Greetings of Peace!
This is connection with the real property identified as Lot No. 2074, Pls-116 CSD-
132585 covered by order approval of application Homestead Application No.
236437 with Homestead Entry No. 142551 on October 31, 1940 located at Barangay
Buayan, Mlang, Cotabato is traversed by Mlang-Tacurong National Highway and use
for public purpose consisting an area of TWELVE THOUSAND TWO HUNDRED SIXTY
FOUR (12,264) square meters more or less. Further, the landowners religiously pays
the real property taxes with the Municipality Mlang, Province of Cotabato,
Philipppines. Furthermore, this real property is not yet titled but the owner is
occupying or in continuous possession of the property for more than thirty (30)
years complying the requirements under RA-10752.
In view thereof, invoking Section 9, Article III of the Philippine Constitution “ Private
Property shall not be use by the public without just compensation”, the undersigned
request your good office to inspect the said lot and payment for just compensation.

THIRTY SIX (10,036) square meters more or less, located at Barangay Nueva Vida, Mlang, Cotabato is
traversed by Makilala-Allah-Junction National Road and use for public purpose. Further, the
undersigned religiously pays the real property taxes with the Municipality Mlang, Province of
Cotabato, Philipppines.
In view thereof, invoking Section 9, Article III of the Philippine Constitution “ Private Property shall not
be use by the public without just compensation”, the undersigned request your good office to inspect
the said lot and payment for just compensation.
I, DOMICIANO AVELINO PEROCHO, heir of Saturnino Perocho, of legal age, single, Filipino and a
resident of Nueva Vida, Mlang, Cotabato, have name named, constituted and appointed, and by these
presents do name, constitute and appoint, MUTIN M. LANDASAN, also of legal age, married, Filipino
and a resident of 1375 Mercado St., Poblacion, Kabacan, Cotabato to be my true and lawful attorney-
in-fact, for us and in our name, place and stead, and for our own use and benefit to do and perform
all of any of the following act and things to wit;
1. To follow-up and secure the approval of the respective claims in the DPWH,
Regional Office XII, Koronadal City, or in its Central Office in Manila, or any
offices/agencies concerned, whichever is practicable for claims covered by the
traversed Makilala-Allah-Junction National Road in our lot, a project of
Department of Public Works and Highways (DPWH) located at Nueva Vida, Mlang,
Cotabato.
2. However, upon payment of the RROW claims, the payment shall only be receive by
the attorney-in-fact together with the landowner or any of his authorized
representative
3. To accomplish and sign for me all papers and/or documents needed to carry into
effect the above-mentioned duties.
HEREBY GIVING AND GRANTING unto my said attorney-in-fact full power and authority
whatsoever requisite or necessary or proper or proper to be done in or about the premises as fully to
all intends and purposes as we might or could lawfully do or personally present and hereby ratifying

MEMORANDUM OF AGREEMENT

of Saturnino Perocho, of legal age, single, Filipino and a resident of Nueva Vida, Mlang, Cotabato,
Philippines, hereinafter called PARTY OF THE FIRST PART; and

Poblacion, Kabacan, Cotabato, Philippines, hereafter called PARTY OF THE SECOND PART;
That for and in consideration of the foregoing premises, PARTIES hereto hereby agree as they

1. PARTY OF THE SECOND PART, will take charge in all aspects in the processing of the
documents, travel documents and others for the approval of the claim covered of
the traversed by the Makilala-Allah-Junction National Road located at

2. That any NET PROCEEDS of the payment of the claim, the sharing is 60% for the
