In reviewing the investigative report for PSS-110-2020 involving Tpr. Dylan Neill of the Lapeer Post, I believe

Trooper Neill
conducted a traffic stop for a civil violation (seatbelt violation) and made contact with . After some
conversation with , he also produced a driver’s license. While was agitated with being
stopped, and not being fully cooperative, there were no violations beyond those of civil infractions at this time.
Trooper Neill, after further conversation with about his proof of insurance, orders from the
vehicle and then forcibly removed from the vehicle.

Summary of original allegations:

It is alleged that on March 10, 2020, a trooper violated the law and department policy by using excessive force to effect
the arrest of a citizen during a traffic stop.

Summary of key investigative findings:

On March 10, 2020, Tpr. Dylan Neill of the Tri-City Post stopped for failure to wear his seatbelt, a civil
infraction. Video of the incident was captured on Trooper Neill’s in-car video recording system and from a bystander
filming with a cellular phone. Trooper Neill
In-car video of the traffic stop indicates that and Trooper Neill
had a heated discussion about the traffic stop with insisting his seatbelt was on. Trooper Neill asked
for his registration and proof of insurance. Trooper Neill made attempts to verbally de-escalate .
remained argumentative and insisted that Trooper Neill “check his computer” to verify his insurance as he
did not have his proof of insurance with him. Trooper Neill asked to exit his vehicle, and he indicated during
his principal interview Trooper Neill told
to exit his vehicle several times, refused. Eventually, Trooper Neill radioed for additional
officers.

Trooper Neill asked to undo his seatbelt, and he complied. Trooper Neill asked if he had
anything on him that he (Trooper Neill) had to worry about. said, while still seated in the driver’s seat, “You
got my I.D., now what do you want?” Trooper Neill said, in a calm voice, “ said, “You got my I.D.,
what else do you want?” Trooper Neill, in a calm voice, told to get out of the car and said, “Do
I have to?” Trooper Neill said, “Yes.” moved toward Trooper Neill and appeared to be trying to exit his
vehicle, as this was happening said, “Wait, hold it now” (presumably because Trooper Neill had grabbed
ahold of some portion of body). Trooper Neill said, “Stop.” said, “You can’t man handle me.”
A struggle then ensued with still seated in the driver’s seat and facing Trooper Neill, whose upper body was
inside the driver’s door.

The struggle continued inside the vehicle and continued to ask what Trooper Neill wanted and stated he was
getting out of the vehicle. It appeared that Trooper Neill was attempting to pull from the vehicle and
was physically resisting that effort. said what sounded like, “Do you want me out of the god damn
car,” and Trooper Neill said, “Yes!” said, “Well let me out then.” Trooper Neill shouted to to
“Get out of the car,” multiple times and said, “Let me out!”, multiple times. These comments were made as
the physical struggle continued. Trooper Neill said, “You’re going in handcuffs, let’s go, you’re under arrest, get out of
the car.” said, “Under arrest for what?”

Eventually, Trooper Neill forced out of the vehicle and back to the front of his patrol vehicle, where he
continued to struggle with him, attempting to place him in handcuffs. Trooper arrived on scene and assisted
Trooper Neill. The struggle went to the ground on the passenger’s side of the patrol vehicle. Shortly thereafter,
Saginaw Police Department (SPD) Officers and arrived and assisted with placing into
custody.

said Trooper Neill told him, “Well, now I’m going to make things hard for you.” Trooper Neill
then started to pull him out of his van. said he had his seatbelt on, so Trooper Neill could not pull him out
of the vehicle. said he told Trooper Neill to just move out of the way and let him out, but Trooper Neill still
tried to pull him out. said, “And I gets out of the van; he wants to try to throw me on the ground. I don’t
want to get threw on the ground. I’m years old, so I let him walk me back over to the curb.”

said he suffered an injury on his left side, toward the middle. X-rays .

There is no evidence that responding officers were aware of the nature of the traffic stop prior to their on-scene
assistance to Trooper Neill. Trooper admitted to kneeing in the ribs to secure his hands.

During the administrative interview, Trooper Neill

was subsequently charged with resisting and obstructing a police officer by the Saginaw County
Prosecutor’s Office.
