SUBJECT: Final Investigative Report Regarding a Use of Force (Electronic Control
Device) involving Sergeant Jin Park of the Fourth District, IS #21 ~000058,
IAD #21-018, X-ECD-21-025
Agent Eboni Merritt of the Internal Affairs DMsion investigated the Use of Force (ECD)
by Sergeant Jin Park on an unidentified rioter on January 06, 2021.
ln reference to Sergeant Park's ECD deployment, it was found that he acted within the
guidelines established by the provisions of the MPD General Orders.
Accordingly, it is recommended that the Use of Force (ECD) by Sergeant Jin Park
against an unidentified rioter on January 6, 2021, be classified as: Justified, Within
Department Policy.
On January 07, 2021, Agent Lisa Burton of the Internal Affairs Division generated an
internal investigation system tracking number for this incident. In accordance with the
Metropolitan Police Department Commencement of Discipline and Command Staff
Appointment Act of 2014 (as amended), any corrective or adverse action against any
sworn member or civilian employee of the MPD shall be commenced within 90 days, not
including Saturdays, Sunday, or legal holidays, of the date that the investigation system
tracking number was obtained. The 90 th business day in this case is May 19. 2021.

SUBJECT: Final Investigative Report Regarding a Use of Force (Electronic Control

Device) involving Sergeant Jin Park of the Fourth District, IS #21-000058,
!AD #21-018, X-ECD-21-025
CHRONOLOGICAL NARRATIVE
On Wednesday, January 6, 2021, Sergeant Jin Park of the Fourth District was working
the 0730 hours until relieved shift, and assigned to Civil Disturbance Unit (CDU) Platoon
42 (Rapid Response). He and members of CDU 42 were specifically staged along
Constitution Avenue, Northwest, for High Visibility.
Approximately 1400 hours, Sergeant Park along with members of CDU 42 and various
other Metropolitan Police Department (MPD) officers arrived at the United States
Capitol, located on First Street, Southeast, 20004, to assist the United States Capitol
Police (USCP) with establishing a police line in response to riotous crowds, which was
later classified as an "!nsurrection1 ."
The rioters were attempting to breach2 the barricades that were established around the
perimeter of the Capitol, as members of Congress were in joint session to count the
electoral votes related to the 2020 United States Presidential Election.

Sergeant Park and members of CDU 42 were attired in full Rapid Response Riot Gear
and equipped with Body Worn Cameras (BWCs) that were activated. While on the
grounds of the Capitol, Sergeant Park along with CDU 42 officers encountered several
rioters as they proceeded to establish their police line to create a barrier to prevent the
rioters from breaching the Capitol. Ultimately, the rioters were successful in overrunning
the police line and entering the Capitol.
Approximately 1500 hours, Sergeant Park and CDU 42 officers eventually made their
way up to the scaffold area near the upper west terrace of the Capitol and into the
hallway of the Capitol. The rioters followed behind the officers as they made their way
into the building. Once inside of the hallway, the MPD officers established their police
line as they continued to encounter numerous rioters. 3
During this time, the MPD officers were physically assaulted by rioters as they kicked,
punched, and threw projectiles, which included metal pipes, bats and various other
objects, and deployed chemical irritants, to include munitions. As the MPD officers
worked tirelessly to maintain their police line, they continued take projectiles and were
continuously assaulted by the rioters.
Sergeant Park was specifically located on the left side in front of the police line with no
cover or concealment between him and the riotous crowd, when he observed an
unidentified rioter. The unidentified rioter was a white male holding a long black object
in his right hand, facing Sergeant Park. (See Sergeant Park's Third BWC at the time
stamp of 04:30). Sergeant Park extended his right arm out to create distance when the
unidentified rioter struck him in the right arm with the object.
Sergeant Park immediately felt a sharp pain which he described as an electric current.
Sergeant Park identified the object to be a fully functional cattle prod or an extendable
Electronic Control Device (ECD). After Sergeant Park was struck with the object, he
immediately withdrew his ECD from the holster and deployed the C1 cartridge from his
ECO. (See Sergeant Park's Third BWC at the time stamp of 04:30). The discharged
probes did not cause complete Neuro Muscular Incapacitation (NMl) 4 , and the rioter
retreated back behind the hostile and riotous crowd, without being identified.
In response to the actions of the rioters, MPD officers utilized various levels of force.
These uses of force incidents will be investigated separately by the Internal Affairs
Division (IAD) under Incident Summary (IS) Number 21-000049. Central Complaint
Numbers (CCN) 21-002-555 were generated for these incidents. (Attachment #1)
On January 7, 2021, approximately 0140 hours, Lieutenant William Hackerman of the

Fourth District notified Lieutenant Deborah Pearce of the IAD, of the deployment of
Sergeant Park's ECO.
Agent Lisa Burton of the IAD obtained IS Number 21-000058 and prepared the PD 901 b
(Preliminary Report Form), in reference to this use of force incident. (Attachment #2)
Lieutenant Kenneth Taylor of the Fourth District uploaded the digital information from
Sergeant Park's ECO into evidence.com. Sergeant Park's ECO was assigned serial
number X3000572M.
Agent Eboni Merritt of the IAD conducted an audit trail in evidence.com, which
confirmed that Sergeant Park's ECD was armed at 1507 hours, and deployed at 1508
hours. (Attachment #3)

DESCRIPTION OF SCENE
The chaotic scene initially began on the exterior grounds of the U.S. Capitol Complex
and escalated to the upper west terrace interior hallway entrance of the U.S. Capitol
Building, which is a Federal Government Complex located on First Street, Southeast,
20004. The temperature was 40° Fahrenheit, and the skies were cloudy.
POLICE WITNESS STATEMENTS
Lieutenant William Hackerman Fourth District
On February 4, 2021, lieutenant William Hackerman provided an audio-recorded

statement to Agent Rachel Pulliam of the IAD. The following is a summary of
Lieutenant Hackerman's statement: (Attachment #4)
On January 6, 2021, Lieutenant Hackerman was the platoon leader of CDU 42. CDU 42
was working the 0730 hours until relieved tour of duty. CDU 42 was staged in the 1100
thru 1400 blocks of Constitution Avenue, Northwest, as a Rapid Response Platoon, and
equipped with personal protective riot gear. lieutenant Hackerman monitored the radio

traffic concerning the events taking place at the Capitol Building.
lieutenant Hackerman directed his platoon to don their personal protective riot gear,
after which they responded to the west front of the Capitol to assist with the 10-33.
As CDU 42 members attempted to push through the rioters to make their way to the
upper terrace area, they became surrounded and were pelted with projectiles. CDU 42
was then engulfed in the crowd. lieutenant Hackerman reported that it was so tight
inside the crowd that it was hard for him to breathe. He stated that CDU 42 was finally
able to break through the crowd and made their way to the upper terrace.
lieutenant Hackerman reported that he was sprayed with bear spray and physically
assaulted with punches during the push to the upper terrace. He said that CDU 42 and
other members formed a line across the lower west terrace. During this time, the
officers were pelted with objects which included fire extinguishers and metal poles.
Additionally, CS gas5 was deployed at some point, which affected some of the CDU 42
members. He also explained that CDU 42 and the other MPD units became surrounded
by the crowd; whereas, the ends of the CDU line had begun to fail.
lieutenant Hackerman stated that CDU 42 and the other law enforcement members fell
back towards the upper terrace. After which, CDU 42 and other MPD members were
able to re-establish their CDU line on the upper west terrace. lieutenant Hackerman
and the other MPD units held their line as rioters were cleared out from the Rotunda of
the Capitol.
lieutenant Hackerman relocated to what he described as the "Hallway of Doom" under

the west terrace of the Capitol. While inside of the tunnel, rioters assaulted MPD
officers with metal poles, shields, and fireworks. lieutenant Hackerman described the
interactions inside the tunnel as hand-to-hand combat; whereas, the rioters assaulted
officers with punches and kicks. He also stated that Sergeant Park was struck with a
"cattle prod."
Lieutenant Hackerman believed that deadly force would have been an appropriate force
response in the tunnel. Lieutenant Hackerman reported that one rioter was armed with
a long pole that had a knife attached to the end of it He stated that outside agencies
arrived inside the tunnel and assisted them with pushing the rioters out of the tunnel.
He also said that hand thrown munitions were deployed inside of the tunnel in an
attempt to push the rioters out.

easily evaporates) and 2-chlorobenzalmalononitrile, which is a solid compound at room temperature. CS
gas is generally accepted as being non-lethal. It is a crowd control munition.

INVOLVED MEMBER'S STATEMENTS
Sergeant Jin Park Fourth District
On March 21, 2021, Sergeant Park completed a Force Incident Report (FIR).
(Attachment #5)
The following is the verbatim statement that was provided in Sergeant Park's FIR:
"On January 6th, 2021, J responded to 100 First Street Southeast at the U.S. Capitol
building in reference to an active riotous crowd attempting to breach the Capitol
grounds. I was in full rapid response riot gear operating as a member of CDU Platoon
42 with cal/sign CDU 4230 with my BWC activated.
I was located at the main West entrance doorway of the U.S. Capitol Building facing
multiple hostile rioters attempting to breach through our line to gain entrance into the
premises. I observed a multitude of assaultive subjects that were kicking, punching,
and attempting to forcefully break their way into our established line while various
projectiles and chemicals were being deployed directly at us. Several of the subjects
were armed with metal pipes, bats, and various other objects and were violently
attacking the front line. I was toward the left side of the front line when I observed an
unidentified subject that was holding a long black object in his hand facing my direction.
I had no officer in front of me and there was open space in between me and the subject
with no viable cover. When I extended my arm while trying to create space, the subject
struck my right arm with the object and I immediately felt sharp pain caused by an
electric current. I identified the weapon to be either a fully functional cattle prod or an
extendable electronic control device. After being struck, I immediately drew my issued
ECD and deployed one single cartridge at the center mass of the target to prevent him
from striking me again or another officer next to me with the device. I observed the
subject being struck with the probes and he went back behind the crowd of assaultive
rioters and I do not recall encountering the subject again after that point. End of
statement."
On April 6, 2021, Sergeant Jin Park provided an audio-recorded statement to Agent

George Singletary of the IAD. Sergeant Park declined to have union representative
present during his interview with Agent Singletary, regarding his ECO deployment. The
following is a summary of Sergeant Park's statement: (Attachment #6)
Sergeant Park adopted his FIR as his statement; however, Agent Singletary did have
follow up and clarifying questions for Sergeant Park.
Sergeant Park was asked if he had any additional details to add.

Sergeant Park described the crowd size to be in the thousands and that the
environment was aggressive and combative. In fact, he stated that the rioters had
actually gained access to the CDU officers' Oleoresin Capsicum (OC) spray and used it
against them. He noted that this behavior of the rioters continued throughout the
duration while inside of the Capitol.
Sergeant Park noted that the rioters were non-responsive and non-compliant to the
verbal commands that were given for them to stop and to move back. In fact he stated
that there was "zero cooperation" from the rioters.
Sergeant Park stated that with regard to his ECO deployment, he did not give any
verbal commands, the "TASER, TASER, TASER" warning, or an ARC warning, as he
had immediately reacted in response to the rioter's assaultive actions.
Sergeant Park stated that the rioter was approximately five (5) feet away from him when
the rioter struck him with the "cattle prod." He also described the sound of the rioter's
object as an "arc test or buzzing electricity sound." Sergeant Park then felt a shock, to
his right arm, from an electric current.
He estimated the distance between him and the rioter at the time of his ECO
deployment at about four (4) feet. Sergeant Park stated that he believed that his ECO
probes took partial effect, as the rioter retreated back behind the crowd of subjects. He
did note that he did not receive complete NMI. He stated that he knew this because it
did not appear as if the rioter's body locked up
Sergeant Park said that he deployed one cartridge and did not re-energize that
cartridge. He said after they were able to gain control of the scene, he was able to
locate the remains of the C1 cartridge, which were not completely intact.
Sergeant Park stated that he did not believe that there were any lower levels of force
available at the time. In fact, if he had not deployed his ECO when he did towards the
rioter, he believed that the rioter would have utilized the apparent cattle prod against
other officers.
Sergeant Park stated that during this incident, his COU equipment and ASP baton were
lost and later replaced.

This report revealed that Sergeant Park deployed the C1 cartridge of his ECD on
January 6, 2021, at 1508 hours and 01 seconds, rendered his ECO safe at 1508 hours
and 04 seconds. The duration for his deployment was three (3) seconds. The report
also indicated that Sergeant Park completed an Arc Test with his ECO on January 6,
2021, at 0806 hours and 35 seconds.
DIGITAL/ELECTRONIC EVIDENCE
SD1-EVTs Radio Zone
The transmissions of the SOD Events radio zone were obtained from the Office of
Unified Communications (OUC). The recordings were reviewed by Agent Merritt of the
IAD. The recordings are maintained within the IAD's main files. Upon reviewing the
radio transmissions of the SD1-EVTs radio zone, the following is a paraphrased

SOD 1400-1500 Hours
This recording was 35 minutes and 10 seconds long.
00:09- Intel 1 advised that the crowd was tearing up the reviewing stands on the north
side of the stairs;
00:22 - Unidentified Unit advised that they were still taking projectiles and requesting
additional units, as they were surrounded;
00:35 - Cruiser 50 (Inspector Robert Glover? advised that they breached the scaffold,
and are behind the line;
00:57 - CDU 42 unit advised that they are trying to get through; however they were
surrounded on the sides;
01 :29 - Unidentified Unit requesting more assets to shift south of the line, as the line
was thinning out;
02:35 -· Cruiser 50 advised that there was a breach on the south; additional units
requested;
02:44 - Cruiser 50 to Cruiser 5 requesting "blue top, requesting authorization for blue
level munitions, blue level munitions to hold the scaffold;" (CS munitions)
02:58 - CDU 54 Unit advised that they are trying to snatch officers on the south side;
03:07 - Cruiser 50 acknowledged that CS munitions were authorized; from the Capitol;
JOCC radio voiced the time 1405 hours;
04:52 - JOCC radio advised that the Capitol was advising that the east front was
breached as well; however, they have not made it inside;
05:01 - JOCC radio advised that a crowd was going up some stairs on the west side
and north side of the building;
05:47 - JOCC radio advised that subjects are attempting to break a window on the east
front, per USCP;

06:09 - JOCC radio advised that at 1413 hours the U.S. Capitol has been breached on
the east side;
06:20 - Cruiser 5 to Cruiser 8600 (Lieutenant Andrew Horos) advising him to pull
additional resources and send them to the U.S. Capitol to assist Cruiser 50; Cruiser
8600 acknowledged; Cruiser 5 further advised Cruiser 8600 to pull resources from
wherever he needed to;
08:04- Cruiser 50 advised that unless they had additional munitions, they would not be
able to hold the line, and there were multiple injuries and they were taking the north
scaffold on the west front;
08:42 - Cruiser 50 advised that they cannot hold the scaffold up and the subjects have
them flanked;
09: 18 - JOCC radio advised that the subjects breached the Senate door on the east
side of the building; Cruiser 50 requesting guidance from USCP on where to pull back to
10:20 - Cruiser 50 advising DSO of the only option is to break the crowd up from the
rear;
13:02 - Cruiser 50 advised that they were still taking casualties on USCP and MPD side
and that there were multlple injuries; JOCC voiced the time 1425 hours;
13:09 - Cruiser 8601 announced the deployment of an [inaudible]; Cruiser 50 advised

that the authorization of deployment continues and that CS is still authorized to be
deployed; JOCC voiced the time 1425 hours;
15:46 - Cruiser 50 advised that they lost the line and advised for all MPD units to pull
back up to the upper deck ASAP and advised that they were flanked; Cruiser 50 voiced
a 10-33 at the west front of the U.S. Capitol; JOCC radio voiced the time of 1429 hours;
17:41 - Cruiser 50 advised that he needed reinforcement on the upper level of the
inaugural deck
18:53 - Cruiser 50 advised that they were throwing fire extinguishers at them from the
top; he continued to request CDU to assist on the inaugural deck;
19:23 - Cruiser 5 advised any CDU units responding to enter the top terrace;
21 :01 - Cruiser 5 advised that subjects have breached the U.S. Capitol; CDU 23
advised that they were in route;

24:57 - Unit advised that they were trying to break into the West Terrace exit and they
broke a window;
28:09 - Unit advised Cruiser 50 that they were pushing the subjects out and that they
were also near the bleachers; there was about 80% left;
34:43 - CDU 5430 requested additional assistance in the Rotunda with about 200
people;
35:04 - Unit advised that they were enroute from Montgomery County Police (MCPD);
SOD 1500-1600 Hours
00:16 -4313 advised OC Deployment (1500 hours);
00:23 - Cruiser 2330 advised two CDU 23 OC Deployments on the second floor of the
Capitol;
00:33 - Cruiser 8600 (Lieutenant Horos) advised the JOCC to restrict the air and that
every single deployment cannot be tracked at that time; JOCC copied.
Body Worn Camera Review:
The following is a synopsis of the pertinent information that was captured relative to this
incident. The time stamps represent the length of time that has elapsed from the start of
the video, and do not represent actual time. (Attachment #9)
Sergeant Park's BWC captured three (3) videos associated with this use of force
incident.
First BWC Video
This video began on January 6, 2021, at 1404 hours, and was 36 minutes and 41
seconds long.
Sergeant Park and several members of the MPD and USCP were observed on the
outside perimeter of the Capitol Building. This video did not capture the use of force
involving Sergeant Park's ECD deployment. However, it did provide an overview of the
behavior of the rioters as well as the various use of force incidents that occurred prior to
Sergeant Park entering the building and investigated under 1S Numbers 21-000049.

Second BWC Video

Officers of the MPD and USCP were observed inside of the Upper Entry Hallway. It
should be noted the officers appeared to be exhausted and suffering from injuries.
02:00 - MPD officers were observed forming a line and heading towards the entrance.
During this time, MPD officers with riot shields, ASPs, and riot batons were observed in
the front of the line, attempting to prevent the rioters from breaching the entryway. This
scene was observed to be chaotic and volatile.
02:35 - Radio transmissions were heard, with an unidentified officer stating, "Shots
fired." Officers continued to hold the line, and gave loud verbal commands to "Move
back."
Third BWC Video
seconds long, and began with MPD officers continuing to actively engage the rioters.
It appeared that Sergeant Park had now made his way to the front of the line, were the
rioters were observed wearing gas masks, and actively assaulting the officers.
01 :33 -An unidentified rioter was observed partially breaching the line, before being
pushed back.
02:00 - Sergeant Park activated his BWC; MPD officers were observed tirelessly
attempting to hold the police line and prevent the rioters from entering the building; MPD
officers were observed falling to the ground, as the rioters continued to push back
against the MPD officers. Sergeant Park was observed with his ASP baton in his right
hand; Rioters were also observed attired in helmets, tactical vests, gas masks, clothing
apparel with "Trump" and "1776", as well as in possession of "Make America Great
Again" flags.
02:22 - The MPD officers briefly disengaged the rioters as they repeatedly shouted,
"Trader, Trader, Trader." An unidentified white male was observed on the ground, and
wedged behind the inside door, as the rioters stood on the outside of the entryway door.
An unidentified MPD officer appeared to render assistance to the male.
02:58 - Sergeant Park transferred his ASP baton to his left hand; An unidentified white
female attempted to gain access to the subject, as the rioters, chanted, "Join us, Join
us." As the MPD officers attempted to remove the subject from the ground, it appeared
that he was grabbing onto the door to prevent the officers from moving him.

03:33 -An unidentified white male rioter was observed holding an unidentified spray
can in his right hand and pointed the spray can in the direction of the MPD officers.
Sergeant Park appeared to transfer his ASP back to his right hand. A rioter wearing a
red, white, and blue, "Make America Great Again," hooded sweatshirt was observed
with the spray can in his right hand and wearing a gas mask.
04:10 -Another unidentified white male rioter wearing a black coat with red, white, and
black sleeves and dark colored jeans was observed holding a long black object in his
right hand. The object appeared to have a red light illuminated. The rioter extended the
object towards Sergeant Park. Sergeant Park appeared to extend his right arm out
multiple times to push this rioter back, as the rioter was attempting to break the police
line.
An unidentified MPD officer lifted a bearded man off the ground and out of the doorway.
The rioter holding the spray can raised the can again and pointed the spray can in the
direction of the police line.
The subject on the ground continued to resist the MPO members' attempt to move him
from the doorway;
04:30 - The rioter holding the long black object stepped forward and extended the object
out and in the direction of Sergeant Park. Sergeant Park extended his right arm in the
direction of the rioter holding the object. An electronic zapping sound was heard
immediately after Sergeant Park extended his right arm out. After the zapping sound
ended, the rioter stepped back.
Sergeant Park then withdrew his ECO from its holster, powered on his ECO, reached
over a riot shield, pointed and "painted" the rioter that was holding the long black object.
It appeared that the rioter was attempting to step towards Sergeant Park. Sergeant Park
aimed and deployed his ECO towards the rioter that utilized the object that shocked
Sergeant Park's right arm. At the time that Sergeant Park deployed his ECO, it also
appeared that the same rioter waved the object in his hand to bat away the wires from
the ECO cartridge.
After the rioter was tased he disappeared into the crowd.
Sergeant Park and the other MPO officers continued to struggle with holding the line, as
the rioters continued to challenge the pofice line and attempted to force their way
through the doorway.
The remainder of this BWC video did not provide any additional evidentiary value to this
use of force investigation.

DISCREPANCIES AND CLARIFACTIONS
Why was there a delay in notifying the IAD of Sergeant Park's ECO Deployment?
Due to the amount of Use of Force incidents, the nature of the event and radio traffic,
Cruiser 8600 (Lieutenant Horos) voiced to the JOCC radio over the SD1-EVTs8 radio to
restrict the air with deployments, The use of force incidents were reported once the
U.S. Capitol Building was secured hours later and the scene was under control. These
various incidents were investigated under IS Number #21-000049.
What type of object was the subject of force armed with when he shocked
Sergeant Park?
Sergeant Park described the object as a cattle prod, or an expandable ECD. 9
Was Sergeant Park required to give a warning prior to deploying his ECD?
General Order 901.13, Electronic Control Devices Part IV, D, 2, states, "When feasible,
officers shall identify themselves as police officers and issue a verbal warning (i.e.,
"TASER! TASER!") before deploying the ECO or using "drive stun" mode."
• It 1s the investigating agent's belief that the quick response by Sergeant Park in
conjunction with the volume of noise in the area, the verbal warning was not
feasible and would not have had an influence on the rioter's actions.
• In reviewing Sergeant Park's BWC video, the rioter extended the device out several
times before striking Sergeant Park. Without Sergeant Park's quick response, he
may have struck someone else with his expandable ECO/cattle prod, after striking
Sergeant Park.
Therefore, it was not feasible to issue the warning, and is not a policy violation.
Did Sergeant Park 1s ECO probes make contact with the 1.m-identified rioter?
In reviewing Sergeant Park's BWC video from this event, it does not appear that both
probes made contact with the subject or simply did not penetrate through his clothing
and make contact with his skin. It was further apparent by the lack of the desired effect
of the discharged probes that they did not make contact because the subject merely
appeared to "bat" away the probe's wires with the ECO stick that he was in possession
of. (See Sergeant Park's third BWC at the time stamp of 04:30)

Was Sergeant Park required to request medical treatment for the un-identifled
rioter?
General Order 901.13, Electronic Control Devices Part IV, F, 1, states, "Members shall
request medical assistance in accordance with GO-PCA-502.07 (Medical Treatment
and Hospitalization of Prisoners) for all ECO deployments, whether or not there is an
actual, perceived, or alleged injury.
• In reviewing Sergeant Park's BWC video of this event, once the ECO was
discharged, the un-identified rioter fled into the crowd of rioters without making
his identity known. It would have been unreasonable to expect Sergeant Park to
pursue this subject to make a lawful arrest and identify this subject. Furthermore,
even if Sergeant Park was able to apprehend this subject, a request for
immediate medical assistance would not have been feasible due to the violent
atmosphere.
Was Sergeant Park's C1 cartridge, wiring and probes recovered?
Sergeant Park's C1 cartridge was located, photographed, and the photographs were
uploaded into evidence.com. He was not able to locate the wiring and probes after the
incident due to the amount of debris at the scene. Additionally, this was an active and
hostile scene; whereas, Department of Forensic Services (DFS) was not able to
respond to recover these items of evidence.
Did Sergeant Park have a duty and responsibility to recover the C1 cartridge as
evidence?
General Order 901 .13 ( Electronic Control Devices), IV, Part F. 5b, states in part:
"Ensure the probes and cartridges are collected and treated as evidence, and are
turned over to the official who responds to the scene.
General Order 901 .13 (Electronic Control Devices), IV, Part H. 5c, states in part:
"Involved members are prohibited from collecting cartridges, wire leads, probes, and
confetti tags unless exigent circumstances exist (e.g. failure to collect the items would
result in the destruction of evidence).
Based on the hundreds of rioters present and the circumstances surrounding Sergeant
Park's ECD Deployment to include the hostile environment, exigent circumstances
existed; therefore, it was not feasible for the cartridge to be recovered by a higher
ranking official or a member of DFS. As a result, Sergeant Park recovered his own
cartridge. Therefore, there was no violation of policy.

Were there CCNs or IS Numbers obtained regarding Sergeant Park's lost CDU
equipment and ASP Baton? No.
Per Commander Glover, the lost or missing equipment that did not contain serial
numbers were replaced through DSO without paperwork. This has been the protocol as
it relates to CDU incidents.
UNITED STATES ATTORNEY'S OFFICE REVIEW
This investigation was not referred to the United States Attorney's Office (USAO) for
prosecutorial review.
CURRICULUM REVIEW
On February 17, 2021, Agent Merritt submitted a curriculum review request to the MPA.

At the submission of this investigative report, the curriculum review has not been
received by the investigating agent
TACTICAL ANALYSIS
Based on the totality of the circumstances, it is the investigating agent's conclusion that
•
Sergeant Park's actions were in compliance with MP policy.
Under these circumstances and due to the violent, assaultive actions of the un-identified
rioter who assaulted Sergeant Park; Sergeant Park's use of the ECO was the best force
option available at the time due to how fluid and quickly this event occurred. In a
situation like this event, the use of hand controls, defensive strikes, or ASP strikes
would not have been conceivably feasible due to the fact that the use of these tactics
would have required Sergeant Park to move within close proximity of the un-identified
rioter.
Furthermore, by closing the distance in order to employ any of the above listed tactics
would have additionally put him in the middle of numerous rioters who were engaging in
assaultive and violent behavior. This action would have further exposed Sergeant Park
to being physically attacked. Another viable option regarding the un-identified rioters'
assaultive behavior could have been the use of Oleoresin Capsicum spray. However,
Sergeant Park's choice to utilize the ECO was appropriate and reasonable.
Furthermore, although OC spray was utilized on numerous occasions during the events
of January 6, 2021, the intended effects of the OC spray met with negative results and
did not alter the assaultive actions of the rioters.

The primary goal of the ECD is to stop aggressive and potentially lethal behavior from a
distance, by temporarily incapacitating a non-compliant individual.
General Order 901.13, Part IV, D, 1, states: "Members shall only use ECDs when a
subject is at least actively resisting a member's requests or demands and the subject is
engaged in dangerous and assaultive behavior towards themselves, members, or
others."
While Sergeant Park's use of the ECO in response to the un-identified rioter's threat
level was justified and within policy, it did not appear the discharged ECO's probes
made complete contact with the un-identified rioter. Nonetheless, Sergeant Park's
discharged ECD was clearly effective in stopping his assaultive behavior even if the un-
identified rioter was not completely affected by the discharged ECO.
While the ECO is not generally used in CDU settings, and is not a CDU-Force level, due
to the unprecedented and riotous events that occurred this day, the ECO was the best
force option available at the time.
SUMMARY AND CONCLUSION
In order to evaluate the issue of force and determine whether or not the events comport
with the applicable rules and regulations, several issues must be addressed and
analyzed.
Moreover, this type of analysis allows for a review of policies and procedures with the
application of, "hindsight vision," which lends itself as a teaching tool and helps
precluded unsafe or improper practices from occurring in the future.
In reviewing and considering this matter, it is helpful to note the Supreme Court's
decision in Graham v. Conner, 490 U.S. 386 (1989) as it relates to the reasonableness
of force used by police. The Court indicated that:
"The reasonableness of a particular use of force must be judged from the

perspective of a reasonable officer on the scene, rather than with the 20/20 vision
of hindsight. .. The calculus of reasonableness must embody allowance for the
fact that police officers are often forced to make split-second judgments, in
circumstances that are tense, uncertain, and rapidly evolving regarding the
amount of force that is necessary in a particular situation."
With this in mind, the following facts were established during the course of this
investigation:
• On January 6, 2021, Sergeant Park and members of the MPO responded to US

Capitol to assist with rioters that were attempting to breach the building.

• Sergeant Park along with other MPO officers eventually made their way inside of the
Capitol via the upper west terrace entrance and into the hallway. Once inside of the
hallway, officers encountered many rioters and the members were subjected to
physical assaults by the rioters who continuously kicked, punched, threw projectiles,
and sprayed chemical irritants at law enforcement
• Sergeant Park observed an unidentified rioter armed with a long black electronic
device that Sergeant Park described as an expandable ECO. As Sergeant Park
extended his right arm out to create space and distance from the rioter, he struck
Sergeant Park on his right arm with the ECO. Sergeant Park immediately felt an
electric shock in his arm. Sergeant Park then withdrew his ECO and deployed the
ECD directly at the rioter who had assaulted him.
• Sergeant Park believed that the probes took partial effect, as the rioter immediately
retreated into the mass of additional rioters and was never identified.
FINDINGS
In reference to Sergeant Park's ECO deployment, it was found that he acted within the
guidelines established by the provisions of the MPO General Orders. Specifically:
• General Order 901.13, "Electronic Control Devices," Part IV, which states:
"Members shall only use ECDs when a subject is at least actively resisting a
member's requests or demands and the subject is engaged in dangerous and
assaultive behavior toward themselves, members, or others."
Accordingly, it is recommended that the Use of Force (ECO) by Sergeant Jin Park
against an unidentified rioter on January 6, 2021, be classified as: Justified, Within
Department Policy.
MISCELLANEOUS
Before the completion of this final report, the undersigned agent had a preliminary
conference with Lieutenant Pearce. Lieutenant Pearce concurred with the investigating
agent's finding.

Eventually the doorway was breached and the law enforcement officers, to include
Sergeant Park, utilized a tactical retreat. As a result, the subject of force was not
identified. (Attachment 2)
Due to the riotous situation, and immediate threat to law enforcement and government
officials, there was a delay in the report of this use of force. In addition, a canvass for
civilian and sworn witnesses was not completed.
On Thursday, January 8, 2021, lieutenant Kenneth Taylor of the Fourth District
downloaded the digital information from Sergeant Park's ECO, serial number
X3000572M. The report confirmed that Sergeant Park's ECD was armed at 1 507 hours
and deployed at 1508 hours. The unknown target was within three (feet), per the BWC
review. As the prongs dld not take effect, twenty-five (25) feet of coil was expelled
during the deployment of the ECO. The prongs were taken by the intended target who
left the area. It is unknown what happened to the cartridges amidst the struggle.

Statement of lieutenant William Hackerman
lieutenant William Ha.ckerma.n Fourth District CDU 42
On February 4, 2021, Lieutenant William Hackerman provided an audio recorded statement to

Agent Rachel Pulliam of the Internal Affairs Division (!AD). The following is a summary of
Lieutenant Hackerman's statement:
On January 6, 2021 Lieutenant Hackerman and was the platoon leader of CDU 42. CDU 42 was
working the 0730 hours until relieved tour of duty. CDU 42 staged in the 1100-1400 block of
Constitution Avenue, Northwest. CDU 42 was equipped with hard gear and is typically utilized
as a response platoon to riots activity. Lieutenant Hackerman monitored the radio traffic
concerning the events taking place at the Capitol. Lieutenant Hackerman order his platoon to
dawn their hard gear. CDU 42 responded to the west front of the United States Capitol to assist
with the 10-33. As CDU 42 attempted to push through the rioters to make their way to the upper
terrace they were surrounded and pelted with projectiles. CDU 42 became engulfed in the
crowd. Lieutenant Hackerman reported that it was so tight inside the crowd that it was hard
from him to breathe. CDU 42 finally broke through the crowd and made their way to the upper
terrace. Lieutenant Hackerman reported that he was sprayed with bear spray and physically
assaulted with punches during the push to the upper terrace. CDU 42 and other elements
formed a line across the lower west terrace. The officers were pelted with objects to include fire
extinguishers and metal poles. CS gas was deployed at some point which affected some of the
CDU 42 members. CDU 42 and the other MPD units began to be surrounded by the crowd, The
ends of the CDU line began to fail. CDU 42 and the other law enforcement elements fell back
further towards the upper terrace. CDU 42 and other MPD elements re-established their CDU
line on the upper west terrace. Lieutenant Hackerman and the other MPD units· held their line
as rioters were cleared out from the rotunda of the Capitol.
Lieutenant Hackerman relocated to the "Hallway of Doom" under the west terrace of the Capitol.
Inside the tunnel rioters were assaulting MPD officers with metal poles, shields, and fireworks.

Statement of Lieutenant William Hackerman
Lieutenant Hackerman described the interactions inside the tunnel as hand to hand combat.
Rioters assaulted officers with punches and kicks. One MPD sergeant was hit with a cattle
prod. Lieutenant Hackerman believed that deadly force would have been an appropriate force
response in the tunnel. Lieutenant Hackerman reported that one rioter was armed with a long
pole that had a knife attached to the end of it. Outside agencies arrived inside the tunnel and
assisted with pushing rioters out of the tunnel. Hand thrown munitions were deployed inside the
tunnel in an attempt to push the rioters out.

Statement of Sergeant Jin Park
On April 6, 2021, Sergeant Jin Park of the Fourth District provided an audio-recorded statement
to Agent George Singletary of the Internal Affairs Division (!AD), The following is a summary of
Sergeant Park's statement:
Sergeant Park opted to adopt the statement in his Force Incident Report (FIR) as his statement;
however, Agent Singletary did have follow up and clarifying questions for Sergeant Park.
Sergeant Park was asked if he had any additional details to add.
Sergeant Park described the crowd size to be in the thousands that the environment was
aggressive and combative. In fact, he stated that the subjects had actually gain access of the
officers Oleoresin Capsicum (QC) spray and used it against them. He noted that this behavior
of the crowd continued throughout the duration of them inside of the United States (U.S.) Capitol
Building.
Sergeant Park noted that the riotous subjects were non-responsive and non-compliant to the
verbal commands that were given for them to stop and to move back. In fact he stated that there
was "zero cooperation" from the subjects.
Sergeant Park stated that with regard to his Electronic Control Device (ECO) deployment, he did
not give any verbal commands, TASER, TASER, TASER warning, or an ARC warning, as he
had immediately reacted in response to the subject's assaultive actions.
Sergeant Park stated that the subject was approximately five (5) feet away from him when the
subject struck him with the "cattle prod."
He estimated the distance between h!!!Ul.r1d the subject at the time of his ECO deployment at

Sergeant Park stated that he believed that his ECD probes took partial effect, as the subject
retreated back behind the crowd of subjects. He did note that he did not receive complete Neuro
Muscular Incapacitation (NMl) 1 . He stated that he knew this because it did not appear as if the
subject's body locked up. He also described the sound by the subject's object as an "arc test or
buzzing electricity sound."
Sergeant Park said that he deployed one cartridge and did not re-energize that cartridge. He
said after they were able to gain control of the scene, he was only able to locate the remains of
the C1 cartridge, which was not completely intact.
Sergeant Park stated that he did not believe that there were any lower levels of force available
at the time. In fact, if he had not deployed his ECD when he did towards the subject, he
believed that the subject would have utilized the object against other officers.
Sergeant Park stated that during this incident, his Civil Disturbance Unit (CDU) equipment and
Armament Systems and Procedures (ASP) baton was lost and later replaced.

from the Office of Unified Communications (OUC}. The recordings were reviewed by Agent
Eboni Merritt of the Internal Affairs Division (IAD). The recordings are maintained within the
IAD's main files. Upon reviewing the radio transmissions of the SD1-EVTs radio zone, the
following is a paraphrased summarization of the transmissions that may be relevant to this

The following is a synopsis of the pertinent information that was captured relative to this
incident. The time stamps represent the length of time that has elapsed from the start of the
video, and do not represent actual time.
Sergeant Jin Park fourth District
Sergeant Park's BWC captured two (3) videos associated with this use of force incident.
First BWC Video
This video began on January 6, 2021, at 1404 hours, and was 36 minutes and 41 seconds long.
Sergeant Park and several members of the Metropolitan Police Department (MPD) and United
States Capito! Police (USCP) were observed on the outside perimeter of the United States
Capitol Building. This video did not capture the use of force involving Sergeant Park's ECO
deployment. However, it did provide an overview of the behavior of the crowd prior to Sergeant
Park entering the building and investigated under Incident Summary (lS) Numbers 21-000049.
Second BWC Video
This video began on January 6, 2021, at 1442 hours, and was 04 minutes and 14 seconds long.
Officers of the MPD and USCP personnel were observed inside of the Upper Entry Hallway. lt
should be noted that that these officers were observed to have been exhausted and appearing
that some officers had suffered injuries as well.

batons were observed in the front of the line, attempting to prevent the riotous subjects from
breaching the entryway. This scene appeared to be chaotic and volatile.
02:35 - Radio transmissions was heard, with an unidentified person stating, "Shots fired."
Officers continued to hold the line, and give loud verbal commands to "Move back."
Third BWC Video
This video began on January 6, 2021, at 1505 hours, and was 23 minutes and 4 7 seconds long,
and began with MPD officers continuing to struggle and with the riotous subjects. It appeared
that Sergeant Park had now made his way to the front of the line, were the subjects were
observed with gas masks donned, ln addition to displaying active resistance and assaultive
behavior towards the officers.
01 :33 - An unidentified subject was observed partially breaching the line, before being
pushed back .
02:00 - Sergeant Park activated his BWC; MPD officers were observed tirelessly attempting to
hold the police line and prevent the riotous subjects from entering the building; MPD officers
were observed falling to the ground, as the subjects continued to push back against the MPD
officers; Sergeant Park was observed with his Armament Systems and Procedures (ASP) baton
in his right hand; Subjects were also observed attired in helmets, tactical vests, gas masks, and
"Trump" and "1776" apparel, as well as in possession of "Make America Great Again" flags.
02:22 - The MPD officers briefly disengaged the crowd, as the subjects repeatedly shouted,
"Trader, Trader, Trader." An unidentified white male was observed on the ground, and wedged
behind the inside door, as the riotous subjects stood on the outside of the entryway door. An
unidentlfied MPD officer appeared to render assistance to the male.
02:58 - Sergeant Park transferred his ASP baton to hls left hand; An unidentified white female
attempted to gain access to the subject, as the rioters, chanted, "Join us, Join us." As the MPD
officers attempted to remove the subject from the ground, it appeared that he was grabbing onto
the door to prevent the officers from moving him.
03:33 - An unidentified white male was observed holding an unidentified spray can in his right
hand and pointed in the direction of the MPD officers; Sergeant Park appeared to transfer his
ASP back to his right hand; A subject wearing a red, white and blue "Make America Great Again
hooded sweatshirt was observed with the spray can in his right hand and wearing a gas mask.

dark colored jeans was observed holding a long black object in his right hand. The object
appeared to have a red light illuminated; The subject extended the object towards Sergeant
Park; Sergeant Park appeared to extend his right arm out multiple times to push an unidentified
subject wearing a gray coat back, that continued to move towards the police line, as an
unidentified MPO officer lifts the bearded man off the ground in an attempt to remove the man
from inside the doorway; The subject holding the spray can raised the can again and pointed in
the direction of the police line; The subject on the ground continued to resist the MPD members'
attempt to move him from the doorway;
04:30 - The subject holding the long black object stepped forward and extended the object out
and in the direction of Sergeant Park. Sergeant Park extended his right arm in the direction of
the subject holding the object; A zapping sound was heard immediately after Sergeant Park
extended his right arm out After the zapping sound ended, the subject stepped back; Sergeant
Park drew his ECO from its holster, powered on his ECO, reached over a riot shield that was
observed, and pointed and "painted" the subject that was holding the long black object. It
appeared that the subject was attempting to step back towards Sergeant Park.
04:35 - Sergeant Park aimed and deployed his ECO toward the subject wearing the jacket that
utilized the object that shocked Sergeant Park's right arm. At the time that Sergeant Park
deployed his ECO, it also appeared that the same subject waved the object in hls hand to bat
away the wires from the ECD cartridge.
Sergeant Park and the other MPD officers continued to struggle with holding the line, and the
riotous subjects continued to challenge the police line and attempted to force their way through
the doorway, as the MPD officers held the line.
The remainder of this BWC video did not provide any additional evidentiary value to this use of
force investigation.
