18 I am not a medical qualified person neither a scientist but at least I can use common sense. This
19 is the greatest elaborate swindle perpetrated upon the world and an ordinary citizen like myself
20 somehow can understand matters better then wimps like yourself, the prime minister, the
21 premiers, the first ministers and the lot of doctors and scientist employed by all the governments
22 in Australia. We even had a judge of the Federal Court falling for this elaborate swindle.

30 thereafter on 13 April 2020 with the Human Rights Commissioner. The Ombudsman referred the

1 tactic to get the community to verbally attack those not wearing a mask. I at no time heard him
2 urging people to be careful as not to violate others their rights not to wear a mask for health
3 reasons. Likewise the “social distancing” but somehow no using “employment distancing” where
4 one then could see at some stored employees hugging each other but demanding that customers
5 kept a distance. Then also came the directive about facemask only after it was issues it days later
6 was made known that mask with a ventilator was not to be used. And the Premier claiming that
7 instead of a mask a shawl or other item was also sufficient. As the media reported there were
8 conflicting directions made by Premier Daniel Andrews and health officials.

10 It should be very clear there was this ongoing fear mongering. There was this we need to flatten
11 the curve. There was this needing to wear mask to protect others and a lot more and in the end it
12 all was a gross deception.
13 It appears to me that roadworks near my residence by the State Government somehow was going
14 on regardless of the LOCKDOWN/CURFEW to underlines that the destruction of the economy
15 seemed to be justified but not the ambitions of the premier.

1 Now back to our question of whether the government – state or federal – can confine persons against their
2 will in order to protect public health. The short answer is yes, but the Constitution requires procedural due
3 process. That means a trial for every person confined.
4 Thus, a government-ordered quarantine of all persons in a city block or a postal ZIP code or a telephone area
5 code would be an egregious violation of due process, both substantive and procedural. Substantively, no
6 government in America has the lawful power to curtail natural rights by decree.
7 Procedurally, notwithstanding the fear of disease contagion, the states and feds may only quarantine those
8 who are actively contagious and will infect others imminently. And it must present evidence of both at a trial
9 at which it bears the burden of proof.
10 While the non-aggression principle permits offensive aggression in self-defense when an attack is imminent
11 and certain, that is a high standard for the government to meet, as it should be. Freedom – even the freedom
12 of a madman or a dangerously sick and contagious person – is the default position. Infringing upon it without
13 procedural due process is always constitutionally impermissible.
14 The Constitution was not written for the government to right every wrong. We know that government itself
15 causes most wrongs – the theft of property by taxation, the impairment of economic liberty by regulation, the
16 slaughter of innocents by war, the infringement of expressive liberties by majority vote. Yet, the Constitution
17 still mandates an exacting due process for all whom the government would restrain.
18 That means a trial before any quarantine, no matter the public danger, and a fair trial, not one animated by
19 mass hysteria or government-generated fear.

29 them about “climate change” and other claims?

34 And let us not forget that the premier is still pursuing his elaborate deception claiming that he
35 needs a 12 month extension until a (possible never to happen) vaccine is available.
36 What I view is that IBAC so far miserably failed to place an urgency on matters and it no so to
37 say better get of its backside and make clear to the Premier that his abuse and misuse of powers
38 must stop.

41 choice. But at least let the Victorian Police who participated in this elaborate hoax/abuse also be
42 held accountable and the Chief commissioner of Police should in my view stand aside
