Human Rights in Islam
Introduction
 Islam lays down some rights for man as
a human being on equal basis and in
equal manner.
 Islam emphasize on right giving and not
right taking.
 Fundamental rights are granted by Allah
and only he can snatch these rights.
 “Violations of human rights would not be
forgiven except by the concerned
people.
 Accessibility to God– no intermediary between
human and God.
“O mankind, we have created you from a male
and female and made you into tribes and
nations so that you may know one another. The
most noble of you before God is the most God-
conscious of you.” (Hujurat:49/13)
 Creator is one.
 All human beings are equal.
 Origin is one.
 Nations and tribes are for recognition only.
 God is accessible to every one.
 Right to dignity as a human being as
God’s Khalifah (deputy) on earth.
 Humans as the most noble creature.
 All creatures including the angels
prostrate to Adam.
 Human with ‘wisdom,knowledge and
free will
 Islam is compatible with international
human rights.
 True human rights can only be fully
realized under Islamic law.
Fundamental Human Rights

In constitution of Pakistan fundamental


rights are discussed under Article 8 to 28.
Some of basic rights are as bellow:-

1) Protection of freedom of faith


2) Protection of one’s life
3) Protection of one’s property
4) Protection of one’s honour
5) Protection of right to equality
6) Right to economic security

7) Right to merit

8) Right to justice

9) Right of women
Right to have faith of choice
 The Qur’an outlaws coercion on belief:
‫اَل ِإْك َر اَه ِفي الِّد يِن‬ 
“There is no coercion in religion.”(2:256)

‫ َو َلْو َش اَء َر ُّبَك َآَلَم َن َم ْن ِفي اَأْلْر ِض ُك ُّلُهْم َجِم يًع ا َأَفَأْنَت ُتْك ِرُه الَّناَس‬
‫َح َّتى َيُك وُنوا ُم ْؤ ِمِنيَن‬
If your Lord had wished, all of those on earth “
would have surely believed. Do you then
”?coerce people until they become believers
Surah Yunus:99
“Allah forbid you not, with regard to those
who fight you not for faith nor drive you out
of homes, from dealing kindly and justly
with them: for Allah loves those who are
just.” (Surah Al-Mumtahanah: 8)
“Remind them, for you are but areminder;
you are not awarder over them”
( Surah Al-Ghashia:21-22)
The Right to Life
 The first and the foremost basic right is the
right to live and respect human life.
‫ َم ْن َقَت َل َن ْف ًس ا ِبَغ ْي ِر َن ْف ٍس َأْو َفَس اٍد ِفي اَأْلْر ِض َفَك َأَّن َم ا َقَت َل الَّن اَس‬
‫َج ِم يًع ا َو َم ْن َأْح َي اَه ا َفَك َأَّن َم ا َأْح َي ا الَّن اَس َج ِم يًع ا‬
“Whosoever kills a human being without man
slaughter, or corruption on earth, it is as
though he had killed all mankind And
whoever protected it it is as if he saved the
whole mankind ... (5:32)
‫ َو اَل َت ْقُتُلوا الَّنْف َس اَّلِتي َح َّر َم ُهَّللا ِإاَّل ِباْلَح ِّق‬
 Do not kill a soul which Allah has made
sacred except through the due process of
law ... (6:151)
Right to property
The life, honor and property of all citizens in an
Islamic state are considered sacred, whether a
person is Muslim or not.
The Prophet Muhammad said: “{Truly your
blood, your property, and your honor are
inviolable.”
“O you who believe! Devour not your property
among yourselves by unlawful means, except
what you earn by trade with mutual consent.
And kill not yourselves. Allah is merciful to
you.” (Surah Al-Nisa:29)
 Every one has to right to own property
alone as well as in association with others.
 It should be legitimate’
 It should be free of Riba, corruption.
 It should not be from betting, theft,
hoarding or dishonesty.
 It should be earn through trade and other
productive economic methods like
agriculture, industry, crafts, manufacturing
and other professional services.
Right to one's honour
The Holy Prophet (SAW) told in his last sermon:
“Your lives your honour, and your property are as sacred for each other
as the sacredness of this day, in this month, and in this city. (Sahih
Muslim)
“If any one defends his brother’s honour in this world, Allah will shield
his face from the fire on the Day of Judgment. (Jamah Tirmizi)

Almighty Allah has ordained:


 ‫"َو اَل َت َج َّسُسوا‬Do not spy on one another." (49:12)

 ‫َي ا َأ ُّي َها اَّل ِذ يَن آَم ُن وا اَل َت ْد ُخ ُل وا ُبُيوًت ا َغ ْي َر ُبُيوِتُك ْم َح َّت ى َت ْس َت ْأ ِنُسوا َو ُت َس ِّل ُموا َع َل ى َأ ْه ِلَها َذ ِلُك ْم َخ ْيٌر َلُك ْم‬
"Do not enter any houses unless you are sure of their occupant's
consent." (24:27)
Rights of women
Respect for the Chastity of Women

 "Do not approach (the bounds of)


adultery" (17:32).
 Heavy punishment has been prescribed
for this crime, and the order has not
been qualified by any conditions.
Right to Equality

“ O mankind,we have created you from a


male and a female; and we have made
you into tribes and sub-tribes that you
may recognize one another. Verily, the
most honourable among you, in the sight
of Allah, is he who is the most righteous
among you. Surely, allah is all-knowing
all aware.”(Surah Al- Hujrat)
Right to Economic Security
The Right to a Basic Standard of Life
 ‫َو ِفي َأْم َو اِلِهْم َح ٌّق ِللَّساِئِل َو اْلَم ْح ُروِم‬
“And in their wealth there is acknowledged right
for the needy and destitute.” (51:19)
 Anyone who asks for help has a right in the
wealth of the Muslims; irrespective of his nation
faith or race.
 “He is not a believer who lives in luxury while his
neighbour goes hungry.” (Sahih bahqi)
Right to Merit

“Verily , Allah commands you to make over


the trusts to those entitled to them, and
that, when you judge between men, you
judge with justice, and surly excellent is
that with which Allah admonishes you!
Allah has all-hearing, All-seeing.”
Sursh Al-Nisa:58)
Right to Justice
The justice to which Islam invites her
followers is not limited only to the citizens of
their own country, or the people of their own
tribe, nation or race, or the Muslim community
as a whole, but it is meant for all the human
beings of the world.
 ‫َو اَل َيْج ِر َم َّنُك ْم َشَنآُن َقْو ٍم َأْن َص ُّد وُك ْم َع ِن اْلَم ْس ِج ِد اْلَحَر اِم َأْن َتْع َتُد وا‬
"Do not let your hatred of a people incite you
to aggression" (5:2).
 ‫َو اَل َيْج ِر َم َّنُك ْم َشَنآُن َقْو ٍم َع َلى َأاَّل َتْع ِد ُلوا اْع ِد ُلوا ُهَو َأْقَر ُب ِللَّتْقَو ى‬
"And do not let ill-will towards any folk incite
you so that you swerve from dealing justly. Be
just; that is nearest to heedfulness" (5:8).
 The Right to Co-operate and Not to Co-operate
 ‫َو َتَع اَو ُنوا َع َلى اْلِبِّر َو الَّتْقَو ى َو اَل َتَع اَو ُنوا َع َلى اِإْل ْثِم َو اْلُع ْد َو اِن‬
"Co-operate with one another for virtue and
heedfulness and do not co-operate with one
another for the purpose of vice and aggression"
(5:2).
 The man who undertakes a noble and righteous
work, irrespective race creed nation the right to
expect support and co-operation from the
Muslims.
 On the contrary he who perpetrates deeds of vice
and aggression, even if he is our closest relation
or neighbor, does not have the right to win our
support and help.
Individual's Right to Freedom

Islam has clearly declared that every man


is free and he can not be enslaved.
"There are three categories of people against
whom I shall myself be a plaintiff on the Day
of Judgment. Of these three, one is he who
enslaves a free man, then sells him and eats
this money"
Freedom Of Expression

 Islam gives the right of freedom of thought


and expression to all citizens of the
Islamic state.
 It should be used for the propagation of
virtue and truth and not for spreading evil
and wickedness.
Freedom Of Association
 Islam has also given people the right to
freedom of association and formation of
parties or organizations. This right is also
subject to certain general rules.

 The Right To Participate In The Affairs Of


State:
"And their business is (conducted) through
consultation among themselves." (42:38)
