AFFIDAVIT

I, GORGONIO GOMEZ MORALES, of legal age, married, Filipino with

address at Brgy. Cabugao, Bacuag, Surigao Del Norte after having been sworn in
accordance with the law hereby depose and state that:

1. That I am the owner of GORGON NIPA WINE MANUFACTURING, a sole

proprietorship duly organized and existing under the laws of the Philippines,
engaged in the business of wine manufacturing;
2. That one of my products is GORGON VODKA EST MMVIII NIPA PALM
SPIRIT;
3. That last January 26, 2023, I received a copy of Registrability report from the
Intellectual Property Office of the Philippines that contains the findings of the
Examiner concerning registrability of my mark;
4. It has been observed by the said office that my mark resembles a registered
mark, identical to a mark belonging to GORDON S.R.L, a different proprietor
and it may consist matter that may damage the reputation or falsely suggest a
connection with the said holder;
5. The mark GORGON VODKA EST MMVIII NIPA PALM SPIRIT is not in any
way connected or related to GORDON S.R.L;
6. The term GORGON is from my first name GORGONIO and it is an original
creation and I did not copy it from any other holder’s name;
7. The mark is being filed in good faith and without any malicious intent to
deceive or cause confusion;
8. Also, I do not claim exclusive right over the terms “VODKA” , “EST MMVIII”,
“NIPA PALM and its representation”, “SPIRIT”, “40% ALC./VOL (80 PROOF)”
and “375 ML”;
9. I am executing this undertaking to attest to the truth of the foregoing facts and
to whatever legal purpose it may serve.
