MR. CHAIRMAN:

The Committees on Agriculture and Cooperatives; and on Rules and Privileges to which
was referred Municipal General Ordinance No. 2023-390 (11th SB), enacted on
January 04, 2023, of the Sangguniang Bayan of Kalilangan, Bukidnon, entitled:

“AN ORDINANCE INSTITUTING AND IMPLEMENTING THE REGISTRATION OF

OWNERSHIP OF AGRICULTURAL AND FISHERIES MACHINERY AND
EQUIPMENT IN ACCORDANCE WITH JOINT MEMORANDUM CIRCULAR NO.
2018-02 OF THE DEPARTMENT OF AGRICULTURE AND THE DEPARTMENT OF
THE INTERIOR AND LOCAL GOVERNMENT RELATIVE TO THE NATIONAL
GUIDELINES FOR THE REGISTRATION OF OWNERSHIP OF AGRICULTURAL
AND FISHERIES MACHINERY AND EQUIPMENT WITHIN THE TERRITORIAL
JURISDICTION OF THE MUNICIPALITY OF KALILANGAN, BUKIDNON”

have considered the same and hereby submit their findings, comments, and
recommendations.

COMMENTS / FINDINGS:

The passage of Municipal General Ordinance No. 2023-390, seeks to

establish ownership and create a national database of machinery and equipment for
planning and monitoring in the Municipality of Kalilangan, Bukidnon, as mandated by
R.A. No. 10601, otherwise known as the “Agricultural and Fisheries Mechanization
Law”. Through mechanization, food security can be attained with the use of

appropriate, gender-sensitive technologies. The application of mechanization
technologies has been regarded as an important contributor to modernized Philippine
agriculture.
The coverage establish on Joint Memorandum Circular No. 2018-02 is to
provide owners and Local Government Units (LGUs) with a framework for implementing
the One-time registration of ownership of both new and currently used agricultural
and fisheries machinery and equipment. The registration of such machinery and
equipment shall be re-validated 5 years thereafter, to be led by the Bureau of
Agricultural and Fisheries Engineering.
Hence, the institution and implementation of the registration of ownership of
agricultural and fisheries machinery and equipment is in accord with the law.

RECOMMENDATIONS:

Considering the foregoing, the Committees, after careful review, hereby

recommends for the approval of Municipal General Ordinance No. 2023-390,
enacted on January 04, 2023, of the Sangguniang Bayan of Kalilangan, Bukidnon, for
being proper, in order, and within the competence of the Sangguniang Bayan
concerned to pass subject to the provisions and intent of Republic Act No. 10601 or
otherwise known as the “Agricultural and Fisheries Mechanization (AFMech) Law”.
