Subject: Contract Item Quantities Unresolved Issues

Dear Sirs.

SUBCONTRACTOR hereby informs CONTRACTOR that project execution is being affected by

several contract issues, not yet resolved.

First issue is related with variations in Bill of Quantities of several contract items. For instance,
contract item 19.2 has a variation of 191%. Contract has 47.65 m 3 of backfill material but,
according to drawings delivered by CONTRACTOR after contract signature, the backfilling
quantity required is 130 m3. Attachment 1 presents more details and additional contract items that,
as of this date, present significant variations.

Second issue is related with contract item missing from the bill of quantities. There are several
contract items missing, which are required to fully execute SUBCONTRACTOR scope of work.
For instance, contract item 15 (Concrete for foundations) only has two sub items, 15.1 (structural
concrete) and 15.2 (poor concrete). In order to fully execute the fabrication and installation of
concrete foundations, which is the complete scope of work required by CONTRACTOR, additional
contract items need to be created. They are excavation (up to 2 meters), reinforcement steel,
formwork and backfill. SUBCONTRACTOR submitted CTC-008 on December 28, requesting
approval for using existing contract items to account for quantities related with concrete
foundation works. However, there is no response yet. SUBCONTRACTOR, in good faith, finished
excavation for 28 foundations, as well as preparing reinforcing steel for 8 foundations, with
formwork. Attachment 1 presents more details.

It is important to state that SUBCONTRACTOR was not given the opportunity to review Bill of
Quantities through the use of issue for construction (IFC) drawings. This is supported on the fact

that last DSO presented by CONTRACTOR was not part of any clarification process.
CONTRACTOR only supplied a list of activity names and their quantities.

Furthermore, in letter N° CETHK-P-JCP-23-0009, submitted January 19, CONTRACTOR

indicated that in the contract there is an article that reads “In case there is a notable variation in
cost and/or a schedule delay due to serious execution slowdown, not caused by
SUBCONTRACTOR, THE CONTRACTOR should reasonably compensate such variation or
schedule delay, after obtaining COMPANY approval”, which means that the mechanism for
recognizing notable variations in the contract is in place.

SUBCONTRACTOR requests that variations presented in Attachment 1 be analyzed and

recognized as increments in existing contract items. Additionally, missing contract items shall be
created and included in SUBCONTRACTOR bill of quantities, in order to execute the complete
scope of civil works.
