AFFIDAVIT OF DESISTANCE
(With Compromise Agreement)

I, CHRIS JOHN SOYOSA, of legal age, Filipino, married, and a

resident of Pelay Village, R. Castillo, Agdao, Davao City, after having been
duly sworn in accordance with law, hereby depose and state:

1. That I am one of the parties involved in an incident dated 21 March

2020 along the streets of Davao City while I was driving my Suzuki
motorcycle where I figured in an accident involving another vehicle,
a Ford Ranger pick-up truck with plate no. 1089.

2. That I and the owner of the said vehicle, CHRISTIAN D. DERIGAY,

already made an agreement and promised that he would shoulder the
expenses for my hospitalization at DMSF until I will be discharged in
the said hospital, to pay any damages sustained by the motorcycle,
and to compensate my lost income during the interim that I may not
be able to work as a call center agent, in exchange of me no longer
pursuing any legal action against him in connection with the said
incident.

3. That I am no longer interested in the prosecution of any case in

connection with the aforementioned incident and I hereby desist
myself from filing any criminal complaint arising out of the said
incident. I likewise waive any and all rights to institute said case in
the future and I free him from any responsibility or liability arising
from the said incident.

4. I am executing this affidavit voluntarily and free from any form of

coercion, compulsion or undue influence.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 23 rd
