MR. CHAIRMAN:

The Committees on Agriculture and Cooperatives; and on Rules and Privileges to which
was referred a Proposed Ordinance No. 033-2023 (27 th SP), authored by Board
Member NEMESIO B. BELTRAN, JR., 1st Legislative District, this Province, entitled:

“ AN ORDINANCE INSTITUTIONALIZING THE ORDINANCES, POLICIES,

RULES AND REGULATIONS ON THE OPERATION AND EXPANSION OF
LARGE SCALE AGRI-INDUSTRIAL PLANTATIONS WITHIN THE
PROVINCE OF BUKIDNON, DECLARING CERTAIN ACTS PROHIBITED
AND PROVIDING PENALTIES, APPROPRIATING FUNDS THEREFOR,
AND FOR OTHER PURPOSES – ”

have considered the same and hereby submit their findings, comments, and
recommendations.

COMMENTS / FINDINGS:

The passage of Proposed Ordinance No. 033-2023 (27th SP) seeks to

promote the preservation, protection, and revival of the ecosystem
through prevention, control, and abatement of air, water, and land
pollution and minimize damage to the environment as mandated under
national laws and issuances of the Department of Environment and Natural
Resources.

 The declaration of principles and state policies of the 1987 Philippine
Constitution emphasizes the role of the State to “protect and advance
the right of the people to a balanced and healthful ecology in accord
with the rhythm and harmony of nature”, which is reinforced in Section
16, General Welfare Clause of Republic Act (R.A) No. 7160, as one of the
responsibilities of local government units (LGUs).
Furthermore, Presidential Decree (P.D.) No. 1586 established an
Environmental Impact Statement System, including other environmental
management-related measures for the pursuit of a comprehensive and
integrated protection and regulatory mechanism that ensures a rational balance
between socio-economic development and environmental protection for the
benefit of present and future generations.
Given this, the Provincial Government of Bukidnon and the LGUs shall
work together in ensuring that development activities shall not compromise the
right of the people to an ecologically balanced environment.
Thus, the passage of Proposed Ordinance No. 033-2023 (27 th SP)
institutionalizing the ordinances, policies, rules, and regulations on the operation
and expansion of large-scale agri-industrial plantations within the Province of
Bukidnon is in accord with the law.

RECOMMENDATIONS:

Considering the foregoing, the Committees, after careful review, hereby

recommends for the approval of of Proposed Ordinance No. 033-2023 (27 th SP),
of the Sangguniang Panlalawigan of Bukidnon

SO RECOMMENDED.
