CRIMINAL COMPLAINT

The undersigned offended party, after first being duly sworned, accuses
MA. JOJIE SANTILLAN SAMSON alias JOY of Balopinos Residence, Blk. 7,
Notre Dame Village, Cotabato City, Philippines of the crime of ESTAFA, defined
and penalized under Art. 315, subdivision 1(b) of the Revised Penal Code,
committed as follows:

“That on or about the months of January to

June, 2002 at the City of Koronadal, South Cotabato,
Philippines, and within the preliminary jurisdiction of
the Honorable Court, the above-named accused,
having received in TRUST from the undersigned
offended party, Cash money worth ONE MILLION
TWO THOUSAND SEVEN HUNDRED SEVENTY
FOUR PESOS AND SIXTY CENTAVOS
(P1,002,774.60), Philippine Currency, under the
obligation involving the duty to purchase farm trucks
(weapons), other farm equipments, mahogany hills or
seedlings, coffee seedlings, and other farm inputs to
be used to the farm of the undersigned Private
Complainant, to turnover and remit the farm trucks
and equipments to the entrustor, or to return the
money to the entrustor in the event of non-
performance of the above task and objectives within
the period agreed upon, or upon demand of the
entrustor, but the accused with intent to gain failed to
buy said equipments, mahogany hills or seedlings,
coffee seedlings, and other farm inputs or to

 deliver/remit/or return the money to the
Complainant, instead used the same for her personal
interest and benefit to the damage and prejudice of
the Private Complainant in the sum amounting to
ONE MILLION TWO THOUSAND SEVEN
HUNDRED SEVENTY FOUR PESOS AND SIXTY
CENTAVOS (P1,002,774.60), Philippine Currency.

OF SEARCHING QUESTIONS AND ANSWERS.

1. Q: Do you swear to tell the truth and nothing else but the whole truth in this
investigation?

A: Yes, sir;

2. Q: State your name, age, civil status and other personal circumstances?

A: ROMIE D. UY, of legal age, single, Filipino, and a resident of Pinto

Subdivision, Crossing Diaz, City of Koronadal, South Cotabato;

3. Q: What prompted you to be here at the Municipal Trial Court in Cities, City
of Koronadal, South Cotabato?

A: To file a formal Complaint against MA. JOJIE SANTILLAN SAMSON

alias JOY;

4. Q: What is your Complaint against MA. JOJIE SANTILLAN SAMSON

alias JOY?

A: She committed the crime of Estafa against me, Sir.

5. Q: When, where and how was the alleged Estafa committed?

A: Sometime on the months of January to June, 2002. I gave ONE MILLION

TWO THOUSAND SEVEN HUNDRED SEVENTY FOUR PESOS
AND SIXTY CENTAVOS (P1,002,774.60), Philippine Currency to the
Accused, under the obligation involving the duty to purchase farm trucks
(weapons) and other farm equipments, mahogany hills, coffee seedlings,
and other equipments to be used to my farm situated at Sitio Acub, Brgy.
San Isidro, City of Koronadal, South Cotabato.

6. Q: What was actually the conditions between you and MA. JOJIE
SANTILLAN SAMSON alias JOY regarding the money you had given
her?

A: That she will turnover and remit the farm trucks, equipments and farm
inputs to me, or to return the money to me in the event of non-
performance of the above task and objectives within the period agreed
upon, or upon demand of the undersigned.

7. Q: What happened next?

A: The accused with intent to gain failed to buy said farm equipments, tree
seedlings, and other equipments, or to deliver, remit, or return the money

8. Q: Where did she receive the money?

A: In Cotabato City, Sir.

9. Q: Did you demand for the return of your money to you?

A: Yes, Sir, I informed her and demanded the return of my money but up
to now she failed and refused to comply.

10. Q: Where is Ma. Jojie S. Sanson alias Joy now if you know?

A: She is presently residing at Balopinos Residence, Blk. 7, Notre Dame

Village, Cotabato City, Sir.

11. Q: This transaction took place last January to June, 2002, why did you not
file the case against Ma. Jojie S. Samson that month and why only now
that you decided to file this case?

A: Actually, I intended to file this case last August, 2002, but I was prevailed
to give her a chance. In fact, now I realized that she was just fooling me
of her numerous promises to return to me the money which she
misappropriated. So, I finally decided to file a case against her in Court.

12. Q: For the meantime, I have no more question to ask, do you have more to
say, add or retract from your given statements?

A: No more, Sir.

A: Yes, Sir.
