DEED OF EXTRA-JUDICIAL SETTLEMENT

OF ESTATE AMONG HEIRS

KNOW ALL MEN BY THESE PRESENTS:

That we, HEIRS OF SPS. FLORENTINO PACANA and GUADALOPE JAUDIAN PACANA ,
namely:
MARTIN J. PACANA and ANASTACIA P. MALIAO, of legal age, Filipinos, all married and
resident of Sambulawan, Laguindingan, Misamis Oriental and Poblacion, Manticao, Misamis Oriental,
respectively; after being duly sworn, hereby declare and,

1. That we are the only, sole, legitimate children and surviving legal heirs of the late SPS.
FLORENTINO PACANA and GUADALOPE JAUDIAN PACANA who died intestate on August 22,1932
and on March 27,1988, all at Sambulawan, Laguindingan, Misamis Oriental;

2. That to the best of our knowledge and information the deceased left no will and no known debt
which remain unpaid whatsoever;

3. That the deceased at the time of her death left an agricultural land as her paraphernal property
and more particularly described as follows, to wit:

“A parcel of land located at Sambulawan, Laguindingan, Misamis Oriental, covered by

Tax Declaration No. 08-18-0009-04530, Cad. Lot No.13071-P, bounded on the North by Brgy.
Road, East by Lot No.02,29, South by Lot No.30, and West by Lot 02 of SEC 007., with an
area of 9,327 square meters more or less, in the name of GUADALOPE JAUDIAN.”

4. That by virtue of Rule 74, Section 1, Rules of court, We hereby divide, adjudicate and
partition among ourselves in pro indiviso equal shares:

That all these corresponding shares of the parties above-mentioned are subject to liabilities imposed by
Section 4, Rule 74, of the Rules of Court, in favor of any other possible heirs, creditors and other persons who
might be deprived of their lawful participation in the estate of the deceased for a period of two years; and

That this land has never been registered under Act 496 nor under the Spanish Mortgage Law, and the
parties hereby agreed to register this instrument under Act. No. 3344 as amended. That subject land is not
tenanted nor subject to leased.

That parties further state that they have complied with the provisions of Articles 1621 and 1623 of the
New Civil Code by giving notice to adjacent owners.

IN WITNESS WHEREOF, we hereunto set our hands this ____________________ at the City of
