DECLARATION OF DIVORCE BY CONSENT (MUBARAT)

This Declaration of Divorce (hereinafter referred to as the “Declaration”) is

made and entered into at Karachi on this 06 th day of October 2018
(hereinafter referred to as the “Effective Date”)

I, ___________________________________, holding CNIC #

___________________, Muslim, Adult, R/o
___________________________________, solemnly declare, affirm and state
as under: -

That I had entered into the Nikkah on __________, with

___________________________ Muslim, Adult, residing at
___________________________________________,Karachi, according to
FIQAH HANFIA under Muslim Laws, whereas out of that wedlock two kids
born 1. Baby girl namely _____________ born on ___________________
and 2. Baby boy namely _____________ born on ___________________.

That since from the day of marriage till today, we both fail to establish a
relation of husband and wife as well as fail to continue our matrimonial life
as prescribed our religion Islam and Muhammaden Law, due to unavoidable
differences between you and me some. The such matter brought before our
family members where it is mutually decided by the family elders of both
families that I may pronounce “Talaq” to you on the terms defined
hereunder;
1. That I signatory of this declaration shall pay all the due dower amount of
Rs.50,000/-(Rupees Fifty Thousand only) at the time of signing of this
divorce declaration before the family elders of both families as well as
witnesses of declaration.

2. That custody of both minors were offered to you

_______________________, where you refused to accept/keep the custody
of both minors _____________________________ later on with the
intervention of the family elders of both families, it is resolved that custody
of both minor shall remain with father ____________________.

3. That it is mutually agreed with the consent of both the families that,
custody of kids as defined hereunder shall remain with

kids/children.

4. That after signing of the present declaration of divorce

immediate effect and pronounce the word under the divorce (TALAQ)
three times (thrice) as per Muslim/Mohammadan Laws (as per sunni
fiqah) and under the Muslim Family Laws ordinance 1961.
