The clarifications can be made into divining into 3 events as follows:

1. Event 1: (Initial Soil Investigation)

In this event 5 bore hole, 2 trial Pit and 2 Plate load test were done. All this test was
closely witnessed by the consultant and NEA themselves. The witness sheet is attached
herewith. And the reports were submitted to NEA and Consultant.

2. Event 2: (Stone Column Testing)

Based on the report of event 1, NEA, Consultant, Contractor were agreed for the Stone
Column for the Improving Bearing capacity and Liquefaction issues related to the site soil
condition. Two number of stone column was done in each substation. And during the testing the
SPT values were observed and witnessed by NEA and Consultant. And this time Even with Mr.
Murali, Civil Expert, Consultant. And the report was not good as we all have envisaged.

3. Event 3: (Testing at the Building corners)

After the NEA had done the conformity test from third party, we conducted the test at the 4
corners of the building at the Phutung substation. The Results were even worse than the Event 1
and did not match with the Confirmatory test done by the NEA. The witness sheet is attached
herewith. Moreover, during this test the hammer weight were also weighed and found no
significant difference.

To summarize all above events, till now we have done 11 SPT test at Phutung and 7 Test
at Mulpani substation. And our results were same and did not have any deviation. All the test
was closely witnessed by all the Stakeholders (NEA, Consultant and Employer). So the
clarification should be made by all the stakeholders not only by the contractor.

The Geological condition is much variable in both substations. The soil strata is different
at short intervals. and these case were observed and discussed with NEA and Consultant
representatives during site test.

The third party agency should be hired only if the event 1 is invalid and all the
contractor, NEA and consultant should be made responsible with the evidence. After all,
everybody had witnessed the test.

The Event 3 was Witnessed by NEA Consultant and Contractor. The result was even
worse and did not match with the test conducted by the NEA. So The NEA shall be also
responsible for the clarification for the deviation.

Conclusion:

As this contract is Design, Build type, the contractor will be solely responsible for everything.
And in addition we have done more test than we should have, therefore we have no other options but
to stick with out soil test report and propose RCC pile for bearing capacity and Stone column for
Liquefaction.
