(1) Advokátska kancelária (AK), ktorá zastupuje nášho klienta, poskytuje komplexné právne
poradenstvo pre tuzemských aj zahraničných klientov. Vďaka skúsenému tímu advokátov ponúka
služby v cudzích jazykoch. Na AK sa možno obrátiť pri obhajobe v trestnom konaní a vo veciach
občianskeho a obchodného práva, pracovného práva, práva hospodárskej súťaže a práva duševného
vlastníctva.

Klientmi AK sú právnické osoby (obchodné spoločnosti, občianske združenia a odborové organizácie)


ako aj fyzické osoby. AK príležitostne poskytuje aj pro bono poradenstvo.

Tím AK pozostáva z právnych poradcov, advokátov, koncipientov a personálu iného ako právneho
zamerania. AK poskytuje riešenia šité na mieru. Pri fakturácii kladie dôraz na transparentnosť a
možnosť kontroly zo strany klienta.

(2) Partner AK je členom Slovenkej advokátskej komory. Špecializuje sa na oblasť fúzií a akvizícií a
tiež právny audit a previerky. Pôsobil aj v popredných medzinárodných advokátskych kanceláriách so
zameraním na medzinárodné rozhodcovské konania. V minulosti pracoval ako vyšší súdny úradník na
Okresnom súde v Bratislave (terajší mestský súd) so zameraním na konkurzné konania.

V oblasti zmluvného práva sa zameriava na zmluvy o dielo, dodávateľské zmluvy, zmluvy o


uzatvorení budúcich zmlúv, spotrebiteľské zmluvy a nájomné zmluvy.

Ako autor prispieva do časopisu Justičná Revue a pravidelne prednáša na tému Ochrana osobných
údajov v zmysle nariadenia EU.

Areas - Marriage, Divorce

(1) Particulars of the divorce proceedings are governed by the respective law. Divorce occurs when the
court legally ends your marriage. You are not considered divorced in the eyes of the law until a judge
signs a divorce decree.

In addition to ending your marriage, most divorces decide how your marital property is divided,
whether alimony or spousal support is owed and how custody of your children is shared.

The specific steps of the divorce vary by state, so it is important to learn the rules for where you live.
In most states, however, you will need to complete similar steps of divorce before your marriage can
be dissolved.

There are also different types of divorce, including fault and no-fault divorces and contested and
uncontested divorces. You and your spouse will need to consider what is right for you, as well as for
any children who are involved.

(2) Marriage of American US citizens in Slovakia must be contracted before the Slovak authorities in
accordance with the Slovak law. The American Consul is not authorized to perform wedding
ceremonies. An American citizen must establish to the satisfaction of the Slovak authorities that he/she
is free to marry under the laws of the State of his residence in the United States. Slovak authorities
generally accept a Marriage Affidavit signed in the presence of a U.S. Consul as evidence in this
regard.

Both partners must also be present at the register office when applying for the marriage certificate.
Marriage by proxy or through third parties is not allowed in Slovakia except under dire circumstances.
After obtaining the marriage certificate, the couple must schedule a date for the civil ceremony, which
is typically held at the register office. During the ceremony, the couple declares their intention to
contract marriage before an officer/registrar. The partners will then be provided with a government-
issued marriage certificate.

Areas - Criminal law:

(1) Enviropolícia obvinila muža, ktorý zastrelil ešte počas letných prázdnin na ulici psa. Údajne na
obvineného štekal bez toho, aby na neho zaútočil. Páchateľ mal legálne držanú zbraň. Vyšetrovateľ už
vzniesol obvinenie voči 54-ročnému mužovi z tejto obce za prečin usmrtenia spoločenského zvieraťa
bez primeraného dôvodu. Páchateľ spôsobil psovi poranenie, na následky ktorého pes neskôr uhynul.
V prípade dokázania viny páchateľovi hrozí trest odňatia slobody až do výšky päť rokov.

„Polícia upozorňuje občanov, že akékoľvek bezdôvodné konanie smerujúce k zraneniu alebo


usmrteniu zvieraťa je protiprávnym konaním v zmysle zákona o veterinárnej starostlivosti."

(2) Na Špecializovanom trestnom súde (ŠTS) v Pezinku sa začalo hlavné pojednávanie s


podnikateľom. Obžalobe podanej pre trestný čin podplácania čelí aj bývalý sudca. Obžalovaní a ani
prokurátor nemajú záujem na uzavretí dohody o vine a treste.

Všetci obžalovaní vyhlásili, že sú nevinní. Ich obhajcovia argumentovali tým, že obvinenia sú


postavené len sa výpovedi nepriameho svedka. Vypovedať chcú až po výsluchu tohto svedka. Svedok
podľa nich v minulosti menil výpovede i v spolupráci s vyšetrovateľmi. Sudca prerušil hlavné
pojednávanie do 12. marca. Predvolaní budú ďalší svedkovia.

Hlavné pojednávanie bolo ešte v minulom roku odročené z dôvodu práceneschopnosti a ospravedlnení
jedného obžalovaného a dvoch obhajcov.

Areas - Politics:

(1) In letters sent to Slovakia, the European Commission warns the Fico cabinet that the approved
amendments to the Penal Code will impact EU law and the Union’s financial interests.

The coalition MPs approved amendments last Thursday, February 8. On this day, the EC also sent its
last letter to the government.

As it’s already known, the government ignored a warning that concerned the way of adoption of the
amendments. The coalition used the fast-track procedure, thus excluding a debate on the changes with
experts. But Brussels also refers to the directive on combating fraud, writes the Sme daily. The
Commission also warns that the reform will significantly reduce the ability of the European Public
Prosecutor’s Office to investigate crimes damaging the EU’s financial interests.

The Commission plans to prepare a deeper analysis of the new Penal Code if it comes into force in
March. It added that it is ready to defend the EU’s interests and take action against Slovakia.

(2) The ruling coalition passed its widely criticized changes to Slovakia’s prosecution and penal
systems. MPs started voting on the bill’s second reading before noon and it took them until the
evening to work through all the votes on the partial changes that observers believe have just one aim:
to shelter coalition politicians potential future prosecution or from any meaningful punishment.

Politicians of the ruling Smer and Hlas parties have described the changes as a turn towards
“restorative justice”, including the statutes of limitations put forward by Smer MP Tibor Gašpar. He
served as president of the Police Corps under previous Smer governments before being forced to step
down following the murders of Ján Kuciak and Martina Kušnírová, when evidence emerged to suggest
that he had been abusing his powers. He was later arrested and held on charges of organised crime in
the Purgatory (Ocistec) case, before being released.

The case against him continues and he is currently awaiting trial. If he is found guilty, Gašpar will face
a very different (and less onerous) punishment once the changes he himself proposed to parliament,
and that were passed on Thursday, come into effect.
