SUBJECT : Spot Report: Arrest of HALIM MACAPALO for Violation of Article
295 “Robbery with violence against or intimidation” of RPC
and Republic Act 10591, also known as the "Comprehensive
Firearms and Ammunition Regulation Act"
DATE : April 27, 2023
1. WHAT : Shooting Incident
2. WHEN : At about 9:35 AM, April 27, 2023
3. WHERE : Infront of the house of Nr. 44 Bubarac St., Barangay
Bolo, Taviran, Maguindanao.
4. WHO : HALIM MACAPALO (arrested suspect) 47 years old,
male, single, unemployed and a resident of Nr. 44 Bubarac St., Barangay
Bolo, Taviran, Maguindanao
JALILUL MARAGUSI (victim, deceased) 47 years old, male,
married, farmer and and a resident of Nr. 56 Bubarac St., Barangay Bolo, Taviran,
Maguindanao
FARA MARAGUSI y Fajardo (complainant, wife), 45 years old,
female, married, housewife and a resident of Nr. 56 Bubarac St., Barangay Bolo,
Taviran, Maguindanao.
5. ARRESTING OFFICERS: PCMS Franklin M Ong, PSMS Joey B
Ferrer, and PSMS John King Yabut, all members of this Station
6. WITNESSES: 1) AYLENE PANGANIBAN y Daprosa (Aylene for
brevity) 40 years old, female, married, Sari-Sari Store Owner and a resident
of Nr. 43 Bubarac St.Barangay Bolo, Taviran, Maguindanao; and 2)
JENNIFER REYES y Geradila (Jennifer for brevity) 45 years old, female,
married, housewife, resident of Nr. 45 Bubarac St., Barangay Bolo, Taviran,
Maguindanao
7. EVIDENCE RECOVERED: one unit pistol model Taurus, caliber
9mm with serial number TZF34526, one (1) pc. Magazine and ten (10)
pcs live ammunition.
8. HOW: Initial investigation disclosed that on the aforementioned
TDPO, victim went to the house of the suspect to collect a sum of money
which was long overdue. When the victim arrived at the suspect’s residence,
they talked in front of the house while walking but due to suspect’s failure to
pay his debt resulted to heated argument and the victim shouted at the
suspect on top his voice “WALANG PANGBAYAD!!!... YAN KASI DAHIL
YAN SA PAGKALULONG MO SA SUGAL!!!... KAYA INIWAN KA NI
ELSA!!!... DAHIL DYAN SA BISYO MO!!!...”. and the suspect replied in an
angry manner saying “PUTANG INA MO!!!.. YABANG MO AH!!!...” then and
there, suspect pulled a firearm from his waist and shot the victim thrice hitting
the victims head and chest that resulted to his instantaneous death and
immediately fled towards his residence, wearing red shirt with white Adidas
logo at the front, faded maong pants and slippers.
9. DISPOSITION: The arrested suspect was temporarily detained at
the custodial facility of this station while preparing pertinets documents for
inquest proceedings before thw office of thew City Prosecutor for the crime of
Murder and illegal possession of firearm.
