Apart from various legal standards, I took help from the industry manuals, guidance documents by
different regulatory bodies, material safety data sheets (MSDS), physical inspection reports,
manufacturers guidelines, previous risk assessments, work method statements, health and safety
KPIs (Key Performance Indicators) and statistics, both internal and external audit reports,
approved code of practices (ACOPs), health and safety policy of the organisation, systems and
statutory compliance registers, health and safety performance report of similar organisations.

I conducted interviews and one to one talks with all sections of the workers including the
management staff to get an idea of their understanding about the ongoing construction activities
going on in the premises. I interacted with Project Manager, HSE Manager, Project Engineers,
Site Engineers, Civil Supervisors, Foremen, Leadmen and the Workers during my regular site
visits to conduct risk assessment.

I visited the construction site to identify the risks as a result of various hazards present because of
different activities, identify the people at risk, evaluate consequences and severity of the risks
using risk assessment matrix, the previous applied control measures and the effectiveness of the
control measures to mitigate the consequences of the risks.

Moral, general legal and financial arguments for ALL actions

Moral, general legal and financial arguments Moral Arguments - The company is morally responsible for the health and safety of people, property and
protection of environment. The company is also a part of society and it has the responsibility to provide a
safer workplace and environment to the people from society. The company employs migrant workers who
leave their land and family to work for the organisation. In turn, they expect the organisation to take their
maximum care. If anything happens to the workers, the company is responsible for the pain and suffering of
their families.
General Legal Arguments- There are multiple laws governing the health and safety practices of an
organisation at different level.
There are international laws developed by International Labour Organisation and then there are national laws
by the Government of Saudi Arabia along with laws by the regulatory bodies. International Labour
Organisation's different conventions and recommendations put legal obligation on the company to follow and
practice health and safety standards.
Failure or breach on compliance with these laws would result in either fine or imprisonment or both at a time.
The regulatory bodies also sends improvement notices and prohibitory notices from time to time to the
company. Failure of these notices also results in legal punishment.
Financial Arguments- There are financial reasons to practice health and safety at the company as it helps
save cost and also avoid major financial burden on the company. A better health and safety complying
organisation can even earn from these safety implementations. There are two types of costs that a company
have to expend in case of non-compliance with health and safety, direct and indirect. Direct cost s include first
aid cost, compensation money, hospital charges, sick pay, legal fees, rehabilitation fees etc. Indirect costs
include goodwill loss, contract loss, negative publicity, workers moral loss, company close off in case of major
accident, recruitment charges, workers strike etc.

Justification for action 1

Action (Taken from column 4 of risk Fixed guards must be installed on the moving parts of the concrete mixers such as rotating motors and drive
assessment) mechanisms. (Hazard Category - Work Equipment & Machinery)

Specific legal arguments According to "Article 6 of International Labour Organisation's Guarding of Machinery Convention, 1963 (No.
119), "Machinery shall be so guarded as to ensure that national regulations and standards of occupational
safety and hygiene are not infringed."
Also, Article 11 of International Labour Organisation's Guarding of Machinery Convention, 1963 (No. 119)
rules that,
"1. No worker shall use any machinery without the guards provided being in position, nor shall any worker be
required to use any machinery without the guards provided being in position.
2. No worker using machinery shall make inoperative the guards provided, nor shall such guards be made
inoperative on any machinery to be used by any worker"
Above laws emphasize on the use of machine guarding to protect workers from severe injuries. They made a
specific law on the guarding of machineries, it signifies the high level of the breach that the organisation is
making. It should immediately installed machine guarding based on the provision of the above mentioned
laws.
Consideration of likelihood AND severity types of injury or ill health - This hazard would cause immediate injury to the body parts of the workers. The
injury here can be classified as Hospital Injury as it would cut, crush, tear, shear the body parts of the

● how widespread the risk is
how often the activity is carried out - This activity is frequently performed, as the concretes are prepared
regularly to use as mortars. The likelihood of the risk is Highly Likely.
how widespread the risk is - The risk is widespread as the activity is frequent and a huge number of workforce
is involved into it. Moreover, this activity is performed into multiple sites also and the consequences/severity
of the risk is also major.

whether you think the action will fully control the risk - Installation of machine guard can reduce the risk
greatly. Since, it will act as a strong physical barrier between workers and moving parts of the mixers, it would
decrease the likelihood of the hazard from Highly Likely to Less Likely' while the severity would remain same
as 'Disabling/Hospital Injury/Major'. The risk would then come down to 'ALARP' Level.
With few Administrative and PPE controls, the risk can be controlled.
Old Rating = (5×4 = 20), (Highly Likely × Hospital/Major Injury = Unacceptable
New Risk Rating = (2×4 = 8), (Less Likely × Hospital Injury = As Low As Reasonably Practicable Level)].

Justification for action 2

Action (Taken from column 4 of risk The noise producing machineries must be enclosed with acoustic barriers to reduce the exposure of noise.
assessment) (Hazard Category- Noise)

Specific legal arguments Under Article 9, International Labour Organisation's Working Environment (Air Pollution, Noise and Vibration)
Convention, 1977 (No. 148), it is stated that, 'As far as possible, the working environment shall be kept free
from any hazard due to air pollution, noise or vibration--
(a) by technical measures applied to new plant or processes in design or installation, or added to existing
plant or processes; or, where this is not possible,
(b) by supplementary organisational measures.
The above law requires the noise hazard to be controlled using installation of protective devices (technical
measures) to protect the people from the risk of noise hazard. Till now it was a breach of the law to allow

● number of workers at risk number of workers at risk - The entire workforce who is working at the site is under the risk of the hazard.
● how often the activity is carried Almost 500 people are at the risk of this hazard. These people include workers, staff, vulnerable people,
out visitors, technicians, labours, neighbors who are constantly exposed to the hazard.
● how widespread the risk is how often the activity is carried out - The noise producing activity is performed 24×7. Almost, all the time
people are exposed to the noise as all the tools and equipment produce noise on regular basis. Hence, the
likelihood of the noise is 'Highly Likely'
how widespread the risk is - The risk is widespread as it doesn't have definite range. It can travel through air
and can affect a larger group of people and hence is widespread. The noise is present in similar sites also.
[I have taken 5 categories while considering the likelihood and severity of any risk;
Unlikely - 01, Less Likely - 02, Fairly Likely - 03, Likely- 04, Highly Likely- 05

How effective the action is likely to be in
the intended impact of the action; - This control measure would create a physical barrier between the
controlling the risk. This should include:
workers/affected people and the source of the hazard. This is an engineering control and hence, it would
● the intended impact of the action; reduce the likelihood of the hazard. The noise would be confined inside the barrier and would not reach to the
● justification for the timescale that workers, thereby allowing them a risk free environment to work and avoid health risks.

control the risk approval, design and model identification, budget sanction, vendor identification, order placement, delivery,
installation, management of change etc would be involved in the entire process. Hence, 1 week is justified.
whether you think the action will fully control the risk - 100% noise risk free environment can not be achieved
but this control would definitely control the bigger part of the risk. Since, it is a engineering control as per
hierarchy of risk control, hence it has the capability to reduce the likelihood of the noise hazard to the affected
people from 'Highly Likely to Less Likely'. It would bring down the hazard at 'As Low As Reasonably
Practicable' level.
If, the other control measures mentioned in the risk assessment above is also implemented, then, the risk
would further fall down to the 'Minimal' level.
Old Rating = (5×4 = 20) = (Highly Likely×Major= Unacceptable).
New Rating = (2×4=8) = (Less Likely×Major= ALARP).

Justification for action 3

Action (Taken from column 4 of risk A physical fire resistant barrier should be erected between the hot work area and the storage room (Hazard
assessment) Category - Fire)

Specific legal arguments Article 29, Safety and Health in Construction Convention, 1988 (No. 167)
1. The employer shall take all appropriate measures to-
(a) avoid the risk of fire;
(b) combat quickly and efficiently any outbreak of fire;
(c) bring about a quick and safe evacuation of persons.
2. Sufficient and suitable storage shall be provided for flammable liquids, solids and gases.
The law requires the company to take maximum protection against fire risk by avoiding risk of fire, combating
quickly and efficiently the fire outbreak, quick and safe evacuation, sufficient and suitable storage for
flammable materials. The company was keeping the flammable materials near the fire source which is a
major violations of above mentioned laws. Hence, the given control measure would reduce all the risk and
would comply with all the laws.
Consideration of likelihood AND severity types of injury or ill health - The injury/ill health would be a disaster for this hazard. The severity of the risk
would be 'Fatal' as after the fire outbreak everything would be under destruction. Numerous people would die
● types of injury or ill health and heavy property and environment loss would occur.
● number of workers at risk number of workers at risk - All the people working at the site are under the risk of this hazard including
● how often the activity is carried external people who are at the site for visiting purpose, neighbors, passersby. The total number would be
out more than 600.
● how widespread the risk is
how often the activity is carried out - The activity is performed regularly and the likelihood of the risk is also
'Highly Likely'. The hot work activity is one of the core activities of the company as it requires a lot of
fabrication work during construction.
how widespread the risk is - The risk is extremely widespread as it can affect the entire site, and also, the
neighborhood, environment and everything else in their range. The risk of similar fire is also on the another
site or place.

the intended impact of the action; - This action would reduce the eruption of fire as it would control the fire by
controlling the risk. This should include:
creating fire resistant barrier between the hot work area and the flammable storage room. Through this
● the intended impact of the action; engineering control, the risk would be reduced to a greater level.

whether you think the action will fully control the risk - This action would immediately control the risk of the fire

but wouldn't completely mitigate it. It would reduce the risk to tolerable level.
Further, control measures as per mentioned in the risk assessment would reduce the risk and would keep it at
minimal level as long as the measures are being implemented
Old Rating = (5×5 = 25), (Highly Likely × Fatal = Stop Work/ Highly Unacceptable)
New Rating = (2×5 = 10), (Unlikely × Fatal = Tolerable Risk)

Part 4: Review, communicate and check

Suggested word counts for each section:
● Planned review date or period and reasoning for this: 50 - 100 words
● How the risk assessment findings will be communicated and who needs to know the information:100 - 150 words
● Follow up on the risk assessment: 100 - 150 words.
Planned review date/period with reasoning The next review date of this risk assessment would be 06.11.2023 as per the company's Health and Safety
policy. But the same policy states that the review can be conducted before the planned date in following
conditions:

1. After any legal change made by the government of the country that affects the health and safety practices
of the company.
2. After any major or fatal accident occurred at the workplace.
3. After any major workforce change i.e., introduction of new group of migrant workers and vulnerable group
of people.
4. After any major technological upgradation and introduction of new machineries at the company.
5. After auditing conducted by regulatory bodies or insurance companies.
How the risk assessment findings will be The company has established a communication channel. This communication channel would be used to

A copy of the risk assessment would be published at the intranet of the company for the common access of
senior staff members as well as a hard copy of the risk assessment would be kept at HSE Office for common
reference of everybody.

The risk assessment would be communicated to new employees through induction training session.
It would also be communicated to external parties and would be provided to them as per their demand. They
could be insurance company, client organisation as well as health and safety regulatory bodies.
How you will follow up on the risk A follow up meeting would be conducted every week with the risk assessment implementation team where I

would be rewarded with promotion by the management.

This process would go on until the final member of the team submits his/her successful implementation
report.

To check the actual implementation, the management would conduct the specific inspection of the
implemented control measures to cross verify the report submitted by the risk assessment implementation
team by visiting the site, talking with workers and checking the documents.
