0043), Daughter of Mr.Mohan.T.M, aged about 44 years, both are residing at
No.560 B TYPE, T N H B, Perumalpattu, Thiruvallur, Tamilnadu - 602 O24,
hereinafter referred to as the "PURCHASER" (which expression shall unless
repugnant to the context or meaning thereof be deemed to mean and include
his/her legal heirs, executors, administrators, successors-in-interest and
permitted assignees);

WITNESSETH THAT;
WHEREAS the lands comprised in Survey No.362 /4 of an extent Acre 1.17
Cents and Survey No.362 /3 of an extent of Acre 3.88 Cents out of an extent
of Acre 4.88 Cents was originally belonged to l.Mr.Chockalingam Mudaliar
2.Mr.Munuswamy Mudaliar, 3.Mr.Vinayagar Mudaliar, 4.Mr.Rajabathar
Mudaliar, in favour of l.Mr.V.Ellappan, 2.Mr.V.Babu and 3.Mr.V.Vadivelu,
sons of Mr.Vaithi by virtue of Registered Deed of Sale dated 22.1L.L967
registered as Document No.2944 of 1967 in the office of the Sub-Registrar
Poonamallee.

Thereafter for the remaining balance property bearing Survey No.362/3, of


an extent of Acre 1.00 Cents out of an extent of Acre 4.88 Cents was also
purchased by Mr.V. Muthukrishnan and Mr.V.Ekambaram sons of
Mr.Vaithi, through Registered Deed of Sale dated 22.ll.1967 registered as
Document No.2945 of 1967, in the offrce of the Sub-Registrar Poonamallee
from same above land owners l.Mr.Chockalingam Mudaliar
2.Mr.Munuswamy Mudaliar, 3.Mr.Vinayagar Mudaliar, 4.Mr.Rajabathar
Mudaliar.

Thus the said 1.Mr.V.Ellappan, 2.Mr.V.Babu and 3.Mr.V.Vadlvelu, 4.


Mr.V.Muthukrishnan and 5. Mr.V. Ekambaram is the absolute owners of

the property measuring an extent of Acre 4.88 Cents in Survey No.362/3&


extent Acre l.l7 Cents 362/4.

The recital in the said Sale Deed further reveals that the said property
Survey No.362 /4 of an extent Acre 1.17 Cents was comprised in Patta
No.54O standing in the name of Mr.Munusamy Mudaliar. The recital in the
said Sale Deed reveals that the said property Survey No.362/3 of an extent
of Acre 4.88 Cents was comprised in Patta No.42O standing in the name of
Mr. Chockalingam Mudaliar.
The property bearing survey No.361 /4 of an extent Acre 0.86 cents out ofan
extent of, Acre 1.36 cents was originally belonged to Mr.K.Munusamy
Naicker and his son's LM.Parthasarathy 2.M.Loganathan. The said
Mr.K.Munusamy Naicker executed the said property to 1.Mr.V.Vadivelu,
2.Mr.V.Muthukrishnan sons of Mr.vaithi by virtue of Registered Deed of sale
dated 07.11.1976, Registered as Document No.1320 of 1976, in the office of
the sub-Registrar Poonamallee. The recital in the said sale deed reveals that
Mr.Vaithi and Mr.V.Ellappan already owned the Western part of land in
S.No.361/4 (0.49 cent).

The Printed Village "A" Register Extract in respect of the said properties
bearing l.survey No.362/4, of an extent of 0.47.5 Ares (equal to Acre 7.77
cents) and 2.survey No. 362/3 of an extent of 1.97.5 Ares (equal to Acre
4.88 Cents) and 3.survey No.361/4 of an extent of 0.55.0 Ares (equal to Acre
1.35 cents) was comprised in patta No.729, standing in tJ.e names of
l.Mr.V.Vadivelu 2. Mr.V. Muthukrishnan 3.Mr.Vaithi 4.Mr.V.Ellappan and
others in respect of the properties measuring an extent of Acre 7.40 Cents.

The Printed village "A" Register Extract in respect of the said properties
bearing in survey No.36212, of an extent of 0.26.5 Ares (equal to Acre 0.64
cents) was comprised in Patta No.729, standing in the names of
Mr.V.Ellappan and three otl:ers.

The Printed Village "A" Register Extract in respect of the said properties
bearing in survey No.357, of an extent of 0.58.5 Ares (equal to Acre 1.45

/2, of an extent of 0.09.0 Ares (equal to Acre
0.22 cents) was comprised in patta No.40, standing in the name of
Mr.V.Ekambaram. Thus the Patta in respect of the said properties
measurlng an extent of Hectare 3.94.0 Ares or Acre 9.74 cents (as per
document Acre 9.71 cents) standing in the names of Mr.Vaithi
and his sons.

The said Mr.Vaithi Died on 2g.og.rgg2, and the same is evidenced


by the
l,ega1 Heirship Certificate No.pA.MU.ASI10484/95, dated 1O.11.1995,
issued by the Thasildar, Sriperumpudur Taluk.The said Mr.Vaithi
during his
lifetime executed a registered will dated 04
/07 / rggl registered as document
No.73 of 1991, SRO Poonamallee. The said registered Will reveals
that
Mr.Vaidhi had Five sons and Three Daughters l.Mr.V.Ellappan,
2.Mr.V.Babu, 3.Mr.V.Vadivelu, 4.Mr.V.Muthukrishnan, S.Mr.V.Ekambaram,
6.Mrs.Vasantha, T.Mrs.Meena and g.Mrs.Gowri. The recitals in the
said will
reveal that the properties were bequeathed in favour of the sons
a-lone.As
already stated above the said properties purchased in the names
of
1'Mr.v.Ellappan, 2.Mr.v. Babu. 3.Mr. v.vadivelu, 4.Mr.v. Muthukrishnan,
5.Mr.V.Ekambaram, sons of Mr.Vaithi. After the demise of Mr.Vaithi,
his
sons 1.Mr.V.Ellappan, 2.Mr.V.Babu, 3. Mr.V.vadivelu,
4.Mr.V.Muthukrishnan, 5.Mr.V.Ekambaram, entered into a Registered
Partition Deed dated 22.o2.1999, Registered as Document No.1633
of 1999,
SRO Poonamallee. As per the said partition Deed the properties
are divided
as per particulars mentioned below.

A - Schedule Property of pardtlon deed:

An extent of Acre 0.93 cents in survey No.362/3, and an extent


of Acre 1.00
cents in survey No.362 14, in all measuring: Acre 1.93 cents was
allotted in
favour of Mr.V.Ellappan. The patta in respect of the said property

granted in the name of Mr.V.Ellappan bearing patta
No.362, as per patta
Property subdivided as survey Nos.362l3c, Extent: 0.39.5 Ares

B - Schedule Property of Partltlon deed:

An extent of Acre 1.09 Cents in Survey No.361/4, and an extent of


Acre 0.84 Cents in survey No.36213, in all measuring: Acre 1.93 cents
in favour of Mr.V.Babu. The Patta in respect of the said
was allotted
property was also granted in the name of Mr.V.Babu bearing Patta
No.359, as per Patta Property subdivided as survey Nos.361/4c,
Extent: 0.36.5 Ares (about 90 Cents) and Survey No.362/3D, Extent:
0.40.0 Ares (about 99 Cents).

C - Schedule Property of Partltlon deed:


An extent of Acre 0.64 cents in Survey No.362/2, an extent of Acre
l.12 cents in survey No.362/3, and an extent of Acre 0.17 Cents in
survey No.362 /4, in all measuring : Acre 1.93 Cents was allotted in
favour of Mr.V.Vadivelu. The Patta in respect of the said property was
also granted in the name of Mr.V.Vadivelu bearing Patta No.361, as
per Patta property subdivided as survey Nos.362/2, Extent : 0.26.5
Ares (about 65 Cents); survey No.362/3B, Extent: 0.40.5 Ares (about
Acre 1.00 cents) and Survey No.362/4A, Extent : 0.08.5 Ares (about
Acre 0.2 1 Cents).

D - Schedule Property of Partltlon deed:


An extent of Acre 1.93 Cents in Survey No.362/3, was allotted in favour of
Mr.V.Muthukrishnan. The Patta in respect of the said property was also
granted in the name of Mr.V. Muthukrishnan bearing Patta No.360, as per
Patta property subdivided as survey No.362/3A, Extent : Hectare 0.76.5
Ares (about Acre 1.89 Cents).

E-schedule Schedule Property of Partltlon deed:

An extent of Acre 1.45 Cents in Survey No.357, arr extent of Acre


0.22 cents in survey No.361/2, and an extent of Acre 0.26 Cents in survey
No.361/4, in all measuring Are 1.93 Cents was allotted in favour of
Mr.V.Ekambaram. The Patta in respect of the said property was also granted
in the name of Mr.V.Ekambaram bearing Patta No.20, as per patta property
subdivided as survey Nos.357, Extent : 0.58.5 Ares (about Acre 1.44 Cents);

Survey No.361 /2, Exterrt: 0.09.0 Ares (about Acre O.22 Cents) and Survey
No.361/4A, Extent : 0.10.0 Ares (about Acre 0.25 Cents).

F- Schedule Property of Partltlon deed:


An extent of Acre 0.02 Cents in Survey No.362/2, an extent of Acre
0.06 cents in survey No.362/3. and an extent of Acre 0.01 cents in survey
No.361/4, in all measuring Are 0.09 cents was allotted in favour of
l.Mr.V.Ellappan 2.Mr.V.Babu 3.Mr.V.Vadivelu 4.Mr.V.Muthukrishnan and
5. Mr.V. Ekambaram jointly.

The Patta in respect of the said property was also granted in the
names of
1.Mr.V.Ellappan,2.Mr.V.Babu,3.Mr.V.vadivelu,4.Mr.V.Muthukrishnan,5.V.E
kambaram, sons of Mr.Vaithi bearing Patta No.321, as per Patta property
subdivided as survey Nos.361/48, Extent : 0.07.5 Ares (about Acre 0.19
Cents); Survey No.361/4D, Extent : 0.01.0 Ares (about Acre O.02.5 cents)
and survey No.362/3E, Extent : 0.01.0 Ares (about Acre 0.02.5 cents).

Even though the Patta in respect of the said properties sub divided as
different extent, as per Partition the said 1.Mr.V.Ellappan, 2.Mr.V.Babu,
3.Mr.V.Vadivelu, 4.Mr.V.Muthukrishnan, 5.Mr.V.Ekambaram, sons of
Mr.Vaithi each is entitled to Acre 1.93 cents in all measuring Acre 9.65
cents and an extent of 9 cents belonging to all, and thus in all measuring an
extent of, Acre 9.74 Cents is presently absolutely owned and possessed by
the said Mr.V.Ellappan and others.

lfhereas as per ttre Patta in respect of the said properties were


subdivided and standing in the names of l.Mr.V. Ellappan, 2.Mr.V.Babu,
3.Mr.V.Vadivelu, 4. Mr.V.Muthukrishnan, 5. Mr.V.Ekambaram, sons of
Mr.Vaithi and as per the said partition deed, each is entitled to Acre 1.93
Cents.

ln pursuant of Death certificate No. D-201g:33- 10693_000076, one of


the sons of Mr.Vaithi, nameiy Mr.V.Vadivel Died on 26.10.201g, leaving
behind him the following persons as his legal heirs (Legal Heirship

Poonamallee Taluk). 1. Mrs.V.Sivakami - Wife 2. Mrs.M.Vijaya Daughter 3.

- Son 6. Mr.V.Rajasekar - Son.

(0.98 Cent), 362/48 (0.96 cents), 36ll4C (0.90 Cents), 362/3D (O.99
Centsl, 362/2 (0.64 Cents), 362/38 (1.00 Cents), 36214A (0.21 Cents),
36213A (1.89 Cents), 357 (1.45 Cents), 361/2 (O.22 Cents), 36rl4A (O.25
Cents), 361/4E} (0.19 Cents), 361/4D (0.02.5 Cents), 362l3E (0.02.5 Cents),
situated at Kavalchery, Voyalanallur-B Village, Poonamallee Taluk,
Thiruvallur District, consisting of Plots bearing Nos.1 to 302 and obtained
approval from Chennai Metropolitan Development Authority vide PPD/LO
No.32 /2023 in Letter No.Ll/1596212022, dated 16/02/2023 and Planning
Permit No. 15302 on 16/12/2023 and subsequently approved by
'Commissioner' Poonamallee Panchayath Union, vide RC.No.496/2023 /A3

WHEREAS the a portion of the property was already gifted to the


Poonamallee Panchayat Union in respect of the Road and public places by
way of Registered Gift Deed, dated 07.12.2022, Registered as Document
No.7015 of 2022, on the files of SRO, Poonamallee.
WHEREAS the said PROJECT is registered under the provisions of the Real
Estate (Regulation and Development) Act, 2076 and the Rules framed
thereunder, with the Tamil Nadu Real Estate Regulatory Authority, Chennai,
on 20/03/2023 under Project Registration No.TN/29/ Regularisation
Layottt / Q949 / 2023 .

WHEREAS the PURCHASER has already scrutinized/verified all sanctions,


authorizations, consents, no objections, permissions and approvals issued
by the appropriate authorities and the PURCHASER is satisfied with the title
and stafutory compliance with regard to the said Project/ Layout.

NOtrI THIS DEED OF AGREEMENT OF SALE WITNESSETH:

1. The above VENDORS assures the PURCHASER that there is no


encumbrance over the Schedule property as on today and tJ.at there is
no subsisting Agreement of sale, in favour of any person or persons in
respect of the property and agreed to be selling in favour of the
PURCHASER herein.
2. The VENDORS hereby agree to sell the vacant housing Plot No.52,
measuring an extent of 11OO Sq,ft., comprised in Survey No.362/3C as
Per Patta Sub Division Survey No.362l3C1A1A, in the layout named as
'AYAAN CITY", Approved from Chennai Metropolitan Development
Authority vide PPD/LO No.32 /20'23 in Letter No.Ll/L5962 /2022, dated
16/02/2023 and Planning Permit No.15302 on 16l02l2023 and
subsequently approved by'Commissioner' Poonamallee panchayath
Union, vide RC.No.496l2023lA3 dated 24/02/2023 and the
PURCHASER arrd VENDORS have agree tlat
the total sale consideration
for the schedule mentioned property shall be a sum of RS.24,ZS,OOO/_
(Rupees Twenty Four Lakhs Seventy Five Thousand Onlyf.

3. The PURCHASER hereby has paid a sum of Rs. lO,00O/- as Advance to


the VENDORS herein, which the VENDORS hereby admit and
acknowledgeit.
4. The VENDoRS confirms that on receipt of the sale consideration in full,
registration expenses, stamp duty, document registration fees, and
miscellaneous expenses, will facilitate, arr€rnge and complete the
Registration of the Schedule Property in favour of the pURCHASER and
hand over the possession of the scheduled property.
5. The parties hereto agree that the entire sale shall be completed within a
period of 90 days (Ninety Days) from the date of signing this Agreement of
Sale and time shall be the essence of this Agreement of Sale. And in the
event, the PURCHASER fails to
complete any the terms of this
Agreement, the VENDORS forfeits the advance paid by the pURCHASER
and this agreement will become null andvoid.
6. During the Pendency of this Agreement of Sale, any upward revision in
Land Guideline / Value / Registration charges etc, effected by the
Authorities concerned, then the same will have to be borne by
thePurchaser.
7. In case of need the vENDORS agree to arrange for an inspection of the
original title deeds relating tothe schedule propert5z by the pURCHASER
or by her authorized Bank Representative in respect of which the
PURCHASER has already collected and verified the marketable title of the
Vendor.
8. All disputes arising out of or in respect of this Agreement of sale shall be
decided by Arbitration at chennai Jurisdiction, and the Arbitrator will be
appointed by the VENDORS or its nominee/ s only. The language of
Arbitration shall be English only.
