Referral Mechanism/System

Every pupil should feel safe and protected from any form of abuse
which, in this policy means any kind of neglect, non-accidental physical
injury, sexual exploitation or emotional illness. Pursuant to DepEd Order
No. 40, s. 2012, Bismartz Elementary School is committed to safeguarding
and promoting the welfare of the learners and expects all internal and
external stakeholders to share this commitment. Referral System DepEd,
MSWD, appropriate judicial body Complainant Adviser/Subject Teacher
(Intake Sheet, Anecdotal Report, Incidental Report) Child Protection
Committee (CPC) Monitoring & Evaluation System Scope and Limitation.
This policy is delimited to the pupils of Bismartz Elementary School and in
any related to school child protection incidents that may occur within and
outside the school premises that require proper and/or appropriate action.

Definition of Terms

Child- refers to any person below (11) years of age or those over but
unable to fully take care of themselves or protect themselves from abuse ,
neglect, cruelty , exploitation or discrimination because of a physical or
mental disability or condition ; ( RA 7610). This also includes pupils who
may be eleven (11) years of age or older but are in school.

Pupil/learner- means a child who regularly attends classes in any


level of the basic education system, under the supervision and tutelage of
a teacher or facilitator.

School personnel- means the person singly or collectively working in a


public or private school.

Child protection – refers to programs, services, procedures and


structures that are intended to prevent and respond to abuse, neglect,
exploitation, discrimination, and violence.

Parents- refers to biological parent, step-parents, adoptive parents


and the common law spouse or partner of the parent.

Guardians or custodians- refers to legal guardians, foster parents,


and other persons including relatives or even non-relatives, who have
physical custody of the child.

School Visitor or Guest- refers to any person who visits the school and
has any official business with the school, and any person who does not
have any official business but is found within the premises of the school.

Referral Guidelines A referral to the higher authorities will not


normally be made where; The complaint does not involve a serious
criminal offense; The case is one that can be satisfactorily investigated and
dealt with under the school’s internal procedures. However, if during the
course of internal procedures, it appears that the situation is more
serious, the committee will again consider whether a referral should be
made. Confidentiality and Information Sharing. The school will keep all
child protection records confidential, allowing disclosure only to those who
need the information in order to safeguard and promote the welfare of the
student. The school will cooperate with the higher authorities or social
services to ensure that all relevant information is shared for the purposes
of child protection investigations to safeguard the pupil/s.

Action and Penalty

Written warning on anecdotal record with parent’s notice; 1st


Offense: written warning on anecdotal record in the presence of the parents;
2nd Offense: discipline with parent’s information; 3rd Offense: advice to
transfer to other school or institution.

Definition of Terms

Discrimination against children- refers to an act of exclusion ,


distinction, restriction or preference which is based on any ground such as
age, ethnicity, sex, sexual orientation and gender identity, language,
religion, political or other opinion, national or social origin , property, birth,
being infected or affected by Human Immunodeficiency Virus and Acquired
Immune Deficiency Syndrome (AIDS), being pregnant, being a child in
conflict with the law, being a child with disability or other status of
condition, and which has the purpose or effect of nullifying or impairing the
recognition, enjoyment or exercise by all persons, on an equal footing, of all
rights and freedoms.

Child exploitations- refers to use of children for someone else’s


advantage, gratification or profit often resulting in an unjust, cruel and
harmful treatment of the child. These activities disrupt the child’s normal
physical or mental health, education, moral and social emotional
development. It covers situation of manipulation, misuse, abuse,
victimization, oppression or ill-treatment.

Bullying - is committed when a student commits an act or a series of


single acts directed towards another student, or a series of single acts
directed towards several students in a school setting or a place of learning,
which results in physical and mental abuse, harassment, intimidation, or
humiliation.

Cyber-bullying- is any conduct defined in the preceding paragraph, as


resulting in harassment , intimidation, or humiliation, through electronic
means or other technology, such as , but not limited to texting, , instant
messaging, chatting, internet , social networking websites or other platforms
and format.

“Child Abuse” – refers to the maltreatment of a child, whether habitual


or not.

“Bullies” or “victim” – refers to any student who experiences the acts
of bullying or retaliation as defined by Republic Act and its Implementing
Rules and Regulations.

“Bully” –refers to any student who commits acts of bullying as defined


by the Republic Act and its Implementing Rules and Regulations.

Bystander – refers to any person who witnesses or has personal


knowledge of any actual or perceived acts or incidents of bullying or
retaliation as defined by these implementing rules.

Duty of the Faculty and Staff every faculty and staff of the school is
duty bound to: Abide to the Vision and Mission and Core Values of the
Department of Education; To protect students from abuse; To be aware of
the school’s child protection procedure and to follow them; Give attention to
the health, nutrition, and medical needs of the students; To acquaint on
how to access and implement the procedures, independently if necessary; To
keep a sufficient record of any significant complain, conversation or event;
To report any matter of concern to the CPC; Child abuse, exploitation,
corporal punishment, violence and discrimination cases shall be penalized
in administrative proceedings as Grave or Simple Misconduct depending on
the gravity of the act and its consequences under existing laws , rules and
regulations.( DepEd Order no. 40, s. 12 section 15) Procedures The CPC
hearing the complaint of abuse must; Listen carefully to the student and
keep an open mind. Reassure the student but not give a guarantee of
absolute confidentiality. The members of the committee should explain that
they need to pass the information to the higher authorities who will ensure
that the correct action is taken. Keep a sufficient written record of
conversation securely. The record should be signed by the person making it
and should use names, not initials.

SCHOOL RULES

REGULAR AND PROMPT ATTENDANCE IN CLASS

1. Attend classes regularly and punctually.


2. Immediately inform the teacher if absent from class unexpectedly.
3. Avoid leaving class before the scheduled time.
4. Notify the teacher if leaving class is necessary due to illness or unavoidable
reasons.

5. Arrive at school ten minutes before the start of class.


6. Avoid spreading mess upon arrival at school.

BEHAVIOR INSIDE THE CLASSROOM

1. Always enter the classroom prepared for lessons.


2. Speak respectfully at all times.
3. Develop the habit of bringing personal belongings to school.
4. Listen attentively at all times.
5. Wait for your turn to speak.
6. Return books, chairs, and other materials to their proper places after use.
7. Start and finish tasks promptly.
8. Avoid disturbing classmates while working.
9. Be economical in using school supplies.
10. Keep all work areas clean and organized.

RAISING AND LOWERING OF THE FLAG CEREMONY

1. Participate in the flag-raising ceremony.


2. Stand upright and join in singing the National Anthem and reciting the
Pledge of Allegiance.
3. Sing the National Anthem and recite the Pledge with clarity and emotion.
4. Observe the flag solemnly while it is being raised or lowered.
5. Move to classrooms quietly and orderly after the flag ceremony.
6. Arrive on time if assigned to lead or supervise the flag-raising and lowering
ceremony.

BEHAVIOR IN SCHOOL, CORRIDORS, AND STAIRWAYS

1. Be alert to bell signals.


2. Use trash bins properly for waste disposal.
3. Engage in beneficial games.
4. Avoid smoking.
5. Refrain from any form of gambling.
6. Refrain from using indecent or vulgar language.
7. Exercise self-control in not damaging plants, trees, climbing fences, or
gates.
8. Maintain silence and order when entering and exiting classrooms.
9. Always keep to the right side when walking in corridors and going up or

down stairs.
10. Seek permission from teachers before leaving the classroom.
11. Wear the "Hall ID Pass" when going to the restroom, canteen, or any
other place in the school.
12. Avoid loitering in corridors; go home promptly after class.
13. Avoid stopping on the sides and near classrooms that are in session.
14. Any student caught wandering during class hours will be taken to
the Guidance Office, and parents will be notified.

USE OF SCHOOL RESTROOM FACILITIES

1. Maintain cleanliness of seats, wash hands, walls, and floor in the restroom.
2. Flush the toilet after use.
3. Avoid causing clogs in toilets.
4. Wash hands after using the restroom.
5. Avoid eating, playing, and studying inside the restroom.

IN THE CANTEEN

1. Patronize the products/items in the school canteen.


2. Return cups, glasses, spoons, and other utensils after use.
3. Keep the canteen clean.

CARE FOR SCHOOL PROPERTY

1. Cover books; avoid tearing or writing on any page.


2. Keep walls, fences, and school gates clean.
3. Keep chairs and desks clean; avoid writing on them.
4. Close faucets tightly after use.
5. Take care of plants and flowers in the school garden.
6. Clean tools and equipment; return them to their proper places after use.
7. Use play equipment properly.

CONDUCT IN ASSEMBLIES AND MEETINGS

1. Arrive at the designated place on time.


2. Wait quietly for the start of the assembly.
3. Remain silent while someone is delivering a speech.
4. Applaud appropriately to show appreciation for the concluded event or

5. Sit properly to allow those behind to view the program.
6. Avoid whistling, stomping feet, or engaging in inappropriate actions.

GENERAL RULES OF BEHAVIOR IN SCHOOL

1. Wear clean and appropriate school uniforms, and wear your ID properly.
2. Greet teachers and other school personnel politely.
3. Be cheerful.
4. Respect all school personnel.
5. Avoid joining illegal organizations.
6. Avoid posting illegal posters and writing or defacing school walls.
7. Avoid undesirable activities such as extortion, bribery, or theft.
8. Be a good example or role model in the community.

CHILD PROTECTION POLICY

Bully-Free Worry-Free School

In accordance with the Department of Education's policy, this policy ensures


the protection of children against any form of abuse, discrimination, exploitation,
violence, and intimidation.

SCHOOL ANTI-BULLYING POLICY

According to the law, bullying refers to any form of harassment done by one or a
group to another—whether physical, verbal, or instilling fear to prevent a
pupil from entering school. This also includes cyber-bullying, or bullying
through social media and the internet.

THINGS NOT TO DO:

1. Threatening or intimidating fellow pupils, their dignity, or their property or any


family member.
2. Constantly observing or following someone with malicious intent.
3. Theft or destruction of someone else's property.
4. Using words that hurt others' feelings.
5. Spreading gossip, teasing, insulting, or ridiculing someone, whether they

have a disability or not.


6. Physical harm, including punching, pushing, kicking, slapping, hitting,
pinching, choking, scratching, or any object that may harm others.
7. Engaging in fights and using anything that may cause injury.
8. Joining gangs and fraternities.
9. Controlling the freedom of fellow pupils.
10. Encouraging not to talk or engage with family members.
11. Drawing, displaying, or touching any sensitive part of someone's body.
12. Cyber-bullying or bullying using modern technology or any electronic
device through the internet.
13. Seeking revenge on someone who reported or testified about any
bullying incident.

APPROPRIATE PENALTIES:

First Offense

1. The Child Protection Committee will summon the parent or guardian


to discuss the bullying incident.
2. A written agreement will be made regarding any resolution.

Second Offense

1. No issuance of Good Moral Character certificate.


2. Suspension not exceeding one week.
3. The bullying pupil, along with the parent or guardian, will attend
counseling sessions set by the school.

Reminder: If bullying results in "serious physical injury" or death,

Immediately report the incident to the offices of:

1. Schools Division Superintendent


2. Local Social Welfare and Development
3. Suspension not exceeding three weeks
4. Expulsion from the school.

PUPILS' CODE OF CONDUCT

DUTIES AND RESPONSIBILITIES OF PUPILS:

1. Obey and respect the school rules.


2. Take care of and protect school property.
3. Maintain peace and order within the school premises.
4. Do not bring items inside the school that can cause harm, such
as sharp objects, intoxicating drinks, prohibited drugs, cigarettes,
and explicit reading materials.
5. Show respect to each pupil, teachers, parents or guardians, and
school employees.
6. Arrive on time every day.

PUPIL DISCIPLINE IN HANDLING BULLYING

1. Upon complaint, the child and the parents/guardians shall be informed in


writing;
2. The child shall be given the opportunity to answer the complaint in writing,
with the assistance of the parents/guardians;
3. If necessary, the school head shall call for a conference between the parties;
4. The decision of the school head shall be in writing, stating the facts and the
reasons. The penalty of suspension for one (1) week may be imposed by the
school head, if such is warranted.
5. The decision of the school head may be appealed to the schools division
superintendent.
6. If the penalty is suspension for more than one (1) week, the same shall be
subject to the approval of the schools division superintendent.
7. During the period of suspension, the offending child parents/guardians may
be required to attend further seminars and counselling.
8. The school head shall ensure that appropriate intervention or counselling and
other services are provided to the victims of bullying.

For second offense, suspension, exclusion or expulsion


For serious offenses, only the secretary of education has the authority to impose
the penalty of exclusion from the school.
