DEED OF SALE OF MOTOR VEHICLE

WITH ASSUMPTION OF MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

That I, ESTELITO JUMAPIT, JR., of legal age, Filipino and a

resident of Roman Diaz St., Calinan, Davao City, am the owner of a
MOTOR VEHICLE, one 2017 Honda City, more particularly described as
follows:

That for and in consideration of the sum of EIGHTY THOUSAND

PESOS (₱80,000.00), Philippine Currency, to me in hand counted and
paid by AL VALLADARES RESPICIO, of legal age, Filipino, married,
and a resident of 20 Arellano St., Davao City, receipt of which is hereby
acknowledged by me to my entire satisfaction, do hereby sell, cede,
transfer, and convey as by these presents have SOLD, CEDED,
TRANSFERRED and CONVEYED, unto said AL VALLADARES
RESPICIO, his heirs, assigns, executors or administrators, the herein
above-described motor vehicle together with all the accessories therein
whatsoever, free from all liens and encumbrances other than a mortgage
with the Sterling Bank of Asia.

This Deed of Sale is governed by the following terms and conditions:

1. This motor vehicle is sold in an “as is where is” basis.

2. This motor vehicle is presently mortgaged with Sterling Bank of Asia,
the remaining balance of which is Three Hundred Fifty Two
Thousand Four Hundred Seventy Four Pesos (₱352,474.00), with
monthly amortization in the amount of Fourteen Thousand Nine
Hundred Pesos (P14,900.00), payable every 20th day of the month
starting May 20, 2019 until full payment on September 20, 2021.
3. The vendee shall assume the legal obligation to pay Sterling Bank of
Asia insofar as the remainder of the monthly amortization in
paragraph 2 is concerned and is hereby subrogated to the rights of the
vendor upon execution of this deed.
 4. The vendor shall defend the title and rights of the vendee from any
and all claims of whatever kind or nature from third persons except
claims by Sterling Bank of Asia arising from the contract of mortgage.

signatures this 26th day of April 2019, at Davao City, Philippines.

ACKNOWLEDGMENT

me their respective evidence of identity as above indicated, and
acknowledge to me to be the same persons who executed the foregoing
instrument denominated as “Deed of Sale of Motor Vehicle with
Assumption of Mortgage and further acknowledge before me that the same
is their free and voluntary act and deed.
