NOTICE FOR TENDERERS

1. Tenders will be received for the CONSTRUCTION OF BOH TEA BOUTIQUE HOTEL AT BOH
SUNGAI PALAS TEA CENTRE, JALAN GUNUNG BRINCHANG, BRINCHANG, CAMERON
HIGHLANDS, PAHANG. Subject to the following condition:

a) Tenders will be considered for acceptance only on the Tender Form provided
which must be submitted under seal cover bearing no identity of the sender

“The cover shall be endorsed for CONSTRUCTION OF BOH TEA BOUTIQUE


HOTEL AT BOH SUNGAI PALAS TEA CENTRE, JALAN GUNUNG BRINCHANG,
BRINCHANG, CAMERON HIGHLANDS, PAHANG.”

Tenders must be submitted to the office of THE MANAGER, PROPERTY


DEPARTMENT, JALAN BRINCHANG, BRINCHANG.

b) Tender document shall only be issues to the tenderer upon the payment in cash
of :

Non- refundable and deemed reasonable tender fee of RM100.00, and


refundable and deemed reasonable tender document deposit of RM3000.00
which will be forfeited unless all document issued, less the portion returned
herewith, the tender submission, are returned to the office which issued the
tender document before 12:00 noon on 02 May 2019.

In such event of forfeiture, the tenderer is deemed to have agreed to the


forfeiture in consideration of the privilege of keeping the documents beyond
the time fixed for its return. Mutilated or defaced documents will not be
accepted for return.

Tender document deposit of the successful tenderer will not be refunded to


defray the cost of documentation.

c) A contractor may not submit more than one tender in respect of this contract.

d) Mutilated or defaced tender forms may be rejected. Tenderer must ensure that his
tender submission including all accompanying document are firmly and
functionally intact in preferably, one piece. The employer does not hold itself
responsible for loss or misplacement or loose document.

e) The work or service, for which this tender will be received, shall be carried out in
accordance with drawing Nos. as specified together with the Agreement &
Condition of Building Contract and Specification attached thereto and such
detailed drawings and instruction as may be necessary during the Performance of
this work or service.

f) Tenderer shall state in his tender ONE SUM for thorough completion of work as
shown and described in the drawings and specification, inclusive of all
contingencies and liabilities to which he is or may become liable under the said
Drawings, Agreement & Condition of Building Contract and Specification.
- On no account is the tenderer for works allowed to insert any items or
condition of his own. The ONE SUM above should account for all terms and
condition as laid down in the drawings, Agreement & Conditions of Building
Contract and Specifications. Any clarification must be stipulated in a
covering letter and not at the back of the Tender Form or elsewhere.
- The contractor whose tender is accepted shall when required enter into a
formal contract with the Employer for the due execution of the works.
- Tender will remain open for acceptance for a period of 90 days from the day
the tender close

2. The employer does not bind itself to accept the lowest or any tender.

3. Tenderers will not be reimbursed for any expenses incurred in the preparation and
submission of the tender documents.

FORM OF TENDER

1. These instructions to tenderers in so far as they may affect the execution of the Contract
shall be deemed to form part of the condition of the contract.

2. Each tender and all accompanying document and letter must be submitted in a sealed
cover bearing no indication of the identity of the sender. The cover shall be endorsed.

Together in the submission of the tender, the contractor shall deposit a refundable
earnest money of RM 3000.00 in the form of cheque deposited with Employer (Kuala
Lumpur)

Also in the tender submission, proposed Master work program shall be submitted for
evaluation by the Architect.

3. The Employer will not defray expenses incurred in tendering and will not be bound to
accept the lowest or any tender. No reason will be assigned for the rejection of any tender.

4. Tender document shall only be issued to the tenderer upon the payment of:
a. Non-refundable Tender Fee of RM100.00, in cash upon collection of tender
document & drawing.

b. Refundable tender deposit in the form of cheque made payable to BOX DESIGN
STUDIO SDN BHD for RM 3000.00. Tender deposit for unsuccessful tender shall be
refunded and tender deposit for successful tenderer will be retained for lithography
documentation charges.

5. Tender must be made out on the Form of Tender included in the Tender Documents.
Mutilated or defaced tender form may be rejected. Tenderer must ensure that his tender
submission includes all accompanying documents are firmly attached. The employer is
not responsible for any losses or misplacement of loose documents.

6. Tenderer shall visit the site ad shall make, or cause to be made on their behalf, local
enquires concerning the availability and cost of any plant required, storage,
accommodation, labor, temporary supplies of power, water supply and access, nature
of adjacent property, nature of site, subsoil site levels, working space, etc. and obtain for
themselves on their own responsibilities all other information which may be necessary for
making a tender and entering into contract and must examine the Contract Document
ion order to ascertain the matters as to which they will be deemed to have satisfied
themselves and the risks and obligation which they are to undertake.

7. The Tenderer shall note that the Condition of Contract and the Specification are to be
strictly enforced and that no extra charges or claims in respect of extra work will be
allowed unless such extra work is clearly outside the spirit ad meaning of the scope of the
Contract and is ordered in writing and claimed for the prescribed manner and at the
prescribed time.

8. The Tenderer shall note that the prices and rates inserted in the Summary of Prices and
Schedule of Rates are to be fully inclusive of the work described under the several items
including all costs and expenses that may be required in and for the construction of the
works described, whether specifically mentioned or not, together with all general risks,
liabilities and obligation set forth or implied in the document on which the Tender is based.

9. The Tenderer (whether or not he submit a tender) shall treat the detail of the document
as private and confidential.

10. If the tender is accepted, the Tenderer shall provide a Performance Bond amounting to
5% of the Contract Sum in form of cash or banker‟s guarantee from bank established in
Malaysia for the due performance of the Contract under the term of a Bond. The Bond
shall be deposited with the Employed prior to the commencement of work. As stipulated in
Clause 37.3 (PAM Contract 2006). The Performance Bond shall remain valid until three
(3) Months after the Completion Date. Where the Works would not be completed the
Completion Date, the Contractor shall before the expiry of the Performance Bond, extend
the duration of the Performance Bond to expire three (3) Months after the projected
Practical Completion of the Works.

11. If the Contractor fails to provide or maintain the validity of the Performance Bond in
accordance with the clause 37.3 (PAM Contract 2006), then without prejudice to any
other right and remedies which the Employer may possess, the Employer shall be entitled
to withhold or deduct an amount equal to the performance Bond from any payment
due or to become due to the Contractor as stipulated in Clause 37.4 (PAM Contract
2006)

12. The accepted approved Tenderer (if any) shall be notified of such acceptance by letter
before the expiry of the validity period. The said Tenderer shall within seven (7)days from
posting, or deliver if by hand, of notification of acceptance, deposit the Performance
Bond and Insurance Policies for Contractor –All- Risk and Workmen „s Compensation with
the Employer and shall produce fir inspections receipts of premiums paid for the
insurances. All insurances shall be deposited with Esther EHP Bhd.

13. As stipulated in Clause 33.1 (PAM Contract 2006). All fossils, antiquities and other object
of interest or value which may be found on the site or in excavating the same during the
progress of the works shall become the property of the Employer.

14. The tender of any Tenderer who had not complied with the foregoing instruction may be
rejected.

15. Tenders shall remain valid for 90 days from being closing date for the submission of
tender and no Tenderers may withdraw his tender within this period.

16. Under and subject to the Condition of tendering annexed hereto, the undersigned does
hereby tender and offer to execute, complete and maintain the works and supply all labor
and materials and everything named, shown, described and alluded to in, or to be inferred
from, the PAM FORM OF CONTRACT AGREEMENT (without quantities) Conditions of
contract or, for the works as above described, in conformity with the said Specification
and Drawing and under subject to the said Condition of Contract for the lump sum named
herein below.

17. The undersigned agrees to be bound by and submit to the said Condition of the
Contract and Specification and agrees that the priced Rates in Summary of Prices set
down therein by the undersigned have been scrutinized and agreed to by the Architect
as being reasonable, as by the Conditions of Contract provided, shall form a basis for the
valuation of interim certificates and any deduction variation or extra work which may
from time to time ordered by the architect.

18. And further, the undersigned agreed to complete the works within a period of 8 months
(Period to be proposed by tenderer) weeks from the Date of Possession of site or within
such extended time as by the Condition of Contract provided.

19. The total amount offered in this tender is the lump sum of Malaysian Ringgit:
Nine hundred and Seventy Four Thousand Nine Hundred Seventy Seven and Thirty Cents
Only (RM 974,977.30).

20. Whereas it is understood that you reserve to yourself the right to accept or to refuse the
tender, whether it is lower or higher than any other tender, or of the same amount, the
undersigned agrees that this tender shall remain valid and shall not be withdrawn within
ninety (90) days from the final date for submission of tenders.

21. And further, the undersigned agrees, in the event of your acceptance of this tender, to
execute the formal Contract Agreement and to furnish the Performance Bond, the
Workmen‟s Compensation and SOCSO Code No, Contractor All Risk Insurance Policies
and Produce the receipts for premium paid, for inspection within fourteen (14) days from
notification of acceptance.

22. The undersigned confirms, after personal scrutiny, that the document and drawings used
by the undersigned in compiling this tender are true copies of the document and drawing
included in the Tender Table Documents.

23. We understand that you are not obliged to accept the lowest or any tender received.

24. Unless and until a formal agreement is prepared and executed, this tender together with
the “Letter of Acceptance” of tender thereof, shall constitute a binding contract
between us (Employs and main contracts).

CONDITIONS TO TENDERING

1. SCOPE OF WORK
The works to be constructed, completed and maintained under this Contract consists
of construction of proposed building as shown and detailed on drawings and
specification herein & any other works incidental to and necessary for the satisfactory
completion of the intended works.

2. CONTRACT COMPLETION PERIOD


The contractor„s attention is drawn to the fact that the whole of works inclusive of
provisional items, embraced in this contract, must be completed within the time
stipulated in the “Appendix” from the date of possession of site to the date when the
completed works are handed over to the EMPLOYER in the condition fit for the whole
of the scheme to be put into use immediately.
The time of completion shall include Sunday, public holidays, inclement weather days
and customary festive holidays.

3. LOCATION OF SITE
The site of the work is located on Boh Sungai Palas Tea Centre, Jalan Gunung
Brinchang, Brinchang, Cameron Highlands, Pahang.

4. NATURE OF CONTRACT
This contract is a firm lump sum contract. Fluctuation in the price of material, fuel,
wages, plants, labor, government duties, etc. in connection with this contract will not
be entertained.

5. TENDERING PARTICULARS
(a) The rates set down by the tenderer, shall be held to include for providing and
delivering all materials, unloading, cutting and waste on materials, storage,
packing carriage and cartage, hoisting, all labor setting, fitting in position, use of
plant, scaffolding, trestles, supervision, establishment charges, profit and all other
labor and everything else necessary for the due and proper completion of each
item.

(b) No alteration shall be made by the tenderer to the clauses or items in the tender
document. The printed text will be rigidly adhered to and items or clauses must
be priced as described.

(c) Where the contractor leaves any item blank or inserts only a dash against any
items in the tender document the value thereof shall be deemed to be included in
the prices or rates of other items therein.

(d) The contractor is particularly requested to check all dimension shown or figured
on the drawing and obtained his own information on all matter s which may in any
way affect his tender as no claim for extras for any alleged ignorance in respect
thereof shall be entertained.

(e) The contractor shall be hold to have understood fully all matters concerning the
work to be carried out under this contract. Any queries must be settled with the
architect prior to the submission of the tender. No consideration shall be given to
any query raised by the contractor indication lack of comprehension of the work
to be done or material to be supplied after the acceptance of the successful
tender.

6. TENDERER AND TENDER DOCUMENT


The tender is to be “Lump Sum” for carrying out the whole week in accordance with
the drawings, condition of contract and specification. The contractor shall have
included in his tendered amount for the cost of al incidentals of preliminaries, plant,
labor materials, supervision, profit and all other things and matters necessary for the
proper execution of this contract. No re-measurement will be done for work actually
carried out expect as indicated. The contractor is advised to do his own calculation
to determine the actual amount of the work required when he prepares the tender.

7. DISCREPANCIES BETWEEN DOCUMENT


The contractor shall, before tendering and during the progress of the work, refer to
the Architect any discrepancies found in or between the Specification and the
Drawing or instruction issued.

8. DRAWINGS
The list of contract drawing is as shown in the list of drawing.

9. TEMPORARY ACCESS
The contractor shall provide and maintain the necessary temporary roads, sleeper
tracks, ramps, temporary cross over and bridges if necessary to and within the site etc.
and temporary site drainage as required during the execution of the work, and clear
away same at completion, and reinstate and make good any works disturbed all to
the satisfaction of the Architect. The contractor shall pay all charges and fees in
connection therewith.

10. VISIT TO SITE


The contractor must visit the site if the works and shall by independent inquiry and
observation ascertain the following in connection with the works before tendering:

(a) The nature, character and extent of the works


(b) Local condition
(c) The means of access to and from and within the site of the works
(d) The extent of working space available
(e) The condition affecting labor and materials
(f) The condition affecting the positioning of sheds, stores, site offices, temporary
building and plants.
(g) The location of all primary service, including electric cables, water mains,
telephone services, storm and soil water drain and sewers in or above ground.
(h) The nearest points from which electricity, water and other like temporary service
can be connected.
(i) The character of the soil or strata and the nature of subsoil upon which the works
are to be executed, tenderer are to bore trial holes at their own expenses if deem
it necessary.
(j) All other information which may in any way to relevant or necessary to enable the
contractor to estimate accurately the cost of the works.
No claims made on the ground of failure to visit the site and / or of want of any of
the aforesaid matters or other like information which might financially effect the
contract, will be considered.
I. There are no special stipulated regarding working hours.
II. Allowing for complying with any current registration or regulation
regarding working conditions, working hours or rates or payment to
employees and accept the risk of any impending legislation or other
conditions which alters any obligation or imposes new obligations.
III. Allow for all bonus payments or other incentive payment schemes which
he Contractor deem necessary to complete the work in time.
IV. Allow for overtime payment if the Contractor considers that it may become
necessary to carry out overtime work I order to complete the contract by
the date of completion.
V. No claim in respect of any of the above and other cost in connection
thereto will be entertained.

11. PLANT, TOOLS, VEHICLES ETC


(a) Allow for providing all necessary mechanical equipment, tools, implements,
ladders, hoist, cranes, plants, tarpaulins and other articles necessary for the
proper and efficient execution and completion of the work; also erect, alter if
necessary, and maintain all necessary screen, gates, foot ways, gangways,
hoardings, fans, temporary enclosures, barriers, gantries etc. to the satisfaction of
the Engineer; and remove at completion and make good all works disturbs after
removal.

(b) Allow for erecting and maintain all necessary scaffolding, staging, shoring and
strutting that may be required and remove at completion and make good all works
disturbed after removal.

(c) Allow for cost of mobilization and demobilization of all labor and machinery, plant
and equipment etc.

12. TEMPORARY BUILDINGS


I. Allow for the provision, erection, maintenance and removal of all necessary
temporary stores, sheds, mess rooms, and etc. in accordance with the
Contractor‟s own or the Local Authorities‟ requirements and to the Architect‟s
approval.

Allow for the provision, erection, maintain and removal of all necessary
latrines for the use of site staff and labor employed upon the works and at
places approved by Architect. The latrines are to be constructed to comply
with requirement of the local health authority.

Allow for moving any or all of the above as required by the progress of the
works and for re-erecting and maintaining same as described above
throughout the contract period.

All temporary buildings shall be constructed to a design approved by the


Architect and in accordance with the requirements of the local tenderer.

II. The site office will be use jointly by consultants / contractor/ sub- contractor/
client. The tenderer will provide their own office furniture. The installation of
temporary electricity and water supply for the site office will be provided by
the tenderer. The charges for the monthly electricity and water consumed will
be paid solely by the tenderer.

13. NOTICES AND FEES


Allowing for cost of complying with and giving notices required by any Act or
Ordinance of Government, Regulation and by laws of any local Authority and paying
all fees and charges legally demand able.

14. SETTING OUT


Allowing for accurately performing all setting out, and providing all instruments,
templates, rods and setting out boards, etc as may be necessary for his purpose and
where required, maintain these for reference during the progress of the works. Any
error in setting out shall be made good at the Contractor‟s own expenses and to the
satisfaction of the Architect.

The contractor shall be fully responsible for the correct and accurate setting out of all
elevation, position, dimensions, alignments, profiles etc. of all parts of the works based
on the information supplied by the Architect. The setting must be carried out by a
competent licensed surveyor. If during the construction or maintain of the works, any
error is discovered in the positions, levels, dimensions, alignments profiles etc. in any
part of the works due to Contractor‟s error, the Contractor shall at his own cost,
rectify such error to the satisfaction of the architect. Construction shall not commence
until the setting out has been checked and approved by architect onsite.

15. EXISTING SERVICES


The contractor shall make all necessary inquires to ascertain the position of
underground services, including electricity and telephone cables, drains, water supply
pipes, sewers etc. any such information given on drawing or by the Architect is given
as a guide only and does not relieve the Contractor of the responsibility of making his
own inquiries.

The contractor shall uphold, protect, and maintain or divert all existing drain, sewers,
water mains, electric and telephone cables and other property of a like nature and
make good or pay for making good damage thereto and any consequential
damage or loss arising out of such damage.

16. FOREMEN
The contractor shall provide full and adequate site management and supervision
during the progress of the works, shall keep one or more competent authorized site
agents or general foremen, approval by architect, on the site. Such agents or
general foremen shall give his whole time to the supervision and management of the
works, and must be able to receive and act on behalf of the contractor, all
instruction, direction or orders issued by the architecture or his representatives.

17. PROTECTION OF PUBLIC PROPERTY


(a) Allowing for maintaining and protecting all public property and road and for
making good of or paying all damage thereto.
(b) It will be the contractor‟s responsibility to ensure that the rods leading to and
round the site are kept free from obstruction brought about by the works on this
site and in no way shall he cause any hindrance to traffic o ancillary works either
by his own vehicles, or by his work people, material etc.

18. ARTISTS OF TRADEMEM NOT SUB- CONTRACTORS


Allow for permitting the execution of works by Artists or Tradesmen who are not
nominated Sub contractors and who may be engaged by the Employer and
providing all reasonable opportunity and facilities to the artist or tradesmen for
carrying out their works such as the reasonable use of any scaffolding or staging
erected by the contractor for his own use.

19. INSURANCE AND LIABILITY FOR DAMAGE

(1) Contractor all risk insurance

(a) Physical damage to contractor works, plant and equipment and material
onsite. The contractor shall insure against all risks of loss or damage by fire and
/or accidental external means including Act of God, all works and building
constructed or in the course of construction in pursuance of or for the
purposes of this contract and all materials and other things delivered on to the
site and approved by architect and ready for incorporation in such works and
buildings and shall keep the same insured until such work, buildings and other
things respectively are handed over to the Employer and shall continue to
insure until the satisfactory performance of the contract on expiry of the
stipulated defect liability period.
The contractor shall insure:
01. The contract works for an amount not less than the contract sum
02. Removal of debris at 10% of contract sum.

(b) Liability for injury and property damage to third party (ies)
The contractor shall effect insurance to indemnify the employee in respect of
any liability, loss, claim or proceeding whatsoever whether arising at common
law or by statue in respect of personal injuries to or death of nay person
whomsoever, losses and / or damages to his properties arising out of or in the
course of or caused by the execution of the works due to any act or neglect
of the contractor, the employer and the architect, their servants or
representatives.

(c) The policy shall have the following endorsement:


01. Strike, riot and civil commotion clause
02. Cross liability clause
03. Vibration and /or removal or weakening of support
04. Extend maintain clause
05. Rectification cost for defective design, material and / or workmanship
extension and
06. Consultants as third parties clause
07. Overtime, night work, work on public holidays, express freight
extension
08. Cessation of work

(d) Any excess or deductible under the policy (ies) shall be for the sole account of
the contractor. The employer and the contractor shall not be called upon to
contribute to such policy excess or deductible.
(e) The policy (ies) shall be taken out in the joint names of the Employer, the
contractor, all consultants and all nominated sub- contractors.

(2) Workmen‟s compensation insurance


The contractor shall also take out such insurance policy or policy in the joint name
of the employer and the contractor indemnifying the contractor and the employer
from all liabilities arising out of claims by any workmen employed in this contract
for payment of compensation under workmen‟s compensation registration or any
other law amending or replacing such legislation and from all costs and expenses
incidental or consequential thereto
For the purpose of this contract the amount to be insured shall not be less than
29% of the contract sum less any provisional prime cost sums.
The policy shall be endorsed to endorse employees of sub-contractors and non-
workmen within the meaning of the workmen compensation ordinance.

(3) General requirements


(a) The said policies so taken out shall be deposited with the architect and the
contractor shall maintain it or them in full force and effect by payment of all
premium from time to time on the first day in which the same ought to be paid
and until the completion of the contract and upon demand the contractor
shall produce to the architect before the commencement of any work
included in the contract.
(b) The contract or will be required to produce all polices and receipts for
premium paid in respect of all insurance for the inspection of the architect
before the commencement of any work included in the contract.
(c) If any default is made by the contractor in complying with the terms of this
clause the architect may without prejudice to any other remedy available to
employer for breach of any term of this contract withhold all payment which
would otherwise be due to the contractor under this contract and out of such
monies so withhold satisfy any claims for compensation by workmen that
would have been borne by an insurance company had the contactor not
made default in maintaining a policy of insurance and / or pay such
premiums as have become due to the contractor.

(d) In case of failure by the contractor to effect or renew such insurance the
architect may himself effect or renew such insurance and pay the premium in
respect thereof and deduct the amount so expended from any monies due
or to become due to the contractor.
(e) Nothing in this clause shall be construed to take away or to waive or in any
manner to modify the right of the employer to be indemnified by the
contractor in respect of all compensation, costs and other expenses
whatsoever which by reason of the contractor‟s default or otherwise become
payable by the employer under the said registration or other law.
(f) For the purpose of the contract, the contractor shall effect all the above
insurance to coincide with the contract period including defects liability period.
At the request of the architect, the contractor shall extend the insurance for
further period in compliance with contract condition.
(g) All insurance policies shall be effected with a company approved by the
employer.

20. SURETY BOND


Allow for the cost of obtaining the guarantee of a bank or insurance company
approved by the architect, to be jointly and severally bound with you in the sum stated
in the Appendix to the condition of contract for the due performance of this contract.

21. WATCHING
Allowing for keeping efficient watchmen on the works day and night and for providing
all necessary lighting, guard, barrier and all other safeguards for the prevention of fire,
accidents, theft and losses.

22. TEMPORARY LIGHTING AND POWER


Allowing for supplying all temporary lighting and power facilities necessary for the
carrying out of the work. Supply and fix all temporary cables, wiring and accessories
required, remove on completion and make good all work disturbed.

23. PROTECTION
Allow for the protection of all works from inclement weather and any other
circumstances which could cause damage.
Allow for the protection of all finished works from damage from any cause whatsoever
and accept responsibility for any damage caused and make good at his own
expense.

24. TREASURE TROVE, COINS ETC


Any treasure trove, coin and object of antiquity shall become the property of the
owner and shall be carefully removed by the contractor and handed to the
architect.

25. VARIATION
No variation or extras shall be held valid unless authorized in writing by the architect.
This clause shall be strictly enforced and it shall be the responsibility of the contractor
to inform the architect in writing of any variations or extras not so recorded. Allow for
all costs involved in the preparation of variation orders. Should the architect instruct
to omit any item or section of the works in whole or in part, the contractor shall not
payment of fees and charges.

26. WATER FOR THE WORKS


Allow for the provision of all water for the works, the erection and removal of
temporary plumbing and storage, and the payment of all fees and charges.

27. REMOVAL OF RUBBISH


Allow for the cost of removing rubbish etc. at frequent intervals during the progress of
the work as required by relevant authority or as instructed by the architect.
Allow for the cost of keeping every part of the work in a clean, sound and perfect
condition fee from all flaws, cracks and settlement whatsoever at completion of work.
The contractor shall on completion of the works clear away all surplus material from
site and leave the whole site clean and to satisfaction of the architect.

28. PROVISIONAL QUANTITIES


Where quantities are noted as provisional, these quantities will be subject to re
measurement, the provisional quantities will be deducted from the contract sum and
the premeasured quantities will be added back and priced at the rate inserted
against the provisional quantities.

29. SIGNS AND NOTICES


Allow for providing, erecting and maintaining one sign board of approved size
constructed and painted to details supplied by architect (if any). The names of the
projects, Employer and the various consultants, etc. shall be written on the surface.
Allow for providing and erecting such “danger”, “warning” and “directional” board
and safety notices as are required and directed during the progress of work. No other
sign or advertisement lighted shall be displayed without the prior written consent of
the architect. The sign board shall be properly lighted at night time.

30. MONTHLY REPORT AND PHOTOGRAPHS


The contractor shall furnish in writing to the architect a monthly report of the job
progress on item such as report in number of work people employed on the works in
each trade, etc and the different types of plants used on site.
The contractor shall allow for the cost of providing two set of monthly progress
photograph of colored postcard size prints consisting of two copies per set giving a
representative view taken from the same points each month or as directed to indicate
the progress of the works.

All photography is to be taken from position to be nominated by the architect. Each


photography is to be dated and marked with the description of the photography
and location from which taken.

The ownership and copy write of all photographs and negatives shall be vested with
the employer and are not to be used without their permission.

31. SAFETY
The contractor shall be responsible for carrying out the whole of the works, provisions
and requirements of the contract or seeing to that they are carried out by all
concerned, in a thoroughly safe ad satisfactory manner, and in particular shall:

(a) Strictly conform to the requirement of any bye-laws, regulations, order ad advices
relating to the safety of persons on or about the site, made by any public authority
and government having jurisdiction in the matter.
(b) Ensure that all tackle, gear, staging, scaffoldings, ladders, machines, winding,
arrangement‟s and other equipment used in connection with the works shall
conform to the requirements of any Government regulation in relation thereto
and in any case be adequately strong and safe to use. Immediately
discontinue any practice or remove any equipment which becomes or is likely to
become dangerous or unsafe.
(c) Provide safety helmet and harness for use by consultants and workers.
(d) Remove promptly from the works any employee or representative who by his
conduct could create any dangerous or nuisance to himself or others.
(e) A complete first aid kit shall be kept and the site.

32. PROGRAMME AND PROGRESS CHARTS


Allowing for providing within two weeks of instruction to commence operation and in
agreement with architect, a programmer and progress chart of the whole of the works.
Two copies of the programmer and progress chart shall be forwarded to the architect.
Further copies shall be retained on the site and he kept up to date by the contractor.
This chart shall be modified as necessary and the architect shall be informed should
any circumstances arise affecting its validity.

33. LIABILITY FOR BUISANCE ETC


It shall be clearly and definitely understand by the contractor that he shall be entirely
wholly take upon himself and every risk and responsibility and carrying out the works
and be held responsible during the progress of the contract for any damage,
accident, annoyance, nuisance or disturbance that maybe occasioned to existing
premises, residents and users and to the adjoining properties, persons and things by
any of the operation arising from the carrying out of the this contract.

The contractor shall be responsible for restricting his workmen only of the site of the
new works, and shall prevent trespass into adjoining property ad existing building ion
which work is not in progress and he shall undertake properly substantially and
effectively to reinstate and make goof all damages and shall indemnify the employer
against all claim for damages as no responsibility or liability whatsoever shall be
undertaken by the employer in respect of any if the foregoing.

34. PREVENTION OF SPOIL DUMPING


The contractor shall take all reasonable steps to prevent executed spoil, rubbish
surplus materials, etc. arising from the works being dumped on area other than a
recognized tipping area. Should it be shown to the satisfaction of the architect, that
any excavated spoil, rubbish, surplus material, etc. have been deposited elsewhere
than at a recognized tipping area, the contractor will be held responsible for
cleaning such deposit at his own cost and ensuring that they are placed in a
recognized tipping area.

35. CUSTOM IMPORT DUTIES


The contractor shall pay all custom duties, sales tax etc. payable in respect of any
materials, plant or any other things imported into Sarawak by him for the purpose of
the contract and is to make all entries and pay all other fee and stamp duties in
connection therewith.
No exemption from duty shall be granted in respect of plant etc. imported for the
work.

36. PUMPING AND DRAINAGE


Remove all water and mud resulting from any source and which may accumulate on
the site from time to time by providing sufficient drainage and/ or pumping systems
to the architect‟s approval. The site shall be maintained in a dry condition by the
contractor at all times at his own expenses.

37. POSSESSION OF SITE


In giving the contractor possession of the site, it shall not to be deemed that he is to
have extensive possession but only a limited possession. Such possession will enable
him to perform the works composed in his contract. The employer may at any time
taken possession of any portion of the ground or intended site of the work for the
purpose of carrying on any other work, or for any purpose whatsoever. The site may
be handed over in part but without any compensation.

38. CO-ORDINATION
The contractor is responsible for the proper co-ordination, direction and supervision
for all the works of the contract. For this purpose he shall provide all necessary to
ensure close detailed and competent supervision of all part of the works.

39. CONTINUES WORKING


If , in opinion of the architect, it is deemed necessary, by reason of the safety of the
works, or for the restoration of interrupted service or for any reason whatsoever, the
contractor shall when so ordered, carry out the works or any portion thereof
continuously by day and night without extra charge.

40. SITE LEEVLS


Before submitting his tender, the contractor shall ascertain the existing ground levels
on the construction site his own expenses for the purpose of computing his
earthworks quantities. Contours and levels shown at indicated intervals on the
drawing provided are for the information of the Contractor only and shall not take to
present the true ground levels of the site. No claim will be entertained if actual ground
levels are higher or lower than the contour levels indicated on drawings.

41. DIMENSIONS
Written dimensions are to be preferred in every case to scaled dimensions. All scaled
dimensions may only be used after confirmation by the architect.

42. ENTIRELY OF CONTRACT


Any matter of construction and workmanship which are fairly and obviously intended,
but may not have been definitely referred to in the specification or drawing but are
usual in sound earthwork practice and essential to the works concerned are to be
considered as included in the contract.

43. TEMPORARY DRAINS AND CULVERTS


The contractor shall construct and maintain such temporary drain and culverts as are
necessary to effect complete drainage if the site at all time. The condition of
satisfactory drainage shall be at the discretion of the architect. The proposed location
of temporary drain and culverts shall be submitted to the architect before their
construction begins, and his direction on their sizes, location, type of obstructed prior
to the construction of the temporary drain and culverts. Any obstruction present in
drain, channel etc. shall be removed promptly.

44. CONVEYANCE OF PLANT AND MATERIAL INTO SITE


The contractor shall arrange for the conveyance of material and plant etc so as to
cause a minimum of damage to existing roads and culverts etc. the contractor shall
be responsible for any damage caused by his lorries or workmen to any existing roads,
culverts, etc. from whatsoever cause arising and shall maintain, repair, and reinstate
same to their original condition to the satisfaction of the architect or alternatively
shall bear the cost of such maintenance and restoration as a deduction from any
money due or become due to the contractor under this contract. The contractor shall
be responsible at all times for keeping roads immediately adjacent to the site of the
works free from mud, dirt, rubbish, etc, arising on put off or in the course of or by
reason of the execution of the works and for the observance of any by law or
regulation imposed by the relevant authorities requiring roads to keep free from mud,
dirt and rubbish, etc.

45. BENCH MARKS


The contractor shall carefully protect and preserve all the topographical bench marks,
pegs and other objects so designated by the architect. If any of the bench marks is
disturbed or is thought to be disturbed, this bench mark will be surveyed and, if
necessary, re-established and all costs involved will be borne by the contractor.

46. ASSITANT TO ARCHITYECT AND HIS PRESENTATIVE


The contractor shall carefully provide the architecture or his representative with such
facilities and assistance as the architecture his representative may require in taking
levels, checking dimensions, examining work, testing and inspecting materials and
workmanship and otherwise watching and supervising the works and execution.

47. PERIOD OF MAINTENANCE AND DEFECT LIABILITY PERIOD


The period of maintenance will be as per “Appendix” commencing from the date
that the Architect certifies that the works have been practically completed. All works
and maintenance and repair will be referred to the contractor in writing from time to
time by the Architect.

The contractor is to note that during the period of maintenance the Employer can
occupy the filled/ excavated land and carry out construction works with any type of
equipment.

48. DEFAULT IN PAYMENT OF WAGES TO WORK PEOPLE


In the event of default being made in the payment of any money in respect of
wages of any work people employed by the contractor in and for the performance
of this contract, and if a claim therefore is filed in an office of the department of
labor and proof thereof is furnished to the satisfaction of an officer of the said
department, the employer may, failing the payment of the said money by the
contractor, make payment of such claim to the Commissioner for labor
representative out of any monies at any time due to the contractor under any by
virtue of this contract.

49. EXPLOSIVES
In the event of explosives being used under any part of this contract, the contractor
shall obtain himself with the necessary permit or license from the appropriate
authority and shall abide by all Government regulation instruction relating to the
transport, handling, transport and use of explosives.

The contract shall be liable for any accident, damage or injury to any person or
property resulting from the use of explosives. When necessary the Contractor shall
display warming sign and flags and shall in all cases a warning to be sounded prior to
firing. The contractor should determine, during tendering whether any explosive or
pneumatic tools are required for the successful carrying out of the work. If through his
investigation and found that the above procedures are necessary, he must allow
extra expenses in the tender.

50. PROVISIONAL SUM


Provisional sums have been allowed in this contract for additional works to be
expended as and when directed by the architect. The said sum shall be deducted
from the contract amount without allowing any profit to the contract when the sum is
not utilized.

51. COMPLETION DRAWING


On completion of the works the contractor shall engage licensed land surveyor to
prepare drawings showing the finished levels of the whole site to the architect before
the certificate that works have been practically completed.

52. DAYS AND TIMES OF WORK


Normal working hours shall be within the period 8:00 am to 5:00 pm Monday to
Sunday inclusive. No work shall be carried out on any Sunday or prescribed Public
Holidays or outside normal working houses on any day without the permission of the
Architect. Except in extraordinary circumstances such permission will be granted only
in relation to plant maintenance or similar works not forming part of permanent works,
and not requiring supervision by the Employer or Architect. The Contractor shall give
not less than four days‟ notice to carry outside normal working hours and the
Architecture‟s decision as to whether work may so proceed shall be binding and not
subject to appeal.

In the event that the Architect approval is obtained for works forming part of the
permanent works outside normal working hour, and requiring supervision by the
Architect/ Engineer, the Contractor will be required to reimburse the reimburse the
Employer for the overtime expenses incurred for such supervision. The days of receipt of
overtime expenses billed by the Employer. Falling to do so, the employer may deduct
from money due or to become due to the Contractor under this Contract.

53. GENERAL CONDITION


The condition of contract will be the Agreement and Condition of Building contract,
edition 1998 (private edition without quantities), where quantities do not form part of
the contract, as produced by the Pertubuhan Akitech Malaysia.

54. SCHEDULE OF CONTRACT CONDITIONS


The contractor is referred to the full text of the under mentioned clauses of the
condition of contract which accompany this document, and he shall allow here or in
his rates for all expenses involved in complying with the term of these clauses. This
schedule is to be read in conjunction with the relevant clauses as contained in other
sections of the preliminaries.

Note:

a) All information regarding the site have been provided in good faith and the contactor is
to refer to the site plan in relation to the actual site for the exact location, dimensions,
areas of site and any other information relevant to his tender.

b) Every effort has been made to ensure the reliability of the information shown on drawing
but the contractor shall be deemed to have considered this information critically during
the preparation of his tender and has carried out such further investigation and test on
site as he considers necessary.

c) The group levels shown on the drawings are based on recent ground survey. The
contractor shall be deemed to have checked the accuracy of the levels shown on the
drawings and to have made allowance in his tender for the effect („other than upon
quantities measured in accordance with the contract) or discrepancies between the
various drawings and of variations which may have taken place or may take place after
those levels were determined. The contractor shall be entitled to additional rates of
payment on ground of inaccuracy of the ground or other levels shown on the drawings.

d) The contractor shall apprise himself of all difficulties of working due to the nature of the
site. He shall appraise himself of the type of material to be excavated, obstruction to be
demolished and anything else likely to affect the cost and shall include in his tender sum.

e) The contractor shall be deemed to be taken all possible weather condition into account
when preparing his tender and shall not be entitled to extra payments by reason of the
occurrence or effect of excessive rainfall, tidal water, high winds or any other
meteorological phenomena.

f) The contractor shall be deemed to have fully acquainted himself with the requirements
of the Local Authorities which may in any way hinder his work.

g) The contractor shall be absolutely and solely responsible for the method employed in
carrying out the works and for the safety and security of all temporary works and
constructional plant not withstanding any examination by the Architect/ Engineer or their
representatives.

Note:

The contractor‟s particular attention is drawn to the fact that this tender is a lump sum fixed
price tender and his tender sum is to allow for all condition affecting the cost of the works. All
tenderers are required to fill in the rates as indicated in this schedule. The rates inserted here
in will be used for ascertaining the prices of variation under this contract. Tenderers who do not
fill in the schedule of rates will not be considered for this tender and their tender submission
will be rejected.

In pricing of execution for trenches, the contractor is to allow for the additional depth and
width in trench excavation, including subsequent backfilling as specified, that he considers
necessary for joining work, or for the installation of valves, etc. all trenches are to be kept free
from water at all times.

Where the terms “as described” or “as specified” occur, they shall mean as described or
specified in these specification. The contractor‟s attention is drawn to the requirements to
setting out of pipe lines including the provision of pegs, sight rails, bonding rods, etc and
facilities for checking by the architect.

The contractor is to note that fitting for all types of pipes are not measured separately. The
rates to be inserted by the contractor for pipes are to include for all fitting, bends, elbows,
tees, junctions, sockets, collars, connectors, brackets. Straps, flanged ends, nuts, drops,
offsets, reducers. Inspection eye pipe pieces (disc seal inspection pipe), short lengths, back
nuts, plugs or stopper and the like. Rates for pipe are also to include cost of preparation of
ends of pipes before jointing, cost of inspection and testing pipes and as well as cost of
jointing materials, equipment, labor.

SPECIFICATION (PREAMBLES)

1. GENERAL

1.1 The quantity of work to be executed under this Contract shall, for the purpose of Tendering,
be deemed to be that stated in the Bills of Quantities and shall be the basis of the Contract
Sum.

1.2 Each item shall have a separate rate or price and extension set against it. Items against
which no price is entered shall be considered as covered by other prices and rates in the Bills
of Quantities.

1.3 The Bills of Quantities shall be read in conjunction with the Conditions of Contract, the
Specification, the Drawings and such other relevant documents forming part of the
Contract. The rates and prices entered in the Bills of Quantities shall provide for compliance
with all the provisions of the said Conditions.

1.4 Pricing

1.4.1 The rates inserted in the Bills of Quantities shall be firm and not subject to fluctuation or any
other factor throughout the entire tenure of the contract.

Unless otherwise specifically stated in the Bills of Quantities, rates shall include everything
necessary to complete the work as described and in accordance with the Contract
Documents including:

a) labour and supervision, including all on-costs such as but not restricted to:

i. overtime and non-productive time


ii. incentive and bonus payment
iii. traveling time and expenses
iv. annual and public holidays
v. disbursements arising from Employment, Health, Safety or Welfare Laws
and Regulations

i. manufacture expenditure
ii. customs and Excise duty
iii. packaging
iv. loading and unloading
v. handling
vi. transport and cartage

c) cost of mechanical and non-mechanical plant, equipment and tools including operator,
fuel, oil, maintenance and all other costs in connection therewith

d) taking delivery of materials, assisting in unloading, handling including double handling


where required, storage on site or off site, paying all storage costs, protecting, returning
packaging, assembling, hoisting, cutting, fitting and fixing materials in final position and
for all sundry materials for fixing such as adhesives, bedding materials, grouting materials,
jointing materials, sealants, bolts, nails, screws and ties and for painting and finishing as
described in the Bills of Quantities.

e) Breakage and wastage

1.4.2 Rates for all work shall also include:

a) all temporary work as necessary and its subsequent removal including scaffolding,
staging, supports, protective screens, other protection measures and the like

b) all permanent work as necessary in supports, fixings and the like, whether shown on
drawings, specified or otherwise required to properly complete the work

c) design to the extent required by the Contract Documents

d) setting out

e) working in confined spaces

f) giving all necessary notices to, and taking all other necessary action in respect of,
government departments, local authorities, utility companies and other bodies having
jurisdiction over the Works

h) testing as specified or required including the supply of additional materials and samples
for testing

i) samples, mock ups, prototypes, quality benchmarks and other benchmarks as specified
or required

j) shop drawings and other drawings, calculations, literature and documents as specified
or required

k) providing warranties, guarantees and the like as required by the Contract Documents

l) spares and replacements as required by the Contract Documents

m) additional fire and smoke stopping measures as set out in the Specification and as
required by local authorities, Bomba and other bodies having jurisdiction over the Works

n) complying with acoustic requirements of the Specification and other Contract


Documents including providing additional works as necessary

o) forming access panels as required

p) training the Employer‟s or User‟s personnel as required by the Contract Documents

q) carrying out work in accordance with the requirements of the Specification including,
inter alia, all fixings, all ancillary materials, goods and accessories and all additional
labours and other work.

1.4.3 Where work is wholly or partly Contractor design the rates shall include:

a) the production of all necessary design information to the approval of the Superintending
Officer including design drawings, working drawings, structural calculations and all other
information necessary to evaluate the Contractor‟s design

b) obtaining endorsements from professionally qualified engineer, architects or other design


professionals and paying all fees

c) incorporating any design revisions required by the Superintending Officer

1.4.4 Where work is specified by, or referred to, a manufacturer or proprietary product the rates
shall include for carrying out the work in accordance with the manufacturer‟s
recommendations, including all accessories, unless described otherwise

The rates shall be inclusive of all ancillary work and expenditure whether separately or
specifically mentioned or described in the Contract Documents or not, which are either
indispensably necessary to carry out and bring to completion the Works, or which may
contingently become necessary to overcome difficulties before completion.

Items shall be realistically priced. The Contractor shall substantiate any rates required by the
S.O., prior to the signing of the Contract. Failing which, he will be considered not to have
submitted a bona-fide tender.

All like items shall be priced at the same rate. In valuing variations the lowest rate for any
individual item will be applied if unit rates vary from Bill to Bill or Section to Section.

The value of any item unpriced (or with a dash against it) shall be deemed to be included in
the prices or rates of other items in the Bills of Quantities. Each item shall be priced
individually; lump sums or percentage additions will not be accepted.

2. METHOD OF MEASUREMENT

2.1 Unless otherwise stated in this Preamble, the Bills of Quantities, the Conditions of Contract, or
Specification, the methods of payment and measurement shall be generally in accordance
with the Standard Method of Measurement of Building Works for use in (Malaysia) 1st Edition
(Metric) March 1976 and shall be nett as they are finished and fixed in the Works.

Deviations from the Standard Method of Measurement are not specifically stated or
itemized and the Contractor in pricing the bills is deemed to have full knowledge of the
deviations and accepted the method of measurement as contained in the Bills of
Quantities. Should any item be unclear, the Contractor shall seek clarification during tender
stage. No claim whatsoever will be subsequently entertained in this Documents, the
Employer Representative‟s decision shall be final and binding on the Contractor and the
Contractor shall not be entitled to any cost or time claim whatsoever.

Where room/location references are stated in certain items in the Bills of Quantities, they are
annotation for the Consultant Quantity Surveyor reference only.

Where work is wholly or partly Contractor‟s design the quantities shall be based on the
drawings produced by the Employer‟s designers showing the design intent. Quantities will
only be adjusted if the result of an instruction from the Superintending Officer. Quantities will
not be adjusted if the actual quantities vary due to modifications necessary to complete the
design, nor will additional items be measured if found to be necessary to complete the
design. Approval of any Contractor‟s design which requires additional items or higher
quantities in order to meet the original design intent does not constitute a variation.

3. COMPOSITE MEASUREMENT OF REPETITIVE WORK

3.1 Certain items in the Bills of Quantities represent composite works of uniform type of
construction. The tenderers shall themselves ascertain the quantities of the component works
involved in the items and price them accordingly.

5. DEFINITION

5.1 Wherever the term “allow for” is used in any items in the Bills of Quantities it shall mean that
the sum entered by the Contractor shall include all costs, charges and profits in respect of
the works or obligations referred to and shall be at the Contractor‟s sole risk. Payment for
such item shall be made at such times and in such installments as the S.O. may deem fit and
proper, taking into account the extent to which the works have been completed or
obligations met by the Contractor.

5.2 Wherever the term “provide a sum for” or „Provisional Sum‟ is used in any item in the Bills of
Quantities and a sum is inserted by the S.O. to cover the cost of any particular item of work,
the sum inserted shall be dealt with in accordance with Clause 30 of the Conditions of
Contract unless otherwise directed.

5.3 Wherever the word “supply” is used in any item in the Bills of Quantities it shall mean that the
article, material, plant or equipment etc., which are supplied under such item shall become
the property of the Employer.

5.4 Wherever the word “provide” or “provision of” or “providing” is used in any item in the Bills of
Quantities in the context of providing some article, material, plant or equipment (as distinct
from “provide a sum for” or „Provisional Sum‟ as described in para 5.2 above) it shall be
taken to mean that the Contractor shall make necessary arrangements to make available
for the use of the Employer or the S.O. such article, material, plant or equipment and the
sum entered by the Contractor shall include all costs, charges and profit in respect thereof.
At the end of the Contract Period or such other times as defined in the Bills of Quantities
ownership of such article, material, plant or equipment shall revert to the Contractor unless
otherwise stated. The Contractor‟s rates and prices shall include for removal, dismantling
and reinstatement of site where necessary.

5.5 The expression “Extra over” used in any item in the Bills of Quantities shall mean that
payment calculated at the rate inserted against that item is additional payment over and
above the particular item for which it is stated to be “extra over”.

5.6 Wherever the word „S.O.‟ appear or used in any part of tender document, it shall mean the
Architect.

6. TEMPORARY WORKS

6.1 Unless specially provided for in separate items in the Bills of Quantities the cost of all
temporary works shall be deemed to be covered by the rates entered in the Bills of
Quantities and shall include the following:

a) Temporary works for the service of the works as a whole e.g., gantries, temporary
works, structures for concrete mixing plant, block yard equipment, work yard sites.

b) Temporary works to form and construct permanent works described under particular
items in the Bills of Quantities, e.g., timbering for trenches, temporary sheet piling for
drainage, forming of bunds and pumping to keep works free of water.

c) Temporary works which are required for establishing and maintaining an access to
the Site and works areas to facilitate transport of the Contractor‟s labour, materials
and plant.

d) Removal of all temporary works and disposal of rubbish and reinstatement of site.

7. MOBILISATION

7.1 The item for Mobilisation in the Bills of Quantities shall be full payment for mobilising and
bringing to site all labour, plant and equipment and incidentals necessary to perform the
Contract works and for the removal of same on completion of work and shall include:

a) Transport and assembly of all items of constructional plant and equipment or such
other plant as may be required for the performance of the works.

b) Dismantling at the work site and removal of all constructional plant and equipment
so that the Site is left in a neat and tidy condition to the satisfaction of the S.O.

7.2 The sum entered by the Contractor against the items for “Mobilisation” in the Bills of
Quantities shall be paid in installments in proportion to the progress of the works.

8. CONCRETE WORK

Concrete work shall include for hoisting, pumping, pouring, packing, rodding and vibrating
concrete around reinforcement, completely filling the formwork to the shape required,
protecting, patching, curing and forming all necessary construction joints, cutting rebates,
grooves, chases, mortices, holes and any other sundry items of a like nature and building in
all wire ties, bolts, lugs nailing blocks, anchors and the like.

The rates for concrete shall also be deemed to include for providing trial mixes, tests on
materials and finished product, including non-destructive tests on and off-site.

Concrete beds and slabs shall include for laying on any type of sub-base, laying to falls or
cambers and preparing and leaving surfaces to receive screeds or pavings including laying
in bays and all necessary formwork to joints between bays.

The rates for concrete work are deemed to include for the following worked finishes types
specified within these contract documents:-

a) Tamped Finish : Tamp surface of poured concrete with edge of a board or beam to
give an even texture of parallel ribs

b) Trowelled Finish (Hand) : Float concrete to an even surface with no ridges or steps,
then immediately commence curing as specified in the Structural engineer‟s
specification. When the concrete is suitably stiff, hand trowel to give a uniform
smooth but not polished surface, free from trowel marks and other blemishes and
suitable to receive floor finishes by others

Surface water channels, concrete curbs and the like shall include for all angles, intersections
ends, outlets and any other sundry items of a like nature.

Precast concrete units shall include for all necessary reinforcement, moulds, holes rebates,
notching, sinkings, mortices and the like and for hoisting, bedding, jointing and pointing in
cement mortar (1:3).

Small concrete components may have been assumed to be cast in situ or precast units. The
Contractor is to note that he may adopt either method of construction but work shall be
paid in accordance with the description in the Bills of Quantities.

Waterproofing membranes are measured nett area in contact with the surface.

The waterproofing membranes system shall be applied in compliance with manufacturers‟


recommendations and the rates unless provided for as separate items shall include:-

1. laps and joints, turnups at angles, including bonding adhesives, bituminous sealant at

ends and interface connections with other waterproofing systems reinforcing mats

and strips etc.

2. skirtings, upturns and upstands, angle fillets, collars around fittings etc.

3. narrow widths

4. forming arrises, fair edges, butt joints, etc.

5. fitting and sealing around inlets, outlets including all pipe connections, projections

and the like

6. connections and joints between different proprietary waterproofing system

7. test on joints

9. FORMWORK

The cost for formwork shall include for all raking and circular cutting, small quantities, narrow
widths, treating surfaces in contact with concrete with mould oil or other approved
preparation as specified, all supports, staging, erecting, easing, striking and removal.

Rates for formwork shall include erection, raking and circular cutting, splayed edges,
notching, allowance for overlap and waste, passing at angles, battens and filleting to form
chamfered edges, strutting and in the case of formwork to vertical surfaces like walls,
columns and the like strutting over 12'0" high, nailing, bolting, wedging, easing, striking and
removal and oiling or lime-washing surfaces in contact with concrete before concreting.

“Sawn Formwork” shall mean formwork to produce concrete surfaces suitable for plastering
or tiling.

“Wrot Formwork” shall mean formwork to produce fair face concrete surfaces suitable for
direct application of decorations.

Curved formwork is given separately irrespective of radii which is not stated.

In case of wrot formwork, the rates shall also include for lining the formwork with suitable
material as directed by the S.O. and for cleaning fins remaining on the surfaces of the
concrete after removal of the formwork including rubbing down with carborandum stone,
making good any honey-combing or irregularities and for leaving the concrete with a true
and even surface.

10. REINFORCEMENT

Mild steel or high tensile steel rod reinforcement shall include for cutting to lengths, waste,
hooked ends, cranks and bending as required and for securing with and including No. 16
gauge annealed iron tying wires at all intersections, distance blocks and spacer bars
including chairs, for brushing and cleaning all rods free of rust, dust, mill scale, dirt, oil and
any other deleterious matters, fixing in position and supporting whilst concreting.

Steel fabric reinforcement shall include for all preparatory work for mild steel rod as
described above and shall also include for laps, all bending, cutting, notching around
obstruction, waste, securing with and including No. 16 gauge annealed iron tying wires and
for brushing and cleaning.

The weight of steel reinforcement excludes both the weight of tying wire and any allowance
for rolling margin, spacers, chairs, weight of weld and the Contractor is to include for these
items.

Rates for prestressing work shall include:-

a) submitting method statements with calculations, working drawings and


specifications, outline of construction procedures, manufacturers mill and test
certificates, tension jack, make and calibration certificates and other
documentation as required by the S.O

b) providing, assembling, handling and moving tensioning plant, equipment and tools
together with standby units and spares; and subsequent removal from site

c) taking all necessary field measurements

d) protecting and identifying all strands and anchorage assemblies

e) forming jacking recesses and construction joints between sections

f) tensioning in approved sequence

g) allowance for strands projecting beyond anchorages and jacking equipment, and
initial slips

h) cutting ends of strands, sealing and treatment after tensioning

i) providing special temporary support and working platforms for tensioning and
grouting

j) providing safety precautions during tensioning

k) any other labour, materials and plant/equipment/tools not specifically mentioned


but necessary for the proper and efficient execution and completion of the works.

11. BRICKWORK AND BLOCKWORK

Each item of brickwork and facings shall include for all rough and fair cuttings, over sailing
and receding courses, rough relieving and discharging arches, wedging and pinning, raking
out joints for and pointing flashings, bedding plates, bedding and pointing wood frames,
parging and coring flues, labour eaves filling, plumbing, angles, forming square and rebated
reveals, cut squints or birds-mouths, notches, forming, leaving or cutting chases, holes and
mortices, cutting and pinning and making good and other sundry items of a like nature.

Each item of blockwork shall include for all special made blocks, all rough and fair cuttings,
over sailing and receding courses, free ends, plumbing, angles, forming square and rebated
reveals, notches, cutting and pinning at top, cutting at ends and around openings, cutting
and bonding to intersections, angles and irregular angles, raking out joints for and pointing
flashings, bedding and pointing wood frames, labour eaves filling, forming notches, forming
leaving or cutting chases, holes and mortices, cutting and pinning and making good and
any other sundry items of a like nature.

Brick reinforcement shall include for all laps, cutting and waste.

Damp proof course shall include for all laps, angles, cutting, labour and materials required in
laying and pointing exposed edges.

12. MASONRY WORK

Each item of masonry work shall include for all rough and fair cuttings, wedging and pinning,
forming grooves or raking out for and pointing flashings, bedding plates, bedding and
pointing frames, paging and coring flues, labour eaves filling, salient angles, squints, quoins,
birdsmouths, splays, rounded angles, forming reveals, forming, leaving or cutting chases,
holes and mortices, cutting and pinning and making good and any other sundry items of a
like nature.

Battering work shall be also be inclusive in the rates.

All necessary templates shall be included for circular work and battering work.

Rates shall be inclusive for finishing fair face on all exposed faces.

13. ROOFING AND ROOF PLUMBING

Roof covering shall include for all laps and for all straight, skew and circular cutting at eaves,
verges top edges, abutments, valleys, hips, intersections etc. and for all holes for pipes and
the like and for subsequent deep, making good. Ridges shall include for stopped and fair
ends. Hip capping shall include for cut intersections of ridges and hips and the like.

Bituminous felt, membranes and the like, roof covering shall also include narrow widths, small
quantities, temporary rules, covering up, protecting after laying and cleaning off on
completion, all labour to form channels, gutters, arrises, fair edges, etc., all cuttings and
working around pipes and the like, cement and sand fillets, expansion joints. Skirting etc. shall
include for short lengths, angles, ends, forming chases in structure.

Flashing shall be held to include for forming grooves in structure and pointing or sealing in.

14. CARPENTER, JOINER AND IRONMONGER

Carpentry work shall include for cutting, notching, boring, sinking, pelleting, fitting, trimming,
mitring, halving, morticing, tenoning, dovetailing, scarfing and wedging and for all ends,
splayed edges, short lengths and temporary supports and any other sundry items of a like
nature.

Carpentry work shall also include nails, screws and where plugged, including drilling all holes
for plugging in walls etc. irrespective of the materials encountered.

Joinery work shall include for wrot surfaces, all cuttings, notching, holes, housing ends,
mitring, ends and shaped ends, angles, junctions, heading joints, short lengths, tongued
joints, splay or rounded edges, chamfers, rebates, grooves, punching nail heads in exposed
timber and filling in with matching putty, screwing and pelleting and any sundry items for the
proper carrying out of the work, including all necessary nails, screws, plugs and the like.

Ironmongery shall include for samples, fitting, cutting, sinking, boring, morticing and for the
supply of screws to match, oiling, easing and adjusting all moving parts, taking off before
painting and refixing and leaving in perfect working order.

Ceiling and wall linings shall include for narrow widths, small quantities, working in panels,
planting on with panel pins, brads or nails, cuttings and wastes, cutting holes and forming
openings including extra framings, etc. for exhaust fans, light fittings, air-condition air-grilles,
access panels, pipes etc. and all other sundry items of a like nature.

15. METALWORK AND STRUCTURAL STEELWORK

No allowance has been made in the weight of steel for rolling margin and steelwork is to
include for this item.

Metalwork shall include for preparing and priming the metalwork with one coat of red oxide
zinc phosphate primer before delivery, except where otherwise described, and all necessary
hoisting to the required levels.

Steelwork shall include for preparing and applying the specified post fabrication and post
erection treatment and painting.

Structural steelwork shall be blast cleaned as specified.

Welded work on site or in shop shall include for all labour, materials and appliances.

All items shall include or setting in position, building in, tightening nuts and fixing as
described.

All items where applicable shall include for cutting to length and shapes required, mitring,
scribing, welding, grinding and polishing of weld.

Bolts shall include for all necessary drillings.


Rates for steelwork shall include for drilling holes or cutting penetration (regardless of size)
through steelwork to suit M&E services and other connections.

Rates for aluminium works shall include everything necessary whether described herein or
otherwise for the complete installation of each unit in accordance with the Specifications,
Drawings and approved Shop Drawings. The rates shall also include the cost of design, all
testings required, samples, weatherseal and hardware, bolting lug/anchors etc. for fixing to
surrounding structures, all necessary metal framing and subframe members and supports
fixed to structure, steel support and fixing accessories, integral opening lights and windows,
associated insulation and vapour barriers, distance pieces, flashings, fire and smoke stop,
reveals, set backs, projections, edge trimming, protection etc, façade lightning protection
system, structural silicone sealant, cement filleting around frames and sealant pointing at all
exterior joints including all painting works. The rates shall also include for edges, gaskets and
end caps, cleats, brackets, channels and additional materials required for bending to profile
and shape.

16 FLOOR, WALL AND CEILING FINISHES

In-situ and tile pavings are to include, as applicable, for cleaning, hacking or slurrying of sub-
base to form key, wetting surfaces or soaking tiles before application, for narrow widths and
small quantities and temporary rules, for all raking and circular cutting, working or fitting up
to and around pipes, gratings, sanitary and other fittings and any other sundry items of a like
nature and for making good to this and other trades.

In-situ work is to include for all rounded edges, arrises, narrow widths, small quantities,
temporary rules and making good and other sundry items of a like nature.

Each item of skirtings, risers, moulded or rounded edges, channels and the like shall include
for short lengths, formed, cut and purpose-made angles, junctions, ends and for making
good up to and around pipes, fittings and the like and any other sundry items of a like
nature.

In-situ and tile finishes shall include for all polishing as described.

Plastering shall include for additional raking out joints of brickwork or hacking concrete
surfaces, as applicable to form key, wetting surfaces before application, providing
„Expamet‟ to timber or metal surfaces and joints between brickwork and concrete, for
narrow widths and small quantities, temporary rules, joints between different types of
plastering, internal angles, arrises, quirks, throats, groin points and other intersection of
curved surfaces, rounded coves and external angles not exceeding 25mm radius and
mitres, stops, etc., on cornices, mouldings, enrichments, coves, skirtings, gutters and strings,
all making good and any other sundry items of a like nature. Rates for plastering shall also
include for shadow gap plaster stop bead. This shall also apply to other similar works such as
Shanghai plaster, washed aggregate, granolithic paving, etc.

Lineal items of plastering such as skirtings, risers, channels and the like shall include for all
short lengths, stops, angles, ends, junctions, arrises, throating, fair edges and any other
sundry items of a like nature.

In-situ terrazzo work shall include for additional raking out joints of brickwork or hacking
concrete surfaces, as applicable, to form key, wetting surfaces before application, for
narrow widths and small quantities, temporary rules, internal angles, mitre angles, arrises,
joints between various types of terrazzo, quirks, throats and any other sundry items of a like
nature, fitting around pipes and for all making good to this and other trades.

Wall and floor tilling shall include soaking tiles in water before laying, for rounded edges,
internal and external angles, arrises, narrow widths and small quantities, cutting and fitting
up to or around frames, grilles, air bricks, sanitary and other fittings, pipes, brackets and any
other sundry items of a like nature. This shall similarly apply to the laying of marble and
granite.

Lineal items of tile skirtings, angles, capping, mouldings and the like are to include for short
lengths, cut and factory-made angle, junctions, ends and making good and for any other
sundry items of a like nature.

Metal lathing shall include for laps, all cutting, holes, notching and any other sundry item of a
like nature and for pointing all cut edges and damaged staples etc. after erection, with a
protective coat of approved bituminous paint.

17. PLUMBING

All types of pipes are to include for all necessary short lengths cutting and waste and fixing
to tiled of plastered surfaces including making good.

Fittings to all types of pipes are to include for all necessary extra joints, cutting and waste.

Rates for all pipes are to include for fixing with approved clips, brackets or holderbats as
required.

Galvanised steel or wrought iron pipe shall include for all short lengths, sockets, connectors,
elbows, bends, fire bends, tees, diminishing pieces, plugs, crosses, lapped ends, splay cut
ends and the like and for fixing to tiled or plastered surfaces including making good.

Copper pipes shall include for all short lengths, made bends and running joints.

Rates shall also include for jointing between diferent types of pipe, and jointing of pipes to all
types of fittings.

Rates for sanitary fittings shall include for all accessories and fixing to tiled or plastered
surfaces or unplastered blockwall including all necessary items for connecting and jointing

18. GLAZING

Glazing shall include for all gaskets and/or glazing felt, setting blocks, weatherseal,
waterproofing, raking and circular cuttings, waste, risks of breakage, cleaning all glass inside
and out, replacing all cracked, scratched or broken panes and leaving in good condition
on completion.

19. PAINTING AND DECORATING

Painting shall include for all necessary preparation for surfaces, as specified, stopping and
additional scaffolding required, all extra labour involved in external work and all cutting into
line.

Painting shall include for the use of multi-colours to walls, doors, frames and the like.

Painting of pipes and gutters shall include for painting on all tacks, wall hooks, holderbats,
brackets, ears and the like.

Painting of vertical surfaces and soffits shall include for painting two finishing coats to all
electrical wiring and battens, roses, conduits, switches, junction boxes, blocks and the like, in
contact with the surface to match the colour of the surface to which they are fixed.

20. STONEWORKS

Generally

The preambles for item (19) – Floor, Wall and Ceiling Finishes shall equally apply herein.

Particular Preambles for Stoneworks

The rates for stone floor paving shall include for:-

a) moisture testing to ensure that base screed to receive flooring is dry enough to

receive them

b) machine cutting, beveled edging and profiling

c) applying Impregnator on all surfaces and sides of stone panel

d) cutting, drilling and fitting as required for permanent penetrations through stone

e) providing movement, expansion and construction joints including Latham strip,

caulking etc.

f) matching panels for identification and delivery in matching sequence

g) marking panels for identification and delivery in matching sequence

h) preparing samples, mock-up, dry laying as specified

i) submitting Certificate of Origin for inspection

j) cleaning and the removal of all dirt, mortar or plaster dropping and making good

k) polishing, crystallization by mechanical polisher and abrasive graded and all
