AFFIDAVIT OF WITNESSES

I, WILFREDO A. CAGUIOA JR., 32 years old, single, Filipino and a

resident of Barangay 3, Balingasag, Misamis Oriental and PETER T.
BASLISTOY, 59 years, married, Filipino, and resident of Valencia Bohol
after having been duly sworn to in accordance with law, hereby depose
and say:

1. That we know the RESPONDENT WINDHIL CAGUIAO of this case

before the National Prosecution Service docketed as NPS NO. X-05-
INV-19K-00752;

2. That on November 23, 2019, the day of the alleged incident,

Windhil Caguiao was working as a painter in Pilar College of
Zamboanga, Zamboanga City, Zamboanga del Sur from 7am to 4pm;

3. That we lived together with Windhil Caguiao in Zamboanga City

while working as painters in Pilar College of Zamboanga,
Zamboanga City;
 4. That we attest that Windhil was in the premises of Pilar College on
the day before, on the day and the day after the alleged incident,
doing his assigned task and he could not possibly have been in
Balingasag that day. In fact, he even slept in our bunk house, all
three nights;

5. That he could not have possibly been one of the robbers of DMC
STL Payout Center in Balingasag, Misamis Oriental because it is
physically impossible for him to be in Balingasag because it takes
at least 14 hours to travel from Zamboanga City to Balingasag;

6. That we do not know the complainant Villalyn T. Evalaroza in this

case; we have never heard of her name nor met her; we do not even
know the exact location of DMC STL Payout Center; furthermore,
we do not gamble with lottery, therefore I do not know how payout
centers are run;

7. That this complaint against Windhil Caguiao is without merit, I

only interfering with his work and is intended to harass him;

8. That we are executing this affidavit to attest to the truth of the

foregoing and for the purpose of proving my innocence.
