past performanceis the report from Design Section and Construction Wing of the

I 3.2 Financial Proposal

3.2.1 The financial proposalshould be submittedusing the format specifiedand enclosedwith


I this RFP. This is a mandatory requirement for evaluation of proposals and needs to be
filled up carefully. The total cost is to be specified in the Form A-17.

I 3.2.2 The financialproposalshouldlist the costsassociated with the Assignment.Thesenormally


cover remuneration for staff in the field and at headquarters, per diem, housing,
transportationfor mobilization and demobilization,servicesand equipment (vehicles,office
t equipment furniture and supplies),printing of documents,surveysand investigations.These
costs should be broken into foreign (if applicable) and local cosjs. Your financial proposal

I 4.4 The completed technical and financial proposalsshall be delivered on or before the time,
date, and the location specified in the Data Sheet.

for the assignment,The Client shall make its best effort to complete negotiations at the

5.1 A Single-Stage-Two-Envelope proceduresshall be adoptedin ranking of the proposals.The


technical evaluation shall be carried out first, followed by the'fi,nancial evaluation. The

5.2 Technical Proposal


I 5.2.1 The evaluationcommitteeappointedby the Clients-hall,,carry out its evaluationfor all the
projectsas listed in Para 1.1, applyingthe evaluationcriteriaand point systemspecifiedin

6.2 Negotiations normally take from two to five days. The aim is to reach agreementon all
points and initial a draft contractby the conclusionof negotiations.

6.3 Negotiations shall commence with a discussionof your technical proposal. The proposed
methodology, work plan, staffing and any suggestionsyou may have made to improve the
TOR. Agreement shall then be reachedon the final TOR, the staffing, and the bar charls,
which shall indicate activities, staff and periods in the field and in the home office, staff
months, logistics and reporting.

6.4 Changesagreed upon shall then be reflected in the financial proposal, using proposed unit
rates(no negotiationof the staff month rates). ,,,,

I The Consultant shall arrange a rental furnished office at Islamabad in close proximity to
NHA HQ, lslamabad where consultant's office team shall be stationed.Office Equipment
shall be purchasedand usedduring the project life. At the end of project, office equipment,
stores, software with complete source codes, documents and project's record shall be
handedover to NHA's Focal Person.In caseof non-submissionof any above mentioned
item to NHA, the consultantmay be penalized(up to full amount,spenton purchaseof the
equipment,stores,software etc.).

2.6. Capacity Building and Training of NHA Staff:

I 2.7 Force Majeure

2.7.1 Definition

3.5 Other Insurance to be taken out by the Consultants

The Consultants(a) shall take out and maintain,and shall causeany Sub consultantsto take
out and maintain,at their (or the Sub consulta nts', as the casemay be) own cost but on
terms and conditions approved by the Client, insuranceagainst the risks, and for the

9. THE RIGHTS AND..D.U:EIS OF THE CONSULTANTS

9.1 The Consultantsshali fulfill their obligations under this Contract using the best technical
knowledge and. according to the accepted professional standards. It shall exercise all
reasonabieskill, care and diligenoe in the dischargeof the duties to be performed and shall
always act as-thefaithful advisor to and in the best interestof the employer.
The bonsultants personnelshall at all times endeavorto observeand respectall laws, rules,
regulationsand customsprevailing within the Islamic Republic of Pakistan.

9.2 Indirect Payments

The Consultantshall throughout the Servicesnot have nor permit its staff to have, any direct

I or indirect financial participation in procurementof construction contractsfor the Work to


be supervisedunder this Contract and shall ensurethat no paymentsare acceptedby it or its
staff during currency of the Contract other than under this Contract. Any such act if proven

9.5 Penalty

If the consultant fails to comply with the time to completion as given in the Contract, the
