RETURN SERVICE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Return Service Agreement is made and entered into this __th day of
___________, 20__ in the Philippines by and between:

EMPLOYER, a duly recognized Local Government Unit Department under


Caloocan City, with principal office at Caloocan City, represented by its (INSERT
POSITION OF CHD REPRESENTATIVE), (NAME OF REPRESENTATIVE), referred to
as “TRAINOR/EMPLOYER”;

-And-

(NAME OF EMPLOYEE/TRAINEE), of legal age, Filipino and residing at


(ADDRESS), referred as “TRAINEE/EMPLOYEE”.

WITNESSETH:

WHEREAS, the TRAINOR/EMPLOYER in need of improving the qualifications


of its employees, is ready, able and willing to send its employees to different trainings,
seminars, and other necessary activities (trainings), in furtherance of their employment
and skills.

In line with this, for and in consideration of the actual financial support and
other necessary expenses for the duration of the training which will be released to the
TRAINEE/EMPLOYEE upon the duration of the said trainings, the
TRAINOR/EMPLOYER shall allow the TRAINEE/EMPLOYEE to pursue such
trainings on a full-time basis, regardless if such will fall on regular working days.

The obligations of the TRAINOR/EMPLOYER are as follow:

1) Allow the TRAINEE/EMPLOYEE to pursue trainings, wherever


and whenever necessary, in support of its own institutional
development plan, and in view of improving the quality of its
services to be rendered and the skills of its personnel;
2) Provide or reimburse the required financial assistance and other
necessary expense for the trainings that the TRAINEE/EMPLOYEE
must attend;
3) Compensate the TRAINEE/EMPLOYEE for his/her day salary
should the trainings fall on working days.
4) Ensure that the TRAINEE/EMPLOYEE is properly compensated
for his/her return service, or during the duration of his/her
employment, according to the policies laid down by prevailing
rules and regulations;
5) Be in charge of monitoring the return service and inform the its
immediate superior should there be changes in the employment
status of the TRAINEE/EMPLOYEE;
6) Report immediately to the Department Head any violation of this
agreement or code of code of conduct committed by
TRAINEE/EMPLOYEE;
7) Send the Department Head a written notice affirming the
completion of the obligation to return service, so that the
department head can issue a Certificate of Completion to the
TRAINEE/EMPLOYEE and relieve him/her of all obligations
under this agreement;
8) Release TRAINEE/EMPLOYEE, at the his/her request, from
employment, upon the completion of the return service;
9) Be in charge of collecting payment obligation from the
TRAINEE/EMPLOYEE if he/she fails to fulfill the terms of the
return service and this Agreement.

The obligations of the TRAINEE/EMPLOYEE are as follow:

1) Return to the TRAINOR/EMPLOYER upon completion of each


trainings and render return service immediately up until the
expiration of the return service period;
2) Render return service to the TRAINOR/EMPLOYER in accordance
with his/her employment or job description;
3) Ensure he/she receives proper compensation, reimbursement for
expenses incurred by reason of trainings, and financial assistance
with regard to trainings attended;
4) Render return service for a period of at least three (3) years from
the date of his/her official employment, which may not be
decreased unless a stipulation to the contrary is agreed upon;
5) Seek written clearance from the Department Head prior to
traveling abroad for personal or official reasons while the return
service and this Agreement is still in force;
6) Remain employed exclusively to TRAINOR/EMPLOYER, and may
not seek employment to other entity/company regardless of the
nature of employment;
7) Pay a penalty amounting to 20,000 for every month unfulfilled on
the period of return service should he wish to terminate his/her
employment prior to the lapse of the three (3) year return service
period;
8) Reimburse the expenses incurred by TRAINOR/EMPLOYER for
his/her trainings should he/she violate any of his obligations, and
pay a penalty amounting to six (6) months gross salary should
he/she violate any of his obligations.

By virtue of the Doctrine of Exhaustion of Administrative Remedies, s or


complaints concerning this agreement shall be settled first with every available
administrative remedy prior to the filing of proper court action.
