KNOW ALL MEN BY THESE PRESENTS:
This Deed of Extra-Judicial Settlement of the Estate of Socorro Villanueva Fallorina
and Supplemental Deed of Extra-Judicial Settlement of the Estate of Alberto Fallorina, Sr.
is entered and made into by and between –
1. Edgardo Villanueva Fallorina1, also known as Edgar Allan
Fallorina2, who died intestate on May 16, 20033, is represented herein by his
heirs and successors in interest, namely:
a) Albert Antonio Catipon Fallorina, married to
Carmina Cecilia Fallorina, Filipinos, and with residence address
at 30 San Juan Street, Brgy. Kapitolyo, Pasig City;
b) Justin Edgar Fallorina, American citizen, with
residence address at 3071 Stonehenge Road, Fremont, CA –
94555, U.S.A., with Philippine address at 29 San Juan Street,
Bo. Kapitolyo, Pasig City, Metro Manila;
c) Therese Georginna Macadaeg, American
citizen, with residence address at 4463 Hyde Cmn, Unit 232,
Fremont, CA – 94538, U.S.A., and with Philippine address at 29
San Juan Street, Bo. Kapitolyo, Pasig City, Metro Manila; and
d) Kristine Nicole Fallorina, American citizen,
with residence address at 2936 Damico Drive, San Jose, CA –
95148, U.S.A. and with Philippines address at 29 San Juan
Street, Bo. Kapitolyo, Pasig City, Metro Manila;
(“Heirs of Edgar Fallorina”, for short), represented herein
by their duly authorized representative and attorney-in-fact, by
herein Albert Antonio Catipon Fallorina.
2. Gilbert Villanueva Fallorina, who died intestate on October 3,
2024, at San Jose, Occidental Mindoro 4, represented herein by his heirs and
successors in interest, namely:
a. Gary James Santos Fallorina, Filipino, of legal age,
married to Maria Clara Chantel Love Ongpauco Fallorina, and
with residence address at 16 M.H. Del Pilar Street, San Nicolas,
Pasig City, Metro Manila; and
b. Gilbert Santos Fallorina Jr., American and Filipino
citizens, of legal age, single and with residence address at 159
Morton Drive, Daly City, CA – 94015 – USA.

5. Alberto Villanueva Fallorina, Jr., Filipino citizen, with residence
address at 29 San Juan Street, Kapitolyo, Pasig City, married to Annabelle
Abeleda Fallorina, with address 124 Mons Alvarez St. Pedro Cruz, San Juan
City, represented herein by their daughter, Kimberly Ann Kirstin A.

address, (“Alberto, Jr.”, for short).
cumulatively referred to as “THE PARTIES/HEIRS”.
WITNESSETH: That –
WHEREAS, Spouses Alberto Fallorina, Sr. and Socorro Villanueva Fallorina died
on August 26, 19995 and on February 24, 20246 respectively without a will, and
hereinafter referred to as the “DECEDENTS”, and who at the time of their respective
death were residence of No. 29 San Juan Street, Kapitolyo, Pasig City, Metro Manila.
WHEREAS, the PARTIES/HEIRS are the legitimate children and sole heirs of the
decedents, except for the Heirs of Edgardo Villanueva Fallorina and Heirs of Gilbert
Villanueva Fallorina, who are represented by their legal heirs and successors-in-interest,
by way of substitution (of heirs).
WHEREAS, on September 3, 1999, the PARTIES/HEIRS executed the Deed of Extra-
Judicial Settlement of the Estate of Alberto Fallorina, Sr. 7, and paid8 the corresponding
Estate Tax due thereon on September 28, 1999, and October 8, 1999, of which some
properties were excluded the same having been recently discovered.
WHEREAS, the DECEDENTS died without any outstanding debts or obligations in
favor of any person(s) or entity.
WHEREAS, the following properties were newly discovered that must form part of
the estate of the DECEDENTS, but were excluded in the settlement of the state of Alberto
Sr., namely:

WHEREAS, DECEDENT SOCORRO at the time of her death left the following

NE., points 3 to 4, by Lot I-5, (LRC) Psd-57957; on the SE., points 4 to 5 and 5
to 6, by Lot I-5-B-7; on the SW., points 6 to 1, by Lot I-5-B-13; and on the W.

WHEREAS, Property Nos. IV and V (Annexes “K” and “L”, hereof) were among the
properties declared and reported as part of the estate of the late Alberto Fallorina Sr.
WHEREAS, it is to the best interest of the PARTIES/HEIRS hereto to adjudicate unto
themselves the entire estate extra-judicially in the form and manner hereinafter set forth.

NOW, THEREFORE, for and in consideration of the foregoing premises and
invoking the provision of Section 1, Rule 74 of the Rules of Court, the PARTIES/HEIRS
above named have agreed to settle the estate extra-judicially and to this effect do hereby
partition and adjudicate the same unto themselves and the foregoing inheritance, subject
however to the liabilities imposed by Section 4, Rule 74 of the Rules of Court for a period
of two (2) years in favor of any other possible heirs, creditors or any other person
deprived of the lawful participation over the said estate of the decedents and
encumbrances subject to the following terms and conditions:
1. Property Nos. I, II, and III, all situated in Quezon City, is adjudicated among the
PARTIES/HEIRS in equal shares of the undivided portion thereof.
2. Property No. IV, the residential house and lot situated in Pasig City, shall be sold
to interested buyer/s, and the net proceeds, (net proceeds shall mean selling price less
commission, capital gains tax and other incidental expenses directly related to the sale of
the property) thereof shall be distributed as follows:
2.1. Fifty (50%) percent of the net selling price is given to Alberto
Jr.
2.2. Fifty (50%) percent shall be shared equally, at twenty-five (25%)
percent each (of the 50%) thereof, among the following heirs/parties:
2.2.1. Heirs of Edgardo Fallorina, namely: (a) Albert Antonio
Catipon Fallorina; (b) Justin Edgard Fallorina; (c) Therese Georginna
Macadaeg; and (d) Kristine Nicole Fallorina, as mentioned in
paragraph 1 hereof.
2.2.2. Heirs of Gilbert Villanueva Fallorina, namely: (a)
Gary James Santos Fallorina; (b) Gilbert Santos Fallorina Jr.; (c)
Karen Santos Fallorina; and Valentin Sevilla Fallorina.
2.2.3. Linda Fallorina-Guthrie; and
2.2.4. Evelyn Fallorina-Yoshida.
3. Property No. V (Baguio) is adjudicated unto LINDA and EVELYN in equal shares
of the
undivided portion thereof.
4. To publish this instrument in a newspaper of general circulation nationwide once
a week for three (3) consecutive weeks, and costs shall be for the account of the estate.
5. Costs and expenses in the settlement of the estate including transfer of titles
from the DECEDENTS to the herein PARTIES/HEIRS shall be for the account of the Estate.
The parties undertake to share these cost equally.
6. In the remote event that any other property of the decedents shall ever be found
which is not included in this Deed, the PARTIES/HEIRS hereto further agree as they do so
agree to settle and distribute the same equally among themselves (parties/heirs).
7. The PARTIES/HEIRS hereby covenant and further warrant that should there be
preterition or omission of one, some of the compulsory heirs in the direct line, whether
living or not at the time of the execution of this Deed, will not invalidate/nullify the terms
and conditions of this Deed. Instead, the PARTIES/HEIRS shall proportionately oblige
themselves to pay to the omitted Heirs or the latter’s heir(s) the share that belongs to
him/them, under the rules on succession under the Civil Code of the Philippines.

9. Finally, WE, the PARTIES/HEIRS hereby appoint, constitute, and name ATTY.
TERESITA L. CAALIM and/or her duly authorized representative (liaison officer) (Filipino, of
legal age, and with office address at No. 5 Bethlehem Street, Victoriaville Homes, Santa
Cruz, Antipolo City, Rizal), as our duly authorized representative(s) and attorney(s)-in-
fact, to act for and on our behalf, to facilitate the registration of this Deed, including the
settlement of the estate of the decedents, and represent us before the proper Revenue
District Office of the Bureau of Internal Revenue, City/Municipal/Provincial Assessors of
the place where the above properties are situated, Land Registration Authority having
jurisdiction of the above properties, and the Philippine Statistics Administration (PSA). As
such authorized representative(s) and attorney(s)-in-fact, to deliver, execute, request,
and receive documents and papers necessary to carry out this authority, including but not
limited to the Tax Declaration of Real Properties and Transfer Certificate of Titles,
Certificate of Live Birth, Certificate of Death, as the circumstances may require, and
HEREBY GIVING AND GRANTING unto our attorney(s)-in-fact full power and authority
whatsoever requisite or proper to be done, as fully to all intents and purposes as we
might or could lawfully do if personally present, and hereby ratifying and confirming all
that our attorney(s)-in-fact shall do or cause to be done under this instrument.
