Dispute Resolution Or Dispute Settlement

-is the process of resolving disputes between parties.

The term dispute resolution is sometimes used interchangeable

with conflict resolution although conflicts are generally more deep-
rooted and lengthy than disputes.

Article 33 of the UN Charter provides for the means of settling
disputes:

Negotiation is a dialogue between two or more people or

parties intended to reach a beneficial outcome over one or
more issues where a conflict exists with respect to at least one
of these issues. This beneficial outcome can be for all of the
parties involved, or just for one or some of them.

Enquiry one of the common obstacles preventing the

successful settlement of a dispute by a negotiation is the
difficulty of ascertaining the facts which have given rise to the
differences between the disputants.
Mediation is a “Party Centered” process in that it is focused
primarily upon the needs, rights and interest of the parties

Conciliation is described by some as a combination of enquiry and

mediation. The conciliator investigates the facts of the dispute and
suggests the terms of the settlement.
Adjudicative methods of Dispute Settlement consist of two types
of procedures:

Arbitration meant settlement by other tribunals

Judicial meant settlement by the Permanent Court of Justice
