Appointment of Authority’s
Engineer
♦Article 18
Appointment of the Authority’s Engineer
o Engineer means Consulting Engineering firm.
o To be appointed within 15 days from the date of agreement as per selection criteria set forth
in Schedule N and as per TOR responsibility
Duties / Powers of Authority’s Engineer with prior approval of Authority
o To determine any Time Extension.
o To determine any additional cost to be paid by the Authority to the Contractor.
o To determine termination payment.
o To determine liability / obligation on either party for a sum up to Rs. 50 Lakh.

Scope of Work
AE to ensure monitoring for
2.1 Scope of the Project: that is
(a) Construction of the Project Highway on the Site set forth in Schedule-A and as specified in
Schedule-B together with provision of Project Facilities as specified in Schedule-C, and in
conformity with the Specifications and Standards set forth in Schedule-D;
(b) Maintenance of the Project Highway in accordance with the provisions of this Agreement
and in conformity with the requirements set forth in Schedule-E; and
(c) Performance and fulfilment of all other obligations of the Contractor in accordance with the
provisions of this Agreement and matters incidental thereto or necessary for the performance of
any or all of the obligations of the Contractor under this Agreement.

Design & Drawings
♦Preparation of Design & Drawings
o Contractor shall carry out survey & investigations with development of
designs & drawings in conformity with the specifications and standards.
o Checked by a Proof Consultant and a Safety Consultant who are to be
appointed with the approval of the Authority.
o Authority’s Engineer shall review the design & drawings to ensure that these
conform to the scope of the project, design standards and specifications.

of Highways
Highway Design Follow the alignment, plan and profile specified in the
alignment plan enclosed in Annex III of Schedule A. Some time minimum FRL
criteria also specified,
Width of the Carriageway: As per the TCS specified in Appendix B-I,

Traffic Control Devices & Road Safety Works: As per Section 9 of
the Manual

o MS Railing
o Overhead Traffic Signs,
o Delineators
o Afforestation
o Safety Barriers

Review of Facilities
Project Facilities: Schedule C (Refers to Clause 2.1)
Toll plaza[s];
Roadside furniture;
Pedestrian facilities;
Tree plantation;
Truck lay-bys & Truck parking-cum-wayside amenities;
Bus-bays and Bus shelters;
Rest areas; and
Others to be specified: Highway Lighting, Highway Patrol,
Ambulances, Cranes, Advance Traffic Management System
(ATMS), etc.

EPC Contractor is sole responsible for any errors /omissions or
defect of design and drawings ;

Supervision Inspection
11.8 Inspection
o 11.8.1 The Authority's Engineer and its authorised representative shall
at all reasonable times:
(a) have full access to all parts of the Site and to all places from which
natural Materials are being obtained for use in the Works; and
(b) during production, manufacture and construction at the Site and at
the place of production, be entitled to examine, inspect, measure and
test the Materials and workmanship, and to check the progress of
manufacture of Materials.

11.9 Samples
o The Contractor shall submit the following samples of Materials and
relevant information to the Authority's Engineer for pre-construction
review:
(a) manufacturer's test reports & standard samples of manufactured
Materials; &
(b) samples of such other Materials as the Authority's Engineer may
require.

Payments
Milestone based Payments during Construction:
Payments are made for works conforming to the Agreement and
commensurate with the stages of completion of works.
AE to monitor stage completion works and related quality
documents
Payment during Maintenace :
The Contractor shall be paid 1.5% of the contract price for the
first year and 2% for the second, third and fourth year of
maintenance.
AE will monitor that maintenance is carried out as per the
Maintenance manual and Maintenance Programme

19.4 Stage Payment Statement for Works:
oThe Contractor shall submit a statement (the "Stage Payment
Statement"), in 3 copies, by the 07th (seventh) day of the month
o19.5 Stage Payment for Works
o19.5.1 Within 10 (ten) days of receipt of the Stage Payment
Statement, the Authority's Engineer shall broadly recommend 90
(ninety)% and within 15 (fifteen) days shall certify IPC.
19.10. Price adjustment for the Works
o19.10.1 The amounts payable to the Contractor for Works shall be
adjusted in accordance with the provisions of this Clause 19.10.
