MEMORANDUM
1. On or about 8:30 o’clock in the evening of January 17, 2024 along the Maharlika
Highway located at Purok 3, Brgy. Samon, Cabanatuan City, Nueva Ecija, one Jackylyn
Agustin, of legal age, and resident of the said place, was struck by Mitsubishi Montero
Sport color black bearing plate number 89SGA, driven by Marco Reyes, 35 years old,
resident of Barangay Talipapa, Cabanatuan City of said province, on the pedestrian
lane.
2. As a result thereof, the victim sustained fatal injuries, and was rushed to Premiere
Medical Center but was pronounced dead on arrival (DOA) by the attending physician.
3. Initial Investigation disclosed that the driver was using a mobile phone while driving,
which may have contributed to the failure of the driver to notice the pedestrian lane and
did not attempt to brake or avoid the collision until it was too late. The incident appears
to be a case of reckless imprudence resulting to homicide. The driver's negligent use of
a mobile phone while driving demonstrates a blatant disregard for the safety of others
and directly contributed to the tragic outcome.

2. This progress report provides an update on the investigation into the incident
involving reckless imprudence resulting to homicide, where the victim Jackylyn Agustin,
of legal age, was hit by a car on the pedestrian lane at Purok 3, Brgy. Samon,
Cabanatuan City, Nueva Ecija.

2. On or about 8:30 o’clock in the evening of January 17, 2024 along the Maharlika
Highway located at Purok 3, Brgy. Samon, Cabanatuan City, Nueva Ecija, one Jackylyn
Agustin, of legal age, and resident of the said place, was struck by Mitsubishi Montero
Sport color black bearing plate number 89SGA, driven by Marco Reyes, 35 years old,
resident of Barangay Talipapa, Cabanatuan City of said province, on the pedestrian
lane.
3. Immediately upon the receipt of the report, PNP elements of Cabanatuan City
Police Station led by PO2 Jeric Mendoza, PO2 Gian Guillermo and PO2 Carlos
Gutierrez proceeded to the place of incident to conduct occular inspection and
investigation over the case. Initial investigation disclosed that suspect Marco Reyes
was using a mobile phone while driving and failed to notice the victim who was legally
crossing the pedestrian lane, and fatal collision occurs.
4. Suspect Marco Reyes was arrested by the responding team and subsequently
brought to Cabanatuan City Police Station for proper case disposition while victim
Jackylyn Agustin was rushed to Premiere Medical Center but was pronounced dead on
arrival (DOA) by the attending physician. A case for Homicide under Article 365 of the
Revised Penal Code has been filed at the City Prosecutors Office against the suspect
Marco Reyes under I.S.
5. The accused Marco Reyes was arraigned on January 25, 2024 where he pleaded
Guilty and the case was set for pre-trial on January 30, 2024.
