoms which no Parliament can blatantly disregard.

28 Mr. ISAACS.-It is puzzling to me why a restriction has been made in this way, that the state is not to be at
29 liberty to abridge the privileges or immunities of the citizens of other states.
30 Mr. SYMON.-It is the essence of the Constitution that the state shall have that power within its
31 legislative jurisdiction. Every state can do that.
32 Mr. ISAACS.-Yes, within its legislative jurisdiction, and that consideration gives immense force to what I
33 said at starting, and what Mr. Trenwith said. We are giving to the Federation certain powers of
34 legislation, and we are reserving all others to the states. If the Federation chooses to exercise its
35 legislative powers within its sphere, it can over-ride anything a state does.
36 Mr. SYMON.-There is no object in the limitation of the federal jurisdiction.
37 Mr. ISAACS.-None whatever; and if the state is to have reserved to itself all other powers, I cannot
38 understand the bearing of it. I thought it my duty, therefore, to bring under the notice of the Convention the
39 reason why it was introduced into the American Constitution. It was to cut down the powers of the state as
40 exercised by refusing citizenship to the blacks. There have been quite a number of decisions on the subject,
41 but it would be profitless to refer to them further. I have endeavoured to point out as briefly as I can how this
42 matter stands, and I think it will be found in the end, subject to anything that Mr. Wise may have to say, that
43 the basis of it all is the 14th amendment of the United States Constitution.
44 Mr. WISE (New South Wales).-I do not like to speak with any confidence after such a strong expression
45 of opinion from one so well qualified to give an opinion as the Attorney-General of Victoria, but my

1 recollection of the reasons which led to the first part of the clause being inserted in the Draft Bill of 1891
2 leads me to say that the words were intended to limit the legislative jurisdiction of the states by such
3 necessary restrictions as were thought desirable to give the Federation power to settle disputes between states
4 arising from the exercise of the legislative authority within each state. I very much regret that Mr. Clark's
5 memorandum, a portion of which I read yesterday, has not been returned. In the concluding part of that
6 memorandum he draws special attention to these words, and points out that they were a necessary
7 complement to the implied surrender of the right to claim redress by diplomatic or other means which was
8 made by every state when it entered into an equal federation with other states. He lays down in express terms
9 the principle which Judge Shipman used as the basis of his judgment in the case I cited yesterday from 22
10 Blatchford, 131, that is to say, if a state passes a law the effect of which is to injure the territory or property
11 of persons outside the state-that may not be the intention, but if the direct effect is to inflict injury upon the
12 territory or property of citizens in another state-then that law, although in so far as it only affects citizens
13 within the state that passes it, it is intra vires of the Constitution, it becomes ultra vires in so far as it inflicts
14 injury on the inhabitants of another state. That, I believe, was the intention, although I feel some diffidence in
15 insisting upon it. This was the view which formed the basis of the judgment of Mr. Justice Shipman.

17 The state of Connecticut had authorized certain works which injured property in the adjoining state of
18 Massachusetts, and it was held that that was a matter in which the Federal Court, in the interests of the
19 Federation, was entitled to exercise jurisdiction.
20 Mr. ISAACS.-Every text-book writer ignores that case; I cannot find it anywhere.
21 Mr. WISE.-The object of this was by no means to deal with a set of circumstances such as have arisen in
22 the United States, which could not have arisen here, but to deal with other matters; and it seems to me that
23 the clause as it stands would be a powerful instrument to prevent an abuse of powers by a state, not for the
24 purpose of injuring the citizens of that state, but for the purpose of injuring the citizens of other states.
25 Mr. ISAACS.-Can you give a concrete case?
26 Mr. WISE.-Well, take the case of imposing a poll tax on citizens passing from one state to another. Such a
27 law as that would at present be within the competency of the legislation of any colony.
28 Mr. SYMON.-Not if this Constitution becomes law.
29 Mr. WISE.-It might be dealt with by another clause, and would also be dealt with by this clause 110. I am
30 not dealing now with the latter part of the clause, because I admit that that is open to other objections. I am
31 confining my attention to the first portion. The instance I have given is of course an extreme one, but it is
32 such cases as that which, according to my recollection, it was intended should be dealt with by the first
33 portion of this clause. I very much regret that Mr. Clark's memorandum is not in the hands of honorable
34 members, because it deals with the first part of this clause and shows what importance Mr. Clark attaches to
35 it as one of the draftsmen of the Bill of 1891.
36 Mr. ISAACS.-How would the entry into one state by a citizen of another state be an immunity or a
37 privilege of that citizen?
38 Mr. WISE.-Let me give another illustration. Suppose an extra probate duty were imposed on Victorians
39 who had property in New South Wales, or vice versa.
40 Mr. REID.-Or an absentee tax.
41 Mr. WISE.-Yes, or an absentee tax.

43 Mr. WISE.-No; I mean an absentee tax making those who reside in one part of the Union pay higher-say
44 pay a higher probate duty or legacy duty-than those who reside within the state imposing the tax.
45 Mr. ISAACS.-How could that be a privilege or immunity of the citizens of the other states?
46 Mr. WISE.-It would be putting an exceptional disability upon the citizens of another state, to which the
47 citizens of the state imposing the tax were not subject.

1 Mr. ISAACS.-But how is it a privilege or immunity of the citizens of another state that they should not be
2 taxed as absentees by a particular state?
3 Mr. WISE.-It is an immunity at present.
4 Mr. ISAACS.-Then you can never tax a man living in another state?
5 Mr. WISE.-You cannot impose exceptional treatment upon the citizens of another state; that applies
6 to everything. It is difficult to contemplate a concrete case, but that the words themselves have a definite and
7 clear meaning any one can see; and whether that clear power should be taken away or not is a matter of very
8 serious consideration. It does appear to me that this clause is a powerful instrument in the hands of the federal
9 authority to prevent any state acting in an overt manner, permitting overt acts of hostility against citizens
10 outside its jurisdiction. For that reason I hope that the clause will be allowed to stand.
11 Mr. OCONNOR (New South Wales).-The honorable and learned member (Mr. Isaacs) is I think
12 correct in the history of this clause that he has given, and this is [start page 672] one of those instances
13 which should make us very careful of following too slavishly the provisions of the United States
14 Constitution, or any other Constitution. No doubt in putting together the draft of this Bill, those who
15 were responsible for doing so used the material they found in every Constitution before it, and
16 probably they felt that they would be incurring a great deal of responsibility in leaving out provisions
17 which might be in the least degree applicable. But it is for us to consider, looking at the history and
18 reasons for these provisions in the Constitution of the United States, whether they are in any way
19 applicable; and I quite agree with my honorable and learned friend (Mr. Carruthers) that we should
20 be very careful of every word that we put in this Constitution, and that we should have no word in it
21 which we do not see some reason for. Because there can be no question that in time to come, when this
22 Constitution has to be interpreted, every word will be weighed and an interpretation given to it; and
23 by the use now of what I may describe as idle words which we have no use for, we may be giving a
24 direction to the Constitution which none of us now contemplate. Therefore, it is incumbent upon us to
25 see that there is some reason for every clause and every word that goes into this Constitution. Now, I
26 agree with Mr. Isaacs, that the 14th amendment of the United States Constitution was directed entirely
27 to the question of the citizenship of negroes who were freed men, and it was necessary to implant
28 something of that kind in the American Constitution, because of the fever heat which had been excited,
29 and which was then subsiding, over the war which had convulsed the country. But how can that
30 condition of things, or that necessity which arose then, have any hearing on our position? I take it that
31 the best way to look on this matter is to try and forget all about the 14th amendment of the United
32 States Constitution, and regard it as though we were framing this Constitution without any knowledge
33 of any such provision. It seems to me that the first portion of the amendment of the United States
34 Constitution, which deals with citizenship, is not in any way necessary. Surely every person who has
35 the suffrage-the right to vote within the Commonwealth-and who lives within the Commonwealth, is a
36 citizen of the Commonwealth, and entitled to all its privileges, including the right to take part as the
37 Commonwealth provides in the framing of the laws.
38 Mr. HIGGINS.-They have declared that in the amendment of the Constitution of the United States; but we
39 have not got it here.
40 Mr. ISAACS.-That shows the history of it.
41 Mr. OCONNOR.-That shows the history of it, as Mr. Isaacs suggests. I am pointing out that there is no
42 necessity for it in our Constitution-no necessity to point out that every person in the states is a citizen of the
43 Commonwealth. There is no necessity for it, because citizenship follows from the rights you give every
44 person in every portion of the Commonwealth under the Constitution. Now, is there any right which it is
45 necessary to state that you give? I see that this provision that we are discussing now makes some reference to
46 privileges or immunities of citizens. Quite sufficient has been pointed out to show that that might work in an
47 exceedingly complicated way-in a way we have no conception of at the present time-if it is inserted in its
48 present form. The only possible differences or disabilities in the states now, as affecting different classes of
49 citizens, are those which exist in regard to aliens and coloured races. But already in clause 52 we have
50 agreed to the insertion of a sub-section which enables the Commonwealth to deal with that matter, and
51 there can be no question about it that in course of time the different laws that exist in the states dealing
52 with such coloured races will be similar, and that such races will be dealt with uniformly, so that
53 whatever privileges [start page 673] or disabilities exist in one state with regard to these people will
54 exist in another state. There is only one portion of the Tasmanian amendment which I think should be
55 preserved, and I prefer it in the form in which it stands as submitted by the Legislative Assembly of

1 Tasmania. I think that the only portion of it which it is necessary to preserve is this-altering the wording
2 slightly so as to make it read as I think it should read-
3 A state shall not deprive any person of life, liberty, or property without due process of law, or deny to
4 any person within its jurisdiction the equal protection of its laws.
5 So that any citizen of any portion of the Commonwealth would have the guarantee of liberty and safety in
6 regard to the processes of law, and also would have a guarantee of the equal administration of the law as it
7 exists. I think Mr. Isaacs will bear me out, that in the United States it has been decided that the title to equal
8 treatment under the law does not mean that you cannot make a law which differentiates one class of the
9 community from another; but, as has been decided, it means that in the administration of the laws you have
10 made, all the citizens shall be treated equally. And that should be so. Whatever privilege we give to our
11 citizens, the administration of the law should be equal to all, whatever their colour. The case I refer to is
12 one of the Chinese cases-I forget the name of it.

6 still infected after 42 days, as I previously wrote about.
7 What we therefore have is that instead of narrowing down those who are purportedly infected by
8 being properly tested and then provided adequate medical care we now have knee jerking
