ASSESSMENT OF REPUBLIC ACT NO.

10883 OR ANTI-CARNAPPING LAW


IN LEGAZPI CITY: BASIS FOR
PREVENTIVE MEASURE AGAINST
CARNAPPING
Introduction
• This research study basically introduces the
assessment of RA 10883 or Anti-Carnapping Law in
Legazpi City particularly motor vehicle theft as one
of the main phenomenon today. This study will
evaluate the motivations behind car napping and
the underlying causes of such behavior. This will
also demonstrate the methods used by those who
commit such crimes as well as the difficulties the
PNP staff faces in putting an end to and preventing
them in order to preserve public peace and order.
• Due to the increasing numbers of motorcycle
vehicle ownership, there is no sufficient space for
parking, leading to perpetrators committing
motorcycle theft. According to R.A. 6539, as
amended by R.A. 10883, otherwise known as the
new “Act providing for a New Anti-carnapping
Law of the Philippines” of July 17, 2016,
carnapping is the taking, with intent to gain, of a
motor vehicle belonging to another without the
latter’s consent, or by means of violence against or
intimidation of person or by causing force upon
things. (Felipe, E., et.al., 2019)
Objectives

1. To assess the enforcement of RA No 10883 or Anti-


Carnapping Law in Legazpi City along:
• Number of Carnapping Incidents; and
• Places of commission
2. To identify common problems being encountered by
PNP along commission of unlawful act in connection with
the violation of RA No 10883 or Anti- Carnapping Law.

3. To develop programs or action plan in eliminating


carnapping cases within Legazpi City.
Assumption/Hypothesis
1. The carnapping incidents committed in Legazpi City for
CY 2019 to 2022 has been identified with the most
incidents that may have happened during the consecutive
years.

2. Problems would operate as a guide for the Legazpi City


Police Station to enact with an immediate action and
prevent cases of carnapping being committed by a person.

3. Formulation of practices that may lessen and prevent


cases of carnapping incidents being committed may be
beneficial to the community

Scope and Limitation
The researchers will be conducting the study within Legazpi City and the chosen

respondents will be composing of PNP Personnel, Public Safety Officers, Barangay

Police, and Barangay Officials of certain barangays within Legazpi City. The study will

be covering the year of 2019 to 2022 carnapping incidents that was recorded by the PNP

as it has transpired within the said area. The main source of the data to be gathered will be

a requested record of carnapping incidents and survey questionnaires which will be

validated by the research director. The conduct of study is limited to the availability

of .the data being provided by the respondents.


• This study will cover the problem of carnapping
incidents being committed within Legazpi City.
Persons not included in the study are not in line with
the law enforcement which has nothing to do with the
implementation of anti-carnapping law. The study will
be based on the gathered data on carnapping from year
2019 to 2022 within the vicinity of Legazpi City. It
excludes the other crime that does not involve motor
vehicle theft in Legazpi City. Legazpi City is known to
have the most carnapping crimes that has been
recorded in which the researchers thought significantly
about it and become the reason why they have chosen
this place as their research locale.
METHODOLOGY
Research Design
• The study will be using a quantitative
research design. It is for cases where statistical
conclusions to collect actionable insights are
essential. Numbers provide a better
perspective for making critical business
decisions. Quantitative research methods are
necessary for the growth of any organization.
Insights drawn from complex numerical data
and analysis prove to be highly effective when
making decisions about the business’s future.
Instrumentation

The researchers will use self-prepared questionnaires which will be

validated by the PNP Personneel and other people being involved in this study.

The questionnaire will be divided into three parts: Part 1 To assess the

enforcement of RA No 10883 or Anti-Carnapping Law in Legazpi City along:

Number of Carnapping Incidents and Places of commission; Part 2 To identify

common problems being encountered by PNP along commission of unlawful

act in connection with the violation of RA No 10883 or Anti- Carnapping Law;

and Part 3 To develop programs or action plan in eliminating carnapping cases

within Legazpi City.


Sampling Design

This study will be utilizing probability sampling which it is being mainly used in a

quantitative type of research. Probability sampling means that every member of the

population has a chance of being selected. Sampling is the selection of a subset of

the population of interest in a research study. In the vast majority of research

endeavours, the participation of an entire population of interest is not possible, so a

smaller group is relied upon for data collection. Sampling from the population is

often more practical and allows data to be collected faster and at a lower cost than

attempting to reach every member of the population. (Turner, D.P., 2020)
