BETWEEN

MR. SAMPSON NANAN WEGWU of No 32 Mbodo Aluu Road, Ikwerre Local


Government Area of Rivers State of Nigeria (hereinafter referred to as the (VENDOR)
which expression shall where the context so admits includes his heirs, personal
representatives, agents and assigns) of ONE PART.

AND

CHIEF CHRIS WIKE JP., Paramount Ruler Rumuwike of Ejekwu Family


Rumuwike, Rumuepirikom Obio/Akpor Local Government Area of Rivers State,
Nigeria, (hereinafter referred to as the (PURCHASER) which expression shall where
the context so admits includes his heirs, personal representatives, agents and assigns)
of the OTHER PART.

WHEREAS:

1. Under and by virtue of customary family land inheritance/purchase in consonance


with the prevailing law and tradition of Ikwerre in regard to land acquisition,
devolution, disposition, allotment, purchase and succession as applicable to Mbodo
Aluu in Ikwerre Local Government Area of Rivers State, Nigeria, the vendor
became seized in absolute ownership in possession by inheritance.
2. The purchaser is desirous of acquiring a free hold estate of this piece or parcel of
land afore described and the vendor has agreed to grant to the purchaser such an
estate in perpetuity and subject to Land Use Act Cap 202 LFN 1990.
3. The Purchaser has applied to the vendor and the vendor has agreed to sell and
convey to him this piece or parcel of land for a consideration of (N500,000.00)
Five Hundred Thousand Naira only.

NOW THIS DEED WITNESS AS FOLLOWS:


a) In pursuance of the above recital and in consideration of the sum of (N500,
000.00) Five Hundred Thousand Naira only. Now paid by the PURCHASER to
the vendor (the receipt of which sum the vendor hereby acknowledges). The
vendor as beneficial owner hereby conveys unto the PURCHASER ALL THAT
parcel of land lying and situate at ALI AGBADA FARM LAND, MBODO
ALUU, in Ikwerre Local Government Area of Rivers State, Nigeria which is
demarcated and more particularly delineated and verged red in the survey plan
number RV/730/2020/089-SP and bounded by beacon numbers SC/RV6112,

SC/RV6113, SC/RV6114 AND SC/RV6115, Measuring 464.456 SQ.METERS in
the said Survey Plan Number RV/730/2020/089-SP Prepared by a registered
Surveyor ONARI J. BRIGGS Of No. 25 Churchill Road, Coronation Layout,
Port Harcourt, Rivers State, annexed to and forming part of these presents; TO
HOLD the same UNTO the Purchaser free and discharged from all Charges,
encumbrances and any form of incident of customary tenure or otherwise.
b) The Vendor with object intention of affording the Purchaser a full and sufficient
INDEMNITY hereby covenant with the Purchasers that he have absolute right
and power to convey the said property to the purchaser and further covenant that
the said property hereby conveyed shall be quietly enjoyed by the Purchaser and
his successors-in-title without interruption from the vendor or persons claiming
any title paramount by totally divesting herself or anyone else either claiming
through her or otherwise of all rights or interest touching this piece or parcel land
having vested same absolutely to the Purchaser and for all purposes.
c) The vendor further covenant that he shall indemnify the purchaser and or their
successor-in-title in the above stated consideration and against all actions, losses,
proceedings, damaged, value of improvements, financials and other incidental
expenses incurred over the said land and adverse claims by third party against the
interest of Purchaser and demand whatever by reason of or arising from this Deed
of Conveyance being proved invalid, defective or resulting in the purchaser being
ousted from the land or any part thereof or unsuccessfully defend his title against
any claimant(s).
d) This deed can and is intended to support an application to the Rivers State
Government if necessary for the grant of Certificate of Occupancy and the Vendor
shall at the option of the Purchaser execute a declaration of trust in favour of the
Purchaser in the event the Governor’s consent cannot be conveniently obtained.

IN WITNESS WHEREOF the parties have hereunto set their respective hands and
seals the day, month and year first above written.
