JOINT AFFIDAVIT OF DESISTANCE

We, NESTOR G. DAYTO AND ROSALINA L. DAYTO, all of

legal ages, Filipino citizens and with residence and postal address at
Purok 6, Balogo, Sorsogon City, after having been duly sworn to an
oath in accordance with law, hereby depose and state that:

1. We are the GUARDIAN of Princess Michaella Dayto

Agoncillo, the private offended party in a statutory rape
case docketed as CRIM. CASE NO. 2020-11477C AND
CRIM. CASE NO. 2020-11476C;

2. We are no longer interested in pursuing the further

prosecution of the said case as the same merely stemmed
from misunderstanding and misapprehension of facts;

3. We have already clarified and settled our family issue and

that Princess Michaella Dayto Agoncillo has denied that
the accused raped her;

4. We are executing this affidavit voluntarily and free from any

form of coercion, threat, intimidation, compulsion or undue
influence.
