Part 3: Prioritise 3 actions with justification for the selection
Suggested word counts
Moral, general legal and financial arguments for all actions: 300 to 350 words
For EACH action:
Specific legal arguments: 100 to 150 words
Likelihood AND severity: 75 to 150 words
How effective the action is likely to be in controlling the risk: 100 to 150 words

Moral, general legal and financial arguments for ALL actions

Moral, general legal and financial Moral: It's the Employer's moral duty to take reasonable care of employees working in the organization. When
arguments an employee feels safe & satisfied with the employer, it will create a positive environment & will surely lead to
work productivity. For growing the business, the employer needs to understand the basic requirement of its
employees & should create a positive culture amongst the employees. In addition, it is the moral responsibility
of the employer to provide a safe workplace, safe work equipment & safe operating system. Research also
showed that employees are more productive in a workplace that is committed to health & safety.
General Legal: As per ILO convention C155 & recommendation R164 the responsibilities laid out to the
employer are to maintain a safe place of work.
ILO C-167-Occupational safety & health convention, 1988,’’ Article 13’’ says that
A) All appropriate precautions shall be taken to ensure that all workplaces are safe & without risk of injury to
the safety and health of workers.
B) All appropriate precautions shall be taken to protect persons present at or in the vicinity of a construction
site from all risks which may arise from such site.
Failure in controlling accidents or developing a safe system of work can lead to enforcement actions that may
result in prosecution. Enforcement of law and regulations concerning occupational health & safety shall be
adequate & appropriate system of inspection to be implemented. It is the duty of an employer to follow legal
standards & to keep workers up to date with legal knowledge.
Financial arguments: Financial loss resulting from accidents, incident, and health issues at work can have far-
reaching effects on the organizations.
For e.g.,
Indirect Cost-
A) Lost of production time of employees & employees helping the victim.
Learner number: 00247298 Learner name: Affan Husain Chougle Page 11 of
15
B) Lost of time to hire & train workers for replacing injured workers.
C) Facing legal actions from the authorities.
Direct Cost-
A) Sick leave pay to the injured employee.
B) Transportation cost to & from the hospital.
C) Need to pay medical expenses, which are not covered in insurance while treatment

Justification for action 1

Proper insulation for electric cables (Hazard category- Electricity)

Action

Specific legal arguments As per ILO Convention ILO C167 for construction, article 26 states that
a) All electrical equipment & installations shall be constructed, installed & maintained by a competent
person, and also used as to guard against danger
b) Before construction is commenced and during the progress thereof adequate steps shall be taken to
ascertain the presence of and to guard against danger to workers from any live electrical cable or
apparatus which is under, over or on the site.
c) The laying & maintenance of electric cables & apparatus on construction sites shall be governed by
the rules & standards applied at the national level
In addition, the company has to follow all the convention C155 & recommendation R164 of ILO to ensure
health & safety at the worksite. Violation may lead to serious accidents & company has to suffer legal
consequences

Consideration of likelihood AND severity Likelihood- As electrical equipment is operational mostly in all areas in the construction site; particular electric
workers, trespassers, as well as visitors, also can be harmed due to the electrical hazard. In addition,
equipment on sites can be exposed to naked electrical cables, which will result in electric shock &
electrocution to the workers using that equipment.
Severity- Anyone on the site can be harmed by getting in contact with a live wire, which could cause even
fatality. The naked cable can result in a short circuit, which will increase the chance of fire.
How effective the action is likely to be in All electrical cables should be properly insulated, this will reduce the risk of getting shocked and any related
controlling the risk. This should include: hazard. Any worker or trespassers will be free from any hazard caused by the electric cable.
 the intended impact of the action; As 1200 workers are working on the site, 2 weeks is considered to complete the task as there will be huge
 justification for the timescale that you electrical cable on site, a team of an electrician will be assigned to complete this task and it will take minimum
indicated in your risk assessment; 2 weeks to make every cable properly insulated.
and As per the control, hazard and risk cannot be controlled fully as there is many other risks associated with
 whether you think the action will fully electric cables. By applying this control, risk can only minimize.

control the risk.

Justification for action 2

Provide functional dead man switch on all power tools (Hazard category-Working equipment and machinery)
Action

Specific legal arguments As per ILO Convention ILO C167 for construction, articles 17 states that
 Plant, machinery and equipment, including hand tools, both manual and power driven, shall
a) be of a good design and construction, taking into accounts as far as possible ergonomic principles
b) be maintained in good working order
c) be used only for work for which they have been deigned unless a use outside the initial design
purpose has been assessed by a competent person who has concluded that such use in safe
d) be operated by workers who have received appropriate training
 Adequate instructions for safe use shall be provided where appropriate by the manufacturer or the
employer in a form understood by the users
 Pressure plant and equipment shall be examined and tested by a competent person in case and at
times prescribed by national laws or regulation.
Consideration of likelihood AND severity Likelihood- Any worker can suffer illness on-site and further if the tool is operational and the worker becomes
unconscious then it can result in loss of life and property damage. In any condition, if the power tool has a
dead man switch then it can be helpful.
Severity- In case power tools do not have a dead man switch and workers suffer any health issue in which
they can be unconscious then it may lead to fatality, an electric short circuit may happen which can lead to a
fire.
How effective the action is likely to be in In case any of the workers suffer health issues and the power tool is running, the dead man switch will be
controlling the risk. This should include: much helpful in reducing the risk & hazards related to the power tools. Further, if any worker loses control of
the power tool, in such a situation it will be controlled using a dead man switch.
 the intended impact of the action;
 justification for the timescale that you As the dead man switch needs to be approved by the management & further for procurement procedures it
indicated in your risk assessment; will take time as well as for installation also, so for all this process to complete, 2 weeks’ timescale is required.
and
 whether you think the action will fully By installing the dead man switch, hazards & risks associated with power tools will be reduced but can’t
control fully as there are many other operational hazards.
control the risk.

15
Justification for action 3

Usage of man lifts for providing safer working platform (Hazard Category- Work at Height)
Action

Specific legal arguments As per ILO Convention ILO C167 for construction, article 15 states that
 Every lifting appliance and item of lifting gear, including their constituent elements, attachments,
anchorages and supports, shall-
a) be of good design and construction, sound material and adequate strength for the purpose for which
they are used
b) be maintained in good working order
c) be examined and tested by a competent person at such time and in such cases as shall be
prescribed by national laws or regulations; the results of these examinations and tests shall be
recorded
d) be operated by workers who have received appropriate training in accordance with national laws and
regulations
 No person shall be raised, lowered or carried by a lifting appliances unless it is constructed, installed
and used for that purpose in accordance with national laws and regulations, except in an emergency
situations in which serious personal injury or fatality may occur, and for which the lifting appliance can
be safely used
Consideration of likelihood AND severity Likelihood- A man lift can be overturned if operated wrongly or by an incompetent person, the operator can be
trapped in the man lift basket. Man lift can be collide with pedestrians and overhead cables. Horseplay activity
with man lift can be dangerous
Severity- A man lift operated can fall from height if the full-body harness is not connected with the basket, the
pedestrian may be injured if the man lift is operated without banksman. Operations of a man lift by an
incompetent worker can cause a fatal accident, which can damage the man lift, property and injured operator,
workers working nearby.
How effective the action is likely to be in As compared to scaffolding, a man lift (MEWP) is the best solution to carry height works, man lift is easy to
controlling the risk. This should include: move from one place to another and man lift baskets can be reached to any suitable height, the working
platform is safer, this will also save time and work will be carried out faster than on scaffold with more safety
 the intended impact of the action; measures
 justification for the timescale that you
indicated in your risk assessment; 1-month timescale is given as a man lift needs to be hired or should be purchased, as per the site
and requirement man lift will be approved and procuring will also take time, further training to the worker and
 whether you think the action will fully certification from the third party will be also needed
control the risk. As man lift also has many associates risk with working at height at it can relate to the dangerous occurrences,
action can’t fully control the risk

Part 4: Review, communicate and check
Suggested word counts for each section:
 Planned review date or period and reasoning for this: 50 - 100 words
 How the risk assessment findings will be communicated and who needs to know the information: 100 - 150 words
 Follow up on the risk assessment: 100 - 150 words.

Planned review date/period with Al shirawi Co LLC has the policy to review the risk assessment after every 1 year; this risk assessmenthas the
reasoning next review date on the 5th of April 2023. Further, after any changes in work procedure or any new
equipment added to the project, or any work-related accident, incident or near-miss cases arises, a risk
assessment will be reviewed and updated

How the risk assessment findings will be Al shirawi Co has weekly and monthly meetings with site staff, in the meeting all matters related to the
communicated AND who you need to tell project are discussed. Further, I will discuss and communicate risk assessment findings with the construction
team, which will help to reduce the on-going non-compliance. Weekly toolbox talk meetings are scheduled
on-site in which site engineers, as well as many project teams, are involved to show motivation towards
safety & discuss related to safety with all workers, so risk assessment findings will be also discussed in
toolbox talk meetings. Moreover, a joint walk-around is carried out with engineers and supervisors and
findings are discussed with workers and supervisors personally. In addition, findings are been reported in the
safety inspection report and emails is been sent to all project teams and higher management.

How you will follow up on the risk I will set reminders as per the finding in every safety inspection report if not completed in the given time. It will
assessment to check that the actions be directly coordinated with responsible person against the progress of each action. I will check with the
have been carried out supervisor if the site engineers have discussed the issues mentioned in inspection reports and if discussed
what actions and control are in place to avoid the reoccurrence. In addition, a walk-around will be carried out
to check if any actions are been taken on the non-compliance report. Closed-out reports are expected to
