That this REAL ESTATE MORTGAGE, is made and entered into
by and between:
DIOSA A. MAGANDA, of legal age, Filipino, single, and with
residence and postal address at Acacia Street, Brgy. Bulusan, Calapan City, Oriental Mindoro herein after referred to as MORTGAGOR;
MARIKIT A. SOLOMON, of legal age, Filipino, single, and with
residence and postal address at Mangosteen Street, Brgy. Suqui, Calapan City, Oriental Mindoro herein after referred to as the MORTGAGEE;
WHEREAS, DIOSA A. MAGANDA is the absolute and
registered owner of a parcel of land situated at Neo Calapan Subdivision Brgy. Bulusan, Calapan City, Oriental Mindoro covered by Transfer Certificate of Title No. 12-3456 issued by the Registry of Deeds of Oriental Mindoro;
WHEREAS, DIOSA A. MAGANDA is indebted to MARIKIT A.
SOLOMONin the principal sum of One Million Five Hundred Thousand Pesos (Php 1,500,000.00), Philippine currency, with an interest rate of two (2%) per cent per month (24% per annum), receipt of the principal is acknowledged by DIOSA A. MAGANDA;
WHEREAS, DIOSA A. MAGANDA agreed to pay the above
indebtedness within a period of Five (5) years from and after the date of this instrument;
WHEREAS, DIOSA A. MAGANDA has agreed to secure the
payment of his indebtedness to MARIKIT A. SOLOMONby means of a good and valid real estate mortgage upon the property herein described below;
NOW, THEREFORE, for and in consideration of the foregoing
premises and as security for payment of the aforesaid obligation, DIOSA A. MAGANDA has transferred and conveyed, and by these presents transfer and convey by way of MORTGAGE, unto the MORTGAGEE, his heirs, successors or assigns the aforesaid parcel of land including the improvements thereon situated at Neo Calapan Subdivision Brgy. Bulusan, Calapan City, Oriental Mindoro and more particularly described as follows: Transfer Certificate of Title No. 12-3456 A certain parcel of land situated in Neo Calapan Subdivision, Bulusan Calapan City, covered and described issued by Registry of Deeds of Oriental Mindoro, Philippines containing an area of Six- hundred Fifty square meter (50sqm.), more or less. Bounded as follows: on the East., Along line 1-2 by Lot 2482, Cad 344-D; on the South., Along line 1-2 by Lot 2482, Cad 344-D; on the West., Along line 1- 2 by Lot 2482, Cad 344-D; and on the on the North., Along line 1-2 by Lot 2482, Cad 344-D; (A Copy of which title is hereto attached as Annex “C”)“ X x x”
The condition of this mortgage is such that if DIOSA A.
MAGANDA shall well and truly pay or cause to be paid to MARIKIT A. SOLOMONthe above-stated obligation in the principal sum with accrued interest, according to the terms and tenor hereof, then this mortgage shall thereby fully discharge and without further effect; OTHERWISE, it shall remain in full force and effect and shall be enforceable in the manner provided for by law.
It is likewise agreed and understood that if at any time DIOSA A.
MAGANDA shall fail or refuse to pay the obligations herein secured, or default in any instalments and/or amortizations for such indebtedness or the principal obligation when due, or to comply with any of the conditions and stipulations herein agreed or in the separate instruments evidencing the obligations hereby secured or shall, during the time this mortgage is in force, institute insolvency, suspension of payment or similar proceedings, or be involuntarily declared insolvent or a writ of garnishment and/or attachment be issued against any of the assets or income of DIOSA A. MAGANDA or if this mortgage cannot be recorded in the Registry of Deeds, then the obligation of DIOSA A. MAGANDA secured by this Mortgage shall immediately become due and payable and defaulted and MARIKIT A. SOLOMONmay immediately foreclose this mortgage judicially, or extra-judicially pursuant to Act No. 2135, as amended.
