Miscellaneous Application like condonation of delay

The Respondent/Defendant Name above named most humbly begs to

submit as under order 21 rule 106 of C.P.C.
I submit that the above case is posted for attachment on today. I submit that
on 19.07.2023 I was set-exparte and the exparte order was passed against
me. I submit that in the above case I was also filed detailed counter on
14.06.2023. I submit that I have also filed Second appeal in
S.A.No.602/2023 before the Hon'ble High Court, Chennai
against the decree and judgement passed in O.S.No.126/2010 and the same
was pending before the Hon'ble High Court. I submit that I
have also filed application for stay the further proceedings before the
Hon'ble High Court, Chennai. I submit that the exparte order
passed against me is works very much hardship to me. Unless the exparte
order is setaside I will be put to great loss and hardship. No prejudice will
be caused to other side.
PRAYER
It is therefore most humbly prayed that the Hon’ble Court may be
pleased to order to setaside the exparte order passed against me on
19.,07.2023 in the above case and thus render justice.
